THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES RESOLVE
AS FOLLOWS:
WHEREAS, on ~~. /~ ' 1963, pursuant to the pro.
visions of the Far~g District Law of 1951, as amended, this
Council duly adopted that certain Resolution No. 1:2,-51 entitled
A Resolution of the City of Seal Beach declaring its intention to
form a Farking District under the Parking District Law of 1951, and
WHEREAS, proceedings have been duly taken and a hearing
duly held pursuant to notices duly given under said Parking District
Law of 1951, and
WHEREAS, said Resolution was duly published, posted and
mailed as provided by said Act and said hearing was duly held at
the time and place so fixed, and all interested parties were given
an opportunity to be heard, and
WHEREAS, at said hearing there were no majority protests
or objections, written and/or oral, to any of the things proposed
to be done, and said hearing has been finally concluded, and
WHEREAS, the City Council has determined that written
protests or objections to the thing or things proposed to be done
as set forth in said Resolution No. 12%1 have not been made by

the owners of more than one-half of the assessed valuation of all
taxable real property in the proposed district, and
WHEREAS, this Council has determined that there is a public
need for such proposed facilities, and
WHEREAS ~ the City Council has determined that the proposed
district approximately covers the contiguous area needing such
facilities, and

WHEREAS, This City Council has determined that the proposed
improvements are located and designed in the manner most compatible
with the greatest public good and the least private injury, and
WHEREAS, This City Council has determined that sufficient
property within the proposed district will be benefited by the
proposed facilities, and
WHEREAS, This City Council has determined that the public
interest and necessity require the acquisition in fee simple of the
real property set forth and described in the said Resolution No.

NOW, THEREFORE, be it ordained by the City Council of the
City of Seal Beach as follows:
SECTION 1. That said City Council fixes and determines
that the public interest and necessity require the acquisition
described in Resolution No. /,;($J and described below, and
accordingly this City Council hereby orders the acquisition
described in said Resolution No. I~ ,namely, the acquisition
in fee simple for parking places of the following described real
property in the Ci~y of Seal Beach, to wit: Lots 17, 19, 20, 21
& 22, Block 9, Bay City Tract
SECTION 2. That this City Council hereby declares that
a Parking District to be known as '~arking District No. 1 of the
City of Seal Beach" is hereby declared to be, and has been duly,
formed under the provisions of the Parking District Law of 1951,
as amended.
SECTION 3. That the boundaries of said district shall
consist of the following Lots in Bay City Tract, City of Seal
Beach: Block 8, Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 15,
17, 19, 21, 23, 25, 27, 29, 31, 33, 35, 37, 39, 41, 43, 45, 47;
Block 9, Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 12, 14, 16, 18, 20,
22, 24, 26, 28, 30, 32, 34, 36, 38, 40, 42, 44, 46, and 48.

SECTION 4. That this Ordinance shall become effective
thirty (30) days after the final passage thereof.
SECTION 5. Severability
If any section, subsection, sentence, clause, phrase, or
portion of this Ordinance or the application thereof to any
person, firm, corporation or circumstance, is for any reason held
to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Ordinance. The Council
of the City of Seal Beach hereby declares that it would have
adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion be declared invalid or unconstitutional.
SECTION 6. Certification
That the City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered
in the book of original ordinances of said City; shall make a
minute of the passage and adoption thereof in the records of the
proceedings of the City Council of the said City in the minutes
of the meeting at Which the same is passes and adopted; and
shall, within fifteen (15) days after the passage and adoption
thereof, cause the same to be published as required by law.
