MINUTES OF THE PLANNING COMMISSION MEETING
OF
NOVEMBER 4, 1981

The Planning Commission met in regular session on Wednesday,
November 4, 1981, in the Council Chambers of the City Adminis-
tration Building, 21l 8th Street, Seal Beach. The meeting was
called to order at 7:40 P.M. by Chairman Covington and the
pledge to the flag: was led by Vice-Chairman Gilkerson

The minutes of the October 21, 1981 meeting were approved as submitted.
PUBLI C HEARINGS
A. Henry and Ann Bird, V-5-8l
Variance for six-foot fence in front yard setback at 4789 Hazelnut
Avenue. Public hearing opened. Henry Bird, 4789 Hazelnut, noted
that the proposed fence is solid block, 4 feet high and wrought iron
for two feet above the block. In addition, fences on both adjacent
properties are closer to the front property line than his proposed
fence. Public Hearing Closed.
The Commission discussed the fact that existing vegetation did not
constitute hardship.
Goldenberg moved to approved Resolution 1242 as modified.
Motion seconded by Gi1ker~on and unanimously approved.

B. Tom Hyams and Howard Brief, V-6-8l
Variance to change a manufacturing building to commercial with. less
than required parking. Pub1 ic Hearing opened.
Gilkerson questioned the use of parking on nearby commercial lots to
serve the project site since almost all listed buildings were short
parking for thei r own use.
Tom Hyams, 31l Main Street, Howard Brief, 222 Main Street. Although
there is a parking problem in the area, on paper, actually most businesses
generate suffi ci ent customers. I f this vari ance is approved, they will
require employees to park in the church lot and they will not add any
more medical uses to ttlebuilding. The building is proposed to be
reduced in area by 23% and fewer employees will be in the building
than at present. I
Leibert asked if the applicants will maintain the church parking lot.
The applicants will keep the church lot in good condition.
Gilkerson noted that if the variance is granted, both sides of the 300
block of 10th Street and Electric Avenue north between 10th and 11th

Streets should be posted, for 1 hour parking during the week days.

Dr. Logan, 311 Ocean Avenue, spoke in opposition to the variance
due to the lack of parking, the tandem parking in the building,
loss of 5 spaces on Electric Avenue for buses and the handicapped spaces
in the public lot which are not aways available for handicapped use.

Cheryl Heggestrom, 501 Agua Place, noted that the public parking lot
is full Wednesday through Friday. The City should consider adding parking
on the P.E. right-of-way to provide the needed additional parking. She
ex'pressed concern about future sale of the building and parking availability.
Public Hearing Closed. .
The Commission extensively discussed: existing parking, building use,
employees, parking availability and future uses, employees parking
availability. It was n~ted that the sailmkaing use will be leaving in
about one month.
Gilkerson moved to deny V-6-81 until more parking can be provided.
Motion seconded by Leibert.

C. Tentative Tract Map 11302 and Precise Plans
A staff report was given by staff on the project with a request to continue
the public hearing until November lBth.

Public Hearing opened.
Diane Jacobus, 7075 Island Village Drive, Long Beach, noted that
Ponderosa Homes was unresponsive to their request for information.
They want a north/south'access through the project.
Vic Peterson, 935 Catalina, presented a petition on the bluff area
behind the hill. They want the developer to dedicate land to the
adjacent property owners.

Martha Bueler, 1701 Catalina, wants single-family homes adjacent to
the existing homes on the hill. Public Hearing continued until
November 18th.

D. Amendments to R/C/P Zone
Staff report given by staff with request that the matter be continued to
November l8th. ~
Public Hearing opened.
Roger Weisman, DWP, stated that the Planning Commission had no requirement
to rezone the DWP site and should take no action until a use was selected
for the site. He also noted that the 70/30 Conservancy Plan does not
preclude th~ Coastal Commission from approving a plan other than 70/30.
Joyce Reisner, 845 Driftwood, opposed any change without a cost analysis
to insure that any zoning'would be cost effective.
Christine Agar, Seal Beach Trailer Park, spoke in favor of the amendment.
Carla Watson, San Gabriel ,Park Pacific Society, read a statement favoring
the 70/30 concept.

Covington noted that the land is now in the public domain. In addition,
approximately 10 years ago, the City went on record (by resolution) to
obtain the maximum amount of open space in the agency area with the private
sector to acquire and develop the minimum amount of land to pay for the
open space.
Matter was continued for two weeks.
E. Amendment to Sign Ordinance
Staff report by staff on proposed definition of sign.
Public Hearing opened.
No one spoke. Public Hearing Closed.
After discussion, Leibert moved to approve Resolution 1244, seconded
by Gilkerson and unanimously approved.

Subjects Commissioners May Wish to Discuss
A. legal Opinion on Presley in Lieu Park Fees
The City attorney's office prepared a legal opinion on returning the
Presley in lieu fees. The legal opinion concluded that the fees may not
be returned.
After discussion, the commission asked if the fees could be used
for community gardens on the State site, if it was open for use by
all the people in Seal Beach.
