RESOLUTION OF THE CITY COUNCIL OF THE.CITY
OF SEAL BEACH, CALIFORNIA, DECLARING ITS
STRONG BELIEF IN THE NECESSITY OF CONTINUED
EXPANSION AND CONSTRUCTION OF STATE, INTERSTATE,
COUNTY AND CITY HIGHWAY SYSTEMS IN CALIFORNIA,
AND IN THE PROTECTION OF GAS TAX FUNDS FROM
BEING DIVERTED FOR OTHER PURPOSES, THAT CITIES
AND COUNTIES CONTINUE TO HAVE THE RIGHTS TO SPEND
A PORTION OF THEIR GAS TAX FUNDS FOR MASS
TRANSIT AS SET FORTH IN PROPOSITION 5 APPROVED
BY THE VOTERS OF THE STATE OF CALIFORNIA, AND
RECOMMENDING THE APPOINTMENT OF HIGHWAY
COMMISSION MEMBERS WHO RECOGNIZE THE ECONOMIC
IMPORTANCE OF A STREETS AND HIGHWAY SYSTEM TO
THE CITIZENS OF THE STATE OF CALIFORNIA.
the City Council of the City of Seal Beach, California, has
repeatedly gone on record during recent years supporting the
construction and completion of the Interstate, State Freeway,
County Highways, and City Streets systems; and
WHEREAS, the above streets and highways systems are an absolute necessity
in Californta; and
WHEREAS,
WHEREAS, these street and highway systems provide the transportation
facility for an oyerwhelming majority of the people Tn the State
of California compared to mass transit, ai'rcraft, bus, rail or
boat; and
WHEREAS, these street and highway systems also provide a major transportation
facility for the trucking of goods from farm and factory to the
citizens of the State of California; and
WHEREAS, historically through the ages, civtlization has grown and
prospered at the crossroads of good 'transportation systems; and
WHEREAS, the State, counties and cities of the State of California with
the past gas tax revenues have been able to construct and
matntain one, if not the finest, street and highway systems in
the world; and
WHEREAS, this accomplishment has been possible primarily because the gas
tax funds have in the past been protected and reserved for
streets and highway purposes; and
WHEREAS, to complete the street and highway system intended when the gas
taxes were established and to maintain the system, it is necessary
to reserve these funds for street and highway purposes only; and
WHEREAS, considerable money formerly spent for streets and highways has
already been siphoned away for other purposes; and
WHEREAS, there is considerable pressure to divert even more funds into
mass transit and other social programs; and
WHEREAS, the past loss of funds together with inflation and the reduction
of gasoline tax revenue income has already resulted in considerable
curtailment of new constructTon and maintenance for State, county
and city projects; and

WHEREAS, the City of Seal Beach currently receives about $280,000 in
gasoline taxes annually for maintenance and construction of
which approximately half is spent for maintenance and the
other half on construction; and
WHEREAS, the City has relied upon the State for additional gas tax
funds for construction of major improvements to the City
highway system; and
WHEREAS, present and future diversion of gas tax funds at the Federal,
State and county levels will seriously curtail both maintenance
and construction; and
WHEREAS, an overwhelming majority of the people of California and of
the City of Seal Beach will continue to rely on their personal
automobile use of streets and highways; and
WHEREAS, the mass transit facilities proposed to use a tremendous amount
of the diverted gas tax funds which will only benefit a very
small percentage of the people of the State of California; and
WHEREAS, to offset the diversion of gas tax funds legislative action is
now underway to increase the gas tax a minimum of two cents
per gallon; and
WHEREAS, this increase in gas tax would not be necessary if the present
gas tax funds are not diverted for purposes other than streets
and highways.
NOW, THEREFORE, BE IT RESOLVED that the Ci~y of Seal Beach, California,
in a regular session assembled this ~~ day of February, 1976, as
foll ows:
1. That gasoline taxes continue to be used exclusively for State, county
and city streets and highways.
2. That any excess gasoline tax money, not needed ~y the State, be
distri'buted to the cities and counttes in dtrect pro!lortton to the
number of people tn the ctties and county untncorporated areas.
3. That the cities and counties then be allowed to exercise thetr
right to spend a portion of the gas tax money for public or mass
transit as set forth in Proposition 5 approved by the voters of
the State of Californi'a.
4. That the State Highway Commisstoners be appointed who recognize the
histortcal economic tmportance'of a transportation system to the
citizens of the State of Caltfornia.
