MINUTES OF THE PLANNING Crn~MISSION MEETING OF AUGUST 19, 1981
THE PLANNING COMMISSION MET IN REGULAR SESSION ON WEDNESDAY,
AUGUST 19, 1981, IN THE COUNCIL CHAMBERS OF THE CITY ADMINIS-
TRATION BUILDING, 211 8th STREET, SEAL BEACH. THE MEETING
WAS CALLED TO ORDER AT 7:35 P.M. BY CHAIRMAN COVINGTON AND
THE PLEDGE TO THE FLAG WAS LED BY VICE-CHAIRMAN GILKERSON.

The minutes of the August 5, 1981, meeting were approved as submitted.
PUBLIC HEARINGS

A. Wayne and Darlene Shaddox. V-3-81, 222 7th Street
Allen Parker, City Manager. presented the Staff Report on this variance request
for 3/10 unit over density in the R-3 zone. Based upon the zoning definitions,
no hardship exists in this application. The City Attorney recommends that this
matter should be handled by the City Council based upon the special and unique
set of circumstances surrounding administrative approval of the development.
Public Hearing Opened.
Darlene Shaddox, 222 7th Street, stated that they had complied with all known
City proCedures and were ver~ surprised to learn of additional requirements
after demolishing the two (2) rear units. They feel that hardship exists due to
the circumstances surrounding the approvals of the project.
Commissioner Covington asked if the Staff Report is accurate in dates, times and
actions regarding the approval process.
Darlene Shaddox agreed that the Staff Report was correct.
City Manager stated that the 'applicant has submitted a letter outlining hardship
in this case and referencing various legal matters. Due to the legal aspects with
this matter, it should properly be handled by the City Council; however, no clear
mechanism exists for direct Council review. It was necessary for the'matter to
first be heard by the Planning Commission and, if denied, appealed to City Council.
Reva Harrison, 1625 Seal Way, spoke in favor of the variance based upon equal
treatment for the applicant.
Public Hearing Closed.
City Manager noted that historically, no variance request of this type has been
approved since the current density standards were adopted. Approval of this
application could, constitute a prescedent for future applications.
Covington noted that the Planning Commission has been exploring the possibility
of amending the code to permit construction of units when the density factor
exceeds 10 'uni t.

Gilkerson raised the potential problem of exceeding 20 units per acre if all or
a majority of lots are 50 feet wide in any acre of land.

Commissioner Leibert moved, to deny V-3-81; motion seconded by Gilkerson.
Commissioner Covington stated, for the record, that he would abstain from
voting on the motion ~ince Town and Country Bank provided financing for the
project.

Applicant was advised of their right to appeal the denial to City Council.
B. Senior Corky's, The Dunes Cafe, CP-5-81, 909 Ocean Avenue
The applicant is requesting a Conditional Use Permit for on-sale beer and
wine in conjunction with a restaurant at 909 Ocean Avenue. The applicant
has requested the matter be continued for two (2) weeks in order to meet
with the Police Department on the crime statistics in the general area where
the building is located.
Public Hearing Opened.
Commissioner Goldenberg moved to continue the matter until September 2, 1981;
motion seconded by Commissioner Leibert and unanimously approved.
. C. H/CD Program, VIII Year, Second Public Hearing
This is the second public hearing on the eighth year of the H/CD Program.
The questions raised by the Planning Commission on August 5th regarding:
Zoeter School, Exxon Park site and Interval House were answered as follows:
Zoeter School Recreational Facilities
Not eligible under Federal register.
Exxon Park Site
May be eligible but no plans have been prepared for uses on
the site. In addition, $87,600 is already set aside for initial
development of the site.
Interva 1 House
The City should support Interval Houses' H/CD application by letter
or resolution.
Public Hearing Opened.
No one from the audience spoke for or against the issues.

The Planning Commission discussed various possible projects for year VIII.
At the conclusion of the discussion, Gilkerson moved to approve year VIII fund

transfers as recommended in the Staff Report; motion seconded by Commissioner
Leibert and unanimously approved.
Commissioner Gilkerson moved to approve year VIII projects as recommended by
the Staff Report; motion seconded by Commissioner Goldenberg and unanimously
approved.
Minute Order Action
Subjects Commissioners May Wish to Discuss
A. Commissioner Goldenberg raised the question of how the Commissions/
Council's conditions on approvals are implemented and if the Commission
is informed about project problems. He is specifically concerned about
the extreme slowness of finishing the project at 12200 Montecito Road.
It is the duty of Staff to inform the Planning Commission of conditions not
met by the applicant. In the case of 12200 Montecito Road, no final
inspection was made and there is no maximum time to complete an active
permi t.
Staff was directed to look into the possibility of imposing time limits
on completing a project.
B. Commissioner Gilkerson noted that the sign on Chuck Dent Surfboards, Ocean
Avenue, covers the while wall. Staff noted that painted signs do not
require permits and so limited control exists over these signs. A large
painted sign may violate the intent of the sign ordinance.
