City Council Compensation
SUMMARY OF REQUEST:
City Council to provide direction to City staff to prepare an amending ordinance
establishing a new compensation rate for City Council pursuant to the guidelines set forth
by California Government Code and the City's Charter and Municipal Code.
DISCUSSION:

The Seal Beach City Charter Section 402 establishes that compensation for City Council
members shall be established by ordinance in accordance with provisions of Sections
36516 and 36516.5 of the State of California Government Code. California Government
Code Section 36516 establishes compensation levels of council members based on the
population of the City. According to Section 36516(a) (1), in cities up to and including
35,000 in population, the maximum pay is $300 month. As Seal Beach's current
population is 24,177, the $300 per month schedule shall apply.
California Government Code Section 36516(c) further defines the ability to increase City
Council compensation by five percent (5%) for each calendar year from the operative
date of the last salary adjustment and that such increases may only occur when one of the
council members commences a new term. Seal Beach's next consolidated general
municipal election for two City Council seats' will be held in November 2008; therefore,
any change to Council compensation will not apply until that date.
In August 1990, the City Council adopted Ordinance 1311 amending the City's
Municipal Code Section 3.05.010 with the following language:

"Pursuant to Government Code Section 36516, each member of the city council
shall receive as salary the sum of $300 per month. Such salary shall be payable at
the same time and in the same manner as salaries are paid to other officers and
employees. The City Council may increase its salary in accordance with the
provisions of Government Code Sections 36516 et seq."

By calculating a 5% increase from the base amount of $300 over a period of 18 years
(1990 thru 2008), the maximum monthly compensation the City Council will be eligible
for in 2008 is $721.99. City Council has the discretion to select a compensation figure
less than this amount if it so desires. A reasonable approach would be to set the new
compensation at a round figure such as $500.
FINANCIAL IMPACT:
There will be no immediate financial impact by adopting an amending ordinance
changing compensation levels for City Council.
RECOMMENDATION:
City Council to direct City staff to prepare an amending ordinance establishing a new
compensation rate of $500 for City Council pursuant to the guidelines set forth by
California Government Code and the City's Charter and Municipal Code.
