ORDINANCE NO. 'J.f ~
AN ORDINANCE AMENDING THE CODE OF THE CITY OF SEAL BEACH BY ADDING
TO SECTION 2 IIADMINISTRATION" A NEW ARTICLE VI ENTITLEDII FRANCHISES"
PURSUANT TO THE CITY CHARTER.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS:
SECTIONU. The Code df the City of Seal Beach is amended
by adding a Chapter >2, Article VI entitled "Franchises" to read
as follows:
Sec. 2-45. Franchise Public. Hearinas. Notice and Protest
The City Council may grant, ratify, modify, amend ~r ~~....:~)
extend a Franchise to any person, firm or corporation, whethe
operating an existing Franchise or not, but before granting) di-
fy,ing, amending or extending such Franchise, shall hold at least
one public hearing thereon, notice of the time and place of such
hearing shall be published at least once in a newspaper of general
circulation.
The public hearing shall be held not less than three (3)
days following such publication and may be continued from time to
time by the Council. Any protest directed to the granting, ratifying,
modification, amendment or extension of any such Franchise shall be
heard by the Council at such hearing, or any continuance thereof,
before any official action is taken by the Council granting, ratify-
ing, modifying, amending or extending the proposed or existing
Franchise, or granting, modification, ratification, amendment or
extension thereof.
SECTION 2. All other Ordinances and parts of ordinances of
said City insofar as the same conflict with the provisions of this
Ordinance shall be and the same are hereby repealed.
SECTION 3. SEVERABILITY. If any section, subsection, sentence,
clause, phrase, or portion of this Ordinance, or the application thereof
to any person, firm, corporation or circumstance, is for any reason
held to be invalid or unconstitutional by the decision of any Court
of competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this Ordinance. The Council of the City
of Seal Beach hereby declares that it would have adopted this Ordinance
and each section, subsection, sentence, clause, phrase, or portion
thereof, irrespective of the fact that anyone or more sections,
subsection, sentence, clause, phrase or portion be declared invalid
or unconstitutional.
SECTION 4. EFFECTIVE DATE. This Ordinance shall take
effect thirty (30) days after the date of its adoption by the City

SECTION 5. PUBLICATION. This Ordinance shall be published
in accordance with law, together with the names of the members of
the City Council voting for and against the same.
