I RESOLUTION NUMBER ,;;531 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE PRIMARY MUNICIPAL NOMINATING ELECTION HELD IN THE CITY OF SEAL BEACH ON THE 30th DAY OF MARCH, 1976, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS, A Primary Nominating Municipal Election was held and conducted in the City of Seal Beach, County of Orange, State of California, on Tuesday, the 30th day of March, 1976, as required by Ordinance Number 984 and Ordinance Number 986 of the City of Seal Beach, California; and 1 Notice of said election was duly and regularly given in time, form, and manner as provided by law; that voting precincts were properly established; that election officers were appointed; and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed, and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law and charter citeis; and WHEREAS, Pursuant to Resolution Number 2527, adopted the 23rd day of February, 1976, the City Clerk of the City of Seal Beach canvassed the returns of said election and has certified the results to this City Council, said results are received, attached, and made a part hereof as "Exhibit A." WHEREAS, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: I Section 1. That there were twenty-seven (27) voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in the City of Seal Beach, California, as established for the holding of State and County elections. Section 2. That said Primary Nominating Municipal Election was held for the purpose of nominating the following officers of said city as required by the Charter of the City of Seal Beach and general laws of the State of California, to wit: One member of the City Council of said City for the short term of two years from Councilmanic District One. One member of the City Council of said City for the full term of four years from Councilmanic District Two. One member of the City Council of said City for the full term of four years from Councilmanic District Four. For City Clerk for the full term of four years. For City Treasurer for the full term of four years. Section 3. That a measure was proposed submitting a Charter Amendment to the voters amending Section 1010 of said Charter. That the names of the persons voted for at said election for member of the City Council in Councilmanic District One are as follows: Barbara Barton Ed Mi schell Ronald "Chi" Kredell Jesse Rountree Stan Steinbe,rg That the name of the person voted for at said election for member of the City Council in Councilmanic District Two is as fo 11 ows : I Russ B. Barry Morgan William J. Ruzgis That the Charter Amendment read as follows: Charter Amendment No.1. Shall the Charter of the City of Seal Beach pertaining to bidding requirements be amended to expand the bidding exceptions YES for work performed by City or County of Orange Departments to include public NO buildings, works, utilities, parks and playgrounds? I That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates and for and against said Measure are as shown in Exhibit "A" attached hereto and made a part hereof. Section 6. The City Council does declare and determine that Ronald "Chi" Kredell and Jesse Rountree are nominated as a member of the City Council for the short term of two years from Councilmanic District One; 1 I 1 ~ . Gray is elected as a member of the City Council of the City of Seal Beach for the full term of four years from Councilmanic District Two; Frank J. Laszlo is elected as a member of the City Council of the City of Seal Beach for the full term of four years from Councilmanic District Four; Jerdys Weir is elected as City Clerk of the City of Seal Beach for the full term of four years; D. Barry Morgan is elected as City Treasurer of the City of Seal Beach for the full term of four years; That as a result of said election. a majority of the qualified voters voting on said measure relating to Section 1010 of theCity Charter did vote in favor thereof. and that said proposition was carried, and shall be deemed adopted and ratified. Section 7. The City Clerk shall enter on the records of the City Council of the City of Seal Beach. a statement of the result of said election showi~g: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; , (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; (5) The number of vote~ given in the City to each person; (6) The number of votes given for and against the measure. Section 8. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereon in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. '" Presented to you is my certification of the results of the Primary Municipal Election and subsequent resolutions and ordinance required by our Charter. Voter turnout city-wide was 28%, in Council District One - 47%, District Four ~ 41%, and Leisure World precincts had a 22.2% voter turnout. I chose to go to private enterprise for services in providing the sample ballots this year for two reasons: (1) the County was extremely busy and in the midst of an administrative change; (2) the cost difference was minimal and I had utilized the services of this firm in 1974 to print the index of registered voters and had found this most satisfactory. There was an error in the sample ballot process and I have, after considerable research, determined that the error existed in the computor print out of the address insert and have apprised the firm to re-evaluate their billing to the City accordingly. ' I do wish to submit for the record that one precinct apparently failed to follow proper instr~ctions that resulted in a difference of five (5) ballots which after consulting with our City Attorney we have determined would not affect the results of the election and therefore not warrant further action. Although a minimal number of registered voters did not 'receive sample ballots, this too. would not affect the election since our office was available, as is the County office to provide voter information as to polling places and other pertinent data. The last resolution on your agenda this evening is requesting County services for the printing of the voter registration index and sample ballot preparation for the General Municipal Election, May 11.
