SECTION 4-15, ARTICLE 2, RELATDlG TO THE DISPOSAL OF REFUSE ON OR FROM THE MUNICIPAL PIER AND DECLARING THE URGENCY THEREOF AND THAT THIS ORDINANCE SHALL TAKE IMMEDIATE EFFECT. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 4. Article 2, Section 4-15 of the Code of the City of Seal Beach is hereby amended to read: No person shall throw, deposit, pipe, drain or otherwise place, or cause to be thrown, deposited, piped, drained or otherwise placed, upon such pier or into the waters of the Pacific Ocean adjacent thereto, any dead animal, dead fowl, anllnal or vegetable matter, dead fish. fish refuse. butchers offal, bones, flesh, food, fruit, garbage. rubbish. trash, dirt, ashes, cinders, broken glass. crockery, tins, soap suds, oil, asphaltum or distillate, but shall deposit any and all such in the receptacles provided for the same. The provisions of this section shall not be construed so as to prevent fisher- men from throwing or depositing or placing back into the waters of the Pacific Ocean any live or dead fish, bait, or fish offal; nor shall the provisions of this section apply to any representative, employee, or agent of the City while acting within the course and scope of his employment or duty. SECTION 2. The City Council of the City of Seal Beach finds and determines that the depositing of dead fish, bait, and fish offal upon the municipal pier and the offensive odor created thereby constitutes a public nuisance and a danger to the public health and safety. The Ci:y Council therefor finds and determines that this ordinance is required for the immediate preservation of the public peace, health, r-nd safety. SECTION 3. This ordinance, being an ordinance required for the immediate preservation of public peace. health, and safety shall take effect immediately upon its adoption, shall be certified as to its adoption by the City Clerk. and shall be posted in three public places within the city lllnits oi the City of Seal Beach, together with the names of the members of the City Council voting for and against the same. SECTION 4. SEVERABILITY.
