A RESOLtrrION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA, A CHARTER CITY, OPPOSING
SB 1368 (SENATOR MILLER) AND REQUESTING THAT SAID
BILL BE VETOED.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY,
DOES HEREBY RESOLVE:
WHEREAS, Senate Bill 1368, if enacted into law, would unjustifiably
reduce the amount of property taxes paid by certain oil companies to
the counties and school districts and cities within such counties by
amounts in excess of the following:
Contra Costa County
Fresno County
Kern County
Kings County
Los Angeles County
Orange County
Sacramento County
Santa BarbaraCounty
Solona County
Sutter County
Ventura County

WHEREAS, the reduction of the ad valorem tax base and the taxes paid
by certain oil companies as specified in SB 1368 will increase the
tax burden on all other property owners; and
WHEREAS, the oil companies benefiting from the special legislation
have not proven that any hardship exists as required by the State
Constitution for such special legislation; and
WHEREAS, the lack of proof of "hardship" raises questions as to the
constitutionality of SB 1368 and will result in extensive litigation;
and
WHEREAS, SB 1368 will create extensive legal and administrative problems
for all county and city assessors; and
WHEREAS, the counties, school districts, and cities are currently
involved in litigation with the same oil companies that would benefit
from the enactment of SB 1368, judgment. having been rendered in favor
of said counties, school districts, and cities (which is under appeal)
and SB 1368 is an attempt to influence said litigation contrary to the
interests of said governmental jurisdictions; and
WHEREAS, said SB 1368 is uncertain as to wording, meaning, and inter-
pretation; and

WHEREAS, the bill attempts to change the ad valorem tax assessment
procedure contrary to the State Constitution equal protection clause
by private lessees of governmental oil and gas rights being taxed
at a lower rate than lessees of privately-owned oil and gas rights;
and
WHEREAS, SB 1368 is an attempt to reverse the DELUZ HOMES case which
has consistently been upheld by the Courts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES RESOLVE
THAT ALL ELECTED STATE OFFICERS AND OFFICIALS DECLINE TO SUPPORT THE
ENACTMENT OF SENATE BILL 1368 INTO LAW, AND THAT GOVERNOR REAGAN IS
REQUESTED AND URGED TO VETO SAID MEASURE.
