Minutes of the Seal Beach Planning Commission
of January 19, 1983
The Planning Commission met in regular"session on
Wednesday, January 19, 1983 in the City Council Chambers
of the City Administration Building. The meeting
was called to order by Vice-Chairman Goldenberg at
7:30 p.m. and the pledge to the flag was led by

The minutes of the January 5th meeting were considered and approved by

PUBLIC HEARING
A. Southland Corporation (7-11 Stores), CUP-5-82 (Cont'd.)
Staff report presented by Mr. Antos. Southland Corporation requested
in a letter to the City that the public hearing be continued until the
first meeting in April, 1983. At that time, the Los Alamitos School Board
and the Seal Beach School Board should know the final determination for
the site at Zoeter.School.
Commission voted to continue hearing until April 6, 1983 with the follow-
ing vote:

Staff report presented by Mr. Antos. He stated that this determination
was for a clarification of Section 28-400(3) relating to flower and veget-
able gardening in the R-l zone as it may relate to growing of nursery
stock. He stated there would be no ploughing, dust, etc.; that all plants
were to be grown in containers.
Commissioner Smith clarified the point. that this resolution would not
change the zoning, but would make the use compatible with R-l zoning.
Chairman Covington asked the time length of the lease. Staff replied
that it was a standard 3-year Edison lease, automatically renewable at
the end of those three years. Staff indicated that S-Y Nursery would

have to obtain a City Business License to operate in the City ata cost
of $50/year. If any problem arose regarding their operation, the City
Manager, City Engineer and the Recreation Department would review the
problem and take the necessary steps to resolve it.
Chairman Covington asked if the sewage needs for those employees were
adequately taken care ~f. Staff replied Edison and the Building Depart~
ment requires portable toilets according to the Uniform, Building Code.
Chairman Covingt~nmenti0nedthat additional water service extended t6
the 'site would be paid for by the applicant. He then asked if the nursery
would take water pressure away from the nearby homes. Staff replied that
the Water Department found no problem with serving the nursery.
Staff also indicated that there would be less demands on the Police and
Fire Department when a parcel of land is occupied. Previous call outs
for the Police Department were in the form of nuisances, which would no
longer take place when land is occupied.
Public Hearing Opened

1) Sumio Yasutake, S-Y Nursery answered some of the Planning Commission's
questions. It was mentioned that all fencingarouna the site is already
existirig; repairs only would be made, no additional fencing would be built.
The existing fencing is 6 ft. high. The lease mentioned is a 3-year lease,
with a 30-day revocation clause in it, should Edison have any problems
with lessee.
Staff replied that the City returned our lease with Edison, who then return=--
ed half a year's lease monies.
Chai~man Covington asked if the mosquitos will breed at ,the nursery.
Mr. Yasutake replied that the water is continually changed, not stag-
nant, therefore no breeding will occur. He also,indicated that most commer-
cial fert~lizers used do not have odors, etc.
No one spoke against the determination.

Commissioner Jessner stated that his concern is with theR-l zone. He
wished to clarify that this determination would not set a precedent.
Staff replied that this determination merely clarifies flower and veget-
able gardening in the R=--lzone. It is not for commercial use. The area
could be rezoned, but the use designated for it is only a temporary use.
The most restrictive use a parcel of land can have is R-l and would be
the most suitable for that site. Underground on. that site are high power
transmission lines for Edison. No structures may be built over those
lines. That is the primary usage of that site. S-Y Nursery would utilize
the site in a suitable manner, since no other activites other than a park
could concievably take place on the site.

It was suggested by Chairman Covington that another condition be added
.to the resolution which stated "and with a road speed not to exceed 10

Chairman Covington asked that another condition also beadd~d to read
"no on-site sales would occur either wholesale or retail."

Chairman Covington moved to adopt resolution as. amended with Commissioner
Smith seconding the motion. Resolution approved with the following vote:'

REPORT FROM SECRETARY

Staff indicated that a :propoS'al?r~'; forthcoming to place video games in
the area.of Rumrunner's Restaurant. The Chief of Police indicated that
.in a place where persons are 21 years or older and in a dinner house or
restaurant situation, he had no objection to the games.
Staff mentioned that the only other restaur8ntin the City that would
come under this same situation was the Glider'Inwhich also has a separate
cocktail lounge. All of the remaining restaurants in town do not have
a separate cocktail lounge.
Staff was asked to present to the Commission an inventory of all existing
machines along with type of machines in the City.
