MINUTES OF THE PLANNING COMMISSION MEETING OF APRIL 1, 1981 THE PLANNING COMMISSION MET IN REGULAR SESSION ON WEDNESDAY, APRIL 1, 1981, IN THE COUNCIL CHAMBERS OF THE CITY ADMINISTRA- TION BUILDING, 211 8th STREET. SEAL BEACH. THE MEETING WAS CALLED TO ORDER AT 7:30 P.M. BY CHAIRMAN COVINGTON AND THE PLEDGE TO THE FLAG WAS LED BY VICE-CHAIRMAN GILKERSON. PRESENT: Knapp, Gilkerson, Leibert, Covington, Ripperdan ABSENT: None The minutes of the March 4, 1981 meeting and the minutes of the March 18, 1981 meeting were approved as submitted. PUBLIC HEARING . .A. Noel's Restaurant, 16281 Pacific Coast Highway, CP-2-81 Conditional Use Permit for on-sale alcoholic beverages in conjunction with an existing restaurant. Public Hearing opened. Michael Patty, owner/applicant, spoke briefly on his intent as to the on-sale of alcoholic beverages. Mr. Patty also informed the Commission of the possibility of a singer on the premises until 9 p.m. No one from the audience spoke for or against the application. Public Hearing Closed. Mr. Covington expressed concern as to whether the sale of alcoholic beverages would be maintained on-site only. Secretary stated the application was for on-sale and that no alcohol would be sold otherwise. Mr. Covington asked the Secretary if the residents in the surrounding area had been notified of the application. Secretary responded to the question stating all residents had been notified. Ripperdan moved approval of CP-2-81; seconded by Gilkerson and unanimously approved. Resolution 1123 ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS Secretary referred to a letter submitted by the San Gabriel Pacific Park Society and stated the letter was in reference to the Draft Land Use Component to the LCP and should be acknowledged with the New Business Agenda item. NEW BUSINESS . Draft Land Use Component to the LCP which was referred back to the Planning Commission by the City Council. '. . New Business Page 2 Secretary read letters from the San Gabriel Pacific Park Society and from the Assistant Executive Director of the Coastal Conservancy regarding availaibility of CEIP loans. A letter from Robert Kent, Department of Commerce Coastal Zone Management was also brought to the attention of the Commission. Mr. Gilkerson read a statement into the record as a member of the LCP committee and Planning Commissioner. Mr. Gilkerson was of the opinion that the proposed changes to the LCP should have been referred to the LCP committee rather than simply changed by the City Council without additional input. Mr. Covington informed the Commission of his telephone conversation with Joy Jacobson, Administrative Assistant with Senator Cranston's office and advised the Commission that he was told the DWP project was 1 of 3 projects in motion, having the same dollar value and that the DWP project .had an excellent chance for funding. Discussion followed on CEIP loan availability. Mr. Ripperdan expressed concern as to the Coastal Conservancy Plan having to be adopted. Secretary replied to the question stating every plan has potential to be conditioned by the Coastal Commission, but once the LCP was adopted, it would not have to go to the Coastal Commission. Ripperdan asked if the LCP could be amended. Secretary advised the Commission that after adoption there could be no amendments without obtaining State Coastal Commission approval. Extensive discussion followed regarding the Hellman property specific plan, participation of Commission members on the work program for the LCP and conceptual approval of the LCP by governing agencies and commissions. Concern was expressed as to constraint time imposed on the LCP. Secretary replied to the concern stating the deadline was July 1, 1981 and after that time the Regional Coastal Commission would be non-existent and any further amendments to the LCP would have to be heard in Sacramento at City's expense. Mr. Knapp expressed concern on the DWP site as to the availability of funds, drawbacks to the City if the LCP was arbitrarily pushed through and the amount of money spent by the City to purchase the DWP site and Conservancy Concept. Joyce Risner, Seal Beach resident, was opposed to the proposed LCP with amendments stating her concern regarding the DWP proposed restaurant revenue, cost of restoration of the property and proposed condominiums over a commercial establishment. Gordon Shanks, 215 Surf Place, a member of the LCP work program and Board Member of the San Gabriel Pacific Park Society, favored the draft LCP . with reference to the DWP project. New Business Page 3 . Christine Agar, 172 Cottonwood Lane, favored the Draft LCP with reference to the DWP site. . Phil Lund, B-57 Surfside, was in favor of the Draft LCP's attempt to deal with public access via Phillips Street. Discussion followed on the intent of City Council referring the LCP back to the Commi ss ion. . . Ms. Leibert questioned money available for the 'OWP site (federal funds) but stated that if the City could not raise the money to purchase the property the current zoning would protect the property from over development . by a private builder. Covington made a motion to modify Policy 15 by inserting "consistent with" after the word "shall;" to strike "and" after "Plan" and insert "and any previous motions by City Council and the Redevelopment Agency" after RCP. Policy 15 therefore would read as amended: ...DWP Parcel. The Land Use Plan for the Department of Water and Power (DWP) parcel shall be consistent with the City's General Plan, zoning designations of R/C/P and any previous motions by the City Council and Redevelopment Agency. This property may be developed under a specific or precise plan as one parcel... Motion seconded by Mr. Ripperdan and approved by the following vote: AYES: Knapp, Leibert, Covington, Ripperdan NOES: Gilkerson MINUTE ORDER Knapp moved approval of the Draft LCP as amended; seconded by Mr. Ripperdan and approved by the following vote: AYES: Knapp, Leibert, Covington, Ripperdan NOES: Gi 1 kers on MINUTE ORDER Ms. Leibert questioned the orlgln of the design standards (item 6, page 28 of the Draft LCP).
