Home My WebLink AboutCC Res 1497 1966-12-19 I I I " RESOLUTION NO. l~q7 , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, OF INTENTION TO ANNEX CERTAIN UNINHABITED TERRITORY; DESIGNATING THE TERRITORY AS "ANNEXATION NO. 66-1"; DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR, AND PLACE WHERE ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY PROTEST OR APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF SEAL BEACH. WHEREAS, the Local Agency Formation Commission of the County of Orange has heretofore, on December 14, 1966, approved as to definite- ness and certainty the boundaries of the territory hereinafter more particularly described, and approved the annexation to the City of Seal Beach, a Charter City, of such territory; and WHEREAS, less than twelve (12) persons who have been registered to vote within such territory for at least fifty-four (54) days resided within the territory at the time of the institution of proceedings on motion of the City Council of the City of Seal Beach for the annexation of such territory to the City of Seal Beach, a Charter City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, A CHARTER CITY, RESOLVES AS FOLLOWS: Section 1. Pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939," and all acts amendatory thereof and supplementary thereto, notice is hereby given of proceedings for the annexation to the City of Seal Beach, a Charter City, of certain uninhabited territory of the County of Orange, contiguous to said City which territory is more particularly described hereinafter. Section 2. That said territory so proposed to be annexed to the City of Seal Beach, a Charter City, be, and the same is hereby designated as "Annexation No. 66-1" and that said territory shall be referred to by such designation in the proceedings for such annexation. . Section 3, That the real property compr~s~ng said territory proposed to be annexed to said City of Seal Beach, a Charter City, is uninhabited, is contiguous to said City of Seal Beach, does not now form a part of any other municipal corporation, is located in the County of Orange, State of California, and is more particularly described as follows: That portion of the West Half and Northeast 0uarter of Section 31, Township 4 South, Range 11 West, in the Rancho Los Alamitos, in the County of Orange, State of California, described as follows: Beginning at the intersection of the South line of the Northwest Quarter of the Northeast OUarter of said Section 31 with the East line of the West 30.00 feet of said Northeast Quarter, said intersection being also a common point in the boundary line of the City of Los Alamitos as determined by Annexation No.8, dated July 28, 1961, with the boundary described in Annexation 64-1 to the City of Seal Beach; thence along said East line and along said Los Alamitos boundary line o NOll' 30" E 901.01 feet to the Easterly prolongation of the South line of Bradbury Road, 80 feet wide, as shown on map of Tract No. 3072 recorded in book 93 pages 5 thru 8 inclusive, of Miscellaneous Maps, records of said Orange County; thence leaving said Easterly line and leaving said existing boundary of the City of Los Alamitos and along said Easterly prolongation and along said South line, N 890 48' 30" W 262.00 feet to the Northeast corner of Tract No. 5317 as per map recorded in book 192 pages 46 thru 50, inclusive, of Miscellaneous Maps, records of said Orange County; thence S 00 10' 50" W 550.00 feet to the Southeast corner of said Tract No. 5317; thence along the South line of said Tract No. 5317, N 890 48' 30" W 1030.00 feet to the Easterly line of Montecito Road, 80 feet wide, as shown on said Tract No. 3072;thence along last mentioned East line and along the East line of Montecito Road, 80 feet wide, as shown on map of Tract No. 3224 as recorded in book 106 pages 21 thru 29, inclusive, of Miscellaneous Maps, records of said Orange County, S 00 10' 50" W 1,731.54 feet to a curve concave Northeasterly having a radius of 260.00 feet; thence Southeasterly along said curve and along said East line of Montecito Road, and along the Northerly line of St. Cloud Drive, 80 feet wide, as shown on said Tract No. 3224 an arc distance of 408.41 feet; thence tangent to said curve, and continuing along said Northerly line of St. Cloud Drive, S 890 49' 10" E 914.50 feet to a curve concave Northwesterly having a radius of 25.00 feet; thence Northeasterly along said curve 39.27 feet to a point in the West line of the East 62.00 feet of the West Half of said Section 31, said point being also the Southerly terminus of the course cited in said Annexation 64-1 as "s 00 11' 30" W 1,615.30 feet"; thence along last mentioned course and along the boundary line of said Annexation 64-1, N 00 11' 30" E 1,615.30 feet to the Northerly terminus of said course; thence continuing along last mentioned boundary S 890 47' 50" E 92.00 feet to the point of beginning. -2- I I I Resolution Number - .. . Section 4. That said annexation proceedings have been initiated by the City Council of the City of Seal Beach, a Charter City, and that the reasons of said City Council for desiring said annexation are as follows: 1. The present boundaries of the City of Seal Beach and the territory proposed to be annexed are contiguous. 2. The commercial development within the territory proposed to be annexed presently serves a large portion of the population of the City of Seal Beach, and it is contemplated that such services will continue to increase at a rapid rate. 3. The owner of the territory proposed to be annexed has requested that annexation proceedings for said annexation be commenced by the City Council of the City of Seal Beach. Section 5. That on Monday, the 30th day of January, 1967, at the hour of 8:00 p.m., at the Council Chambers in the City Hall, in the City of Seal Beach, State of California, any and all persons owning real property within such hereinabove described territory so proposed to be annexed to said City of Seal Beach, and having any objections to such proposed annexation, may appear before the City Council and show cause why such territory should not be so annexed to said City. Any such protests against the proposed annexation must be in writing, shall state the name of the owner of the property affected, and the street address or other description of the property sufficient to identify it on the last equalized assessment rolls of the Orange County Assessor. Section 6. The City Clerk is hereby directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Huntington Beach Daily Pilot, a newspaper of general circulation published in the City of Huntington Beach, County of Orange. Said City Clerk is hereby directed, also, to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Marina News, also a newspaper of general circulation published in the City of Long Beach, County of Los Angeles. Said publi- cation shall be completed at least twenty (20) days prior to the date set for the public hearing. Said Clerk shall also cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date these proceedings were initiated, to the address shown on said assessment roll or as known to the said Clerk, and to any persons who have filed their names and addresses and the designation of the land, and who has any interest, either legal or equitable, with said Clerk. Such notice shall be given not less than twenty (20) days before the date set for such hearing. -3- . I I I Resolution Number . , ". ". Section 7. The City Clerk shall certify to the passage of this resolution and shall cause the same to be posted not less than twenty days before the date set for the public hearing in three conspicious places in the City of Seal Beach, and in at least three conspicious places within the territory to be annexed, and it shall thereupon take effect. ~- ,a.
