ORDINANCE OF THE CITY OF SEAL BEACH
STABLISHING AND EXTENDING AN "INTERIM
ONE" ON THAT PROPERTY KNOWN AS THE
ACIFIC ELECTRIC RAILROAD RIGHT-OF-WAY
DECLARING THE URGENCY THEREOF AND
THAT THIS ORDINANCE SHALL TAKE EFFECT
IMMEDIATELY.

THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS:
Section 1. The Planning Commission of the City ~f Seal Beach, by their Resolution
No. 76, recommended the immediate adoption of an l"Interim Zone" designation
for that property known as the Pacific Electric Railroad Right-of-Way. Section
65858 of the Government Code of the State of California provides for adoption of
such an Interim Zone as an urgency measure. ,

Section 2. An "Interim Zone" classification was ladopted as Ordinance No. 688 by
the City Council of the City of Seal Beach on August 22, 1966.

Section 3. Pursuant to provisions of said Section 65858 of the Government Code
such ordinance shall be of no further force and effect 90 days from the date of
adoption thereof. Said Section 65858 also provid~s that the legislative body
may by a four-fifths vote extend such interim ord~nance for one year.

Section 4. A one year extension of the provisions of Section 2 of said Ordinance
688 is hereby adopted. The provisions of said Se~tion 2 are as follows:
An "Interim Zone" classification is hereby adopted for that strip of land in the
City of Seal Beach known as the Pacific Electric ~ilroad Right-of-Way. Said
"Interim Zone" shall apply to those portions of said Right-of-Way located within
the U.S. Naval Weapons Station and those portionsl of said Right-of-Way located
outside of said Weapons Station. The requirement's of said "Interim Zone" shall

be that no new use or development of any kind sha~l be allowed on any portion of

said Right-of-Way without the granting of a Conditional Use Permit ~yythe Planning
Commission and the approval of the City Council. I
Section 5. Urgency. The City Council finds and aetermines that this is an urgency
measure because: I
(a) The Pacific Electric Railroad ha~ terminated operation of rolling
stock over its tracks in the Cit~ of Seal Beach.
The ownership and control of thei Right-of-Way now reverts to
various property owners. I
The Pacific Electric Railroad Right-of-Way is presently unzoned.

The City of Seal Beach has adopted a Comprehensive General Plan

of development and is in the process of study and adoption of
a new zoning ordinance. I
Until present planning and zoning studies are completed it is
imperative for the best interest I of the community that possible
undesirable development of this property be prevented.

Section 6. Effective Date. This ordinance being an urgency measure, as stated
above, shall take effect immediately upon its pas~age by the City Council.

Section 7. Posting. The City Clerk shall, within fifteen (15) days after adoption,
cause this ordinance to be posted as required by !law.
