ORDINANCE NO. t;2.0
AN ORDINANCE TO AMEND CHAPTER n, OF THE CODE OF THE CITY OF
SEAL BEACH ENTITLED IILICENSES AND BUSINESS REGULATIONS", AS TO
PUBLIC DANCE HALLS.Am> SOCIAL CLUBS, AND DECLARING THE. URGENCY
THEREOF AND THAT. THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES' Om>AIN "AS FOLLOWS:

SECTION 1. Chapter 11, Article I, Section 11-1 of the
Code of the City of Seal Beach is hereb, amended as follows:
A. The definition entitled IIpublic Dance; Public Dance
Hallll is amended to read:
Public Dance Hall. IIpublic dance hallll shall mean
and include any room, place or space, excepting.a private
home or residence where dancing is held or carried on.
B. The definition entitled IISocial Club" is amended
to read:
Social Club. A "Social Clubll, within the meaning
and application of this.Cbapter, shall mean and include
every philanthropic, eleemosynary or fraternal corporation,
association or organization, voluntary, cooperative or
otherwise, organized and maintained for the promotion of
literature, science, politics, good fellowship, philan-
thropy, or for the social or physical welfare, benefit or
amusement of the membership, which operates and functions
upon a nonprofit basis and which maintains a club room or
a club house.
SECTION 2. Chapter 11, Article I, Section 11-6 of the Code
of the City of Seal Beach is hereby amended to read:
Sec. 11-6. Same--Eleemosynary Or~anizations.
Religious, charitable, educational, fraternal and
philanthropical organizations operated not for a profit
shall be exempt from the payment of any license tax
provided in this chapter.
SECTION 3. Chapter 11, Article II, Section 11-53 of the
Code of the City of Seal Beach is hereby amended to read:
Sec. 11-53. Same--Leasing or Rentin~ of Public Dance Hall.
Every person engaged in or conducting the business
of renting or leasing a public dance hall shall pay a fee of
$25.00 per year.
SECTION 4. SEVERABILITY. If any section, subsection,
sentence, clause, phrase, or portion of this Ordinance, or the
application thereof to any person, firm, corporation or circumstance,
is for any reason held to be invalid or unconstitutional by the

decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this
Ordinance. The Council of the City of Seal Beach hereby
declares that it would have adopted this Ordinance and each
section, subsection, sentence, clause, phrase, or portion
thereof, irrespective of the fact that anyone or more section,
subsection, sentence, clause, phrase, or portion be declared
invalid or unconstitutional.
SECTION 5. STATEMENT OF URGENCY. The City Council of the
City of Seal Beach finds and declares, in accordance with the
provisions of Section 36937 of the Government Code of the State
of California, that this ordinance relates to the assessment,
imposition and collection of taxes for the usual and current
expenses of said City.
SECTION 6. EFFECTIVE DATE. This Ordinance, being an
ordinance required fo~ the immediate preservation of the public
peace, health and safety, shall take effect immediately upon
its adoption hereof.
SECTION 7. PUBLICATION. This Ordinance shall be published
in accordance with law, together with the names of the members
of the City Council voting for and against the same.
