HomeMy WebLinkAboutCC Res 1618 1967-11-27 ~ I RESOLUTION NUMBER /6/ K A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, AUTHORIZ- ING THE CITY MANAGER TO EXECUTE ON BEHALF OF THE CITY, A BOUNDARY LINE AGREEMENT KNOWN AS SEAL BEACH BOUNDARY AGREEMENT NUMBER TWO, BY AND BETWEEN THE STATE OF CALIFORNIA, THE CITY OF SEAL BEACH, AND THOSE OTHER PARTIES WHICH OWN LANDS ADJACENT TO SAID BOUNDARY, AND WHICH EXE- CUTE COUNTER PARTS OF SAID AGREEMENT. REAS, The uplands abutting Alamitos Bay, as said Bay existed in the state of nature, which are located in the vicinity of the City of Seal Beach, were granted into private ownership; and I REAS, The boundary of said lands is described in the owner- ship patent of the United States as running around the shore of Alamitos Bay along the edge of high tide, but with specific calls traversing intersecting sloughs; and REAS, The State received title to the tide and submerged lands within Alamitos Bay upon being admitted to the Union, and the State conveyed to private parties, pursuant to State Tide Land Location No, 137, certain of said lands abutting and adjacent to the boundary of Rancho Los Alamitos; and REAS, The line of mean high tide in Alamitos Bay, as the same may have existed in its last natural state, has been affected and controlled by artificial process, and there is substantial doubt and uncertainty as to the last natural location thereof, and consequently the true boundary is uncertain and in doubt between said lands included in Rancho Los Alamitos and the sovereign lands of the State, certain of which were patented into private ownership by virtue of Tide Land Location No, 137; and I REAS, The City Council of the City of Seal Beach considers it expedient and necessary, and in the best interests of the City, and the citizens and tax payers of the City of Seal Beach to describe, determine, and fix per- manently the boundary line between said lands included in Rancho Los Alamitos and the sovereign lands of the State of California, certain of which granted into private ownership; . - I I 1 . Resolution Numbe~ . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIF., a municipal corporation and a charter city, does hereby resolve as follows: Section 1. The City Manager is authorized to execute on behalf of the City of Seal Beach a boundary line agreement, designated as "Seal Beach Boundary Agreement No, 2", by and between the State of california, acting by and through the State Lands Commission, the City of Seal Beach, and those other parties (or their successors) listed on Exhibit B attached hereto and incorporated herein by reference which own lands adjacent to the agree-upon boundary des- cribed in Exhibit A, attached hereto and incorporated herein by reference, and which execute counterparts to said Seal Beach Boundary Agreement No, 2 PASSED, APPROVED, AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AT A MEETING THEREOF HELD ON THE 27th DAY OF NOVEMBER, 1967, BY THE FOLLOWING VOIE: AYES: Councilmen a-;.J~ . ~-"~; I...... ,~.b'nn ;''1, .t!hl?,'. , , NOES: Councilmen ~ Councilmen ~ ABSENT : ATTEST:
