MINUTES OF THE PLANNING COt1MISSION MEETING OF OCTOBER 7, 1981
THE PLANNING COMMISSION MET IN REGULAR SESSION ON WEDNESDAY,
OCTOBER 7, 1981, IN THE COUNCIL CHAMBERS OF THE CITY ADMINIS-
TRATION BUILDING, 211 8th STREET, SEAL BEACH. THE MEETING
WAS CALLED TO ORDER AT 7:30 P.M. BY CHAIRMAN COVINGTON AND THE
PLEDGE TO THE FLAG WAS LED BY VICE-CHAIRMAN GILKERSON.
PRESENT: Knapp, Covington, Gilkerson, Leibert
EXCUSED ABSENCE: Goldenberg
The minutes of the September 16, 1981 meeting were approved as submitted.
PUBLIC HEARINGS:

A. Richard Elvidge, V-4-81
Variance for additions to a non-conforming building. At the request
of the applicant, the matter was continued to October 21, 1981.
B. Tom Hyams & Howard Brief, V-6-81
Variance application for conversion of a non-conforming manufacturing
building to a commercial zone to commercial uses with less than required
parking. The proposal is to reduce the size of the building by 23%, reserve
36% of the building for a night time restaurant dinner house, and use the
re~ainder of the building for conforming day time commercial uses. Parking
for day time uses would be provided on site (19) and at St. Anne's Church
(20). Parking for night time uses would be provided on site (19), at 311
Main Street (32) and at' 240-250 Main Street (15). In addition, 39 public
parking spaces exist 'at Electric and Main for use both day and night.
Public Hearing Opened. Tom Hyams, 311 Main Street, stated that he would answer
any questions.
Commissioner Leibert asked when North Sails would be leaving. Mr. Hyams
indicated that they will leave in November or December.
Commissioner Gilkerson asked about the use of the small first floor office.
Mr. Hyams noted that this would be a management office for the building.
Commissioner Gilkerson asked about the types of offices for the second and
third floors. Tom Hyams said that these offices would be used for such things
as insurance, yacht broker, real estate and attorney's.
Commissioner Knapp asked about the use of parking at St. Anne's. Mr. Hyams
said that parking would be available for day time uses.
Commissioner Gilkerson asked about the restaurant square footage. Tom Hyams
indicated that the restaurant would be about 6000 sq. ft. in area and parking
would be by valet in order to use the parking spaces at 311 Main Street.
Catlmissioner Covington noted that no discussion of a loading zone for the
restaurant was covered in the Staff Report.

John Pitman, 123 Cottonwood Lane, spoke in opposition to the variance on the
basis of lack of parking for the Lighthouse Christian Assembly Church at
10th and Electric Avenue.
Commissioner Gilkerson noted that on-street parking from 10th Street to Main
Street had been eliminated since the buses were moved from Ocean Avenue to
Electric Avenue.
Discussion followed on alternatives to provide more parking in the area.
Public Hearing Closed.
With the consent of the applicant, the matter was continued until October
21, 1981.
PLAN REVIEWS
A. Anna Roh, 1244 & 1250 Pacific Coast Highway, PR-I-81
This plan review is to consider addition of 1700 sq. ft. to an existing
cortlllerci a 1 offi ce buil di ng ,provi de an additi ona 1 parking area and add
landscaping. The building was approved by Resolution 1074 without a
commercia1 10ading zone in 1977. The applicant requests a Planning Commission
affirmation of Resolution 1074 to permit expansion without a loading zone.
After Discussion, Knapp moved to affirm Resolution 1074 noting that this
proposal involves 1700 sq. ft. of expansion to the building; seconded by
Covington and unanimously approved.

B. Jim Watson, 101 Main Street, PR-2-81
This plan review is to consider enclosing 250 sq. ft. of second floor
deck for use as a recepti on area for the offi ce in sui te "A". The app 1 i cant
requests that the Planning Commission affirm that the Main Street parking
district parking lot provides a portion of the parking for 101 Main Street.
Commissioner Covington asked if the properties in the district were assessed
on their usage or square footage. Staff noted that the district ~as based
upon lot area.
After discussion, Knapp moved to approve PR-2-81; seconded by Gilkerson and
unanimously ,approved.

RULING, DETERMINATION AND INTERPRETATIONS

A. Nelson's Nursery, 1422 Ocean Avenue
At the direction of the Planning Commission, the subject of fresh produce
sales at nurseries was placed on the agenda for an interpretation of use
under c1arification of ambiguity.
After being refused a business license by the City, the owners of Nelson's
Nursery began sell ing fresh produce at their nursery. The Owners were directed
by the P1anning Commission to cease fresh produce sales until the Commission
ruled favorably on the use and the owners had a valid City business license
for the use. The owners refused the P1anning Commission's letter of

September 17, 1981. Secretary read the letter into the record. For the
record, it was noted that the owners were present.
Mrs. Nelson, 1422 Ocean Avenue. owner of Nelson's Nursery, stated that her
business license covered the sale of fresh produce.
Commissioner Covington and Mrs. Nelson discussed the definition of nursery.
Covington noted that fresh produce did not fall under the dictionary definition
of nursery. Mrs. Nelson stated that their State Agricultural Permit allows
fresh produce sales and they have met all Orange County Health Department
requirements. '
Commissioner Knapp asked to address Mrs. Nelson. Mrs. Nelson refused.
Danny Nelson, 1422 Ocean Avenue, stated that the Planning Department was"
screwing with their livelihood."
. Commissioner Knapp noted that the use before the Planning Commission is -
if fresh produce sales fall under the normal types of uses found in a nursery.
Commissioner Gilkerson noted that a sign advertising fresh produce had been
installed recently.
Danny Nelson stated that fresh produce sales was necessary to support the
nursery business. They were going to seel produce to the School District.
Commissioner Covington expressed concern about the possibility of insects
from nursery plants affecting the fresh produce and some method for
protecting the produce is necessary if both types of products are in close
proximity.
Commissioner Knapp moved to adopt Resolution 1241; seconded by Gilkerson and
unanimously adopted.

ORAL COMMUNICATIONS
Danny Nelson, 1422 Ocean Avenue, stated that they will continue to sell
fresh produce and accused the Planning Commission of holding a Kangaroo Court.
REPORT FROM SECRETARY
A. Secretary announced that the City should change the R/C/P designation
on the Department of Water and Power site to reflect the adopted 70% open
space - 30% development. The Commission directed the matter to be advertised.
B. Secretary announced that the Commission may inspect 320 10th Street at
B:OO a.m. Saturday October 17, 1981.
C. Commissioner Knapp distributed a letter of resignation from the Planning
Commission effective October. 22, 1981. The Commission received the letter
with deep regret.
