AGREEMENT
SUMMARY OF REOUEST:
The proposed City Council action will approve Resolution No. directing the
City Manager to sign the attached Provisionally Accredited Levee (pAL) Agreement.
e BACKGROUND:
In response to Hurricane Katrina and the resulting catastrophic failure of the levee system
that protects the Gulf Coast, the Federal Emergency Management Agency (FEMA) has
accelerated its national Levee Certification Program. This program seeks to identify and
assess the risk of flood damage in areas protected by existing levees. Under the program,
local, State, and Federal agencies will be required to certify that levees they own meet
Federal flood protection standards.
FEMA is in the process of updating the nation's Flood Insurance Rate Maps (FIRMs). As
part of this process, FEMA is requiring all levees to be certified as providing flood
protection before they can be shown on the new FIRMs. FEMA is allowing cities and
levee owners to obtain levee certification through an administrative process known as a
Provisionally Accredited Levee (pAL) Agreement.
The County of Los Angeles is working with the Corps of Engineers, FEMA, cities, and
other nearby southern California Counties to coordinate the overall levee certification
program. The County intends to sign PALs and pursue certification for all the 61 miles of
levees they own, operate, and maintain. The County is coordinating the PAL Agreement
signatures with the affected Cities and will turn them in to FEMA with the other required
levee maintenance, operation, and as-built plans.

The City of Seal Beach lies adjacent to the San Gabriel River System: Whittier narrows
Dam - Pacific Ocean levee system. Since this levee system is operated and maintained
by the County of Los Angeles, Seal Beach should sign and return the PAL Agreement to
the Public Works City Services Representative of the County of Los Angeles Department
of Public Works.
Should the city not sign and return the PAL Agreement, FEMA will consider that
segment of the levee as ineffective in providing flood protection. FEMA will map a
"levee breakout zone" where flood waters are assumed to be flooding over adjoining low-
lying lands. Adjacent cities may be affected by these assumed overflow areas. This will
result in these areas having mandatory flood insurance purchase requirements and
development restrictions.
FISCAL IMPACT:
There will be no fiscal impact to the City.
RECOMMENDATION:
It is recommended that the City Council approve Resolution No. directing the City
Manager to sign the attached Provisionally Accredited Levee (pAL) Agreement and send it
to the County of Los Angeles Department of Public Works.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH DIRECTING THE CITY MANAGER TO SIGN THE
PROVISIONALLY ACCREDITED LEVEE (PAL) AGREEMENT
NOW, TIIEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The City COlmcil hereby directs the City Manager to sign the FEMA
Provisionally Accredited Levee Agreement.

FEDERAL EMERGENCY MANAGEMENT AGENCY
LEVEE CERTIFICATION PROGRAM
In response to Hurricane Katrfna and the resulting catastrophic failure of the levee
system that protects the Gulf Coast, the Federal Emergency Management Agency
(FEMA) has accelerated Its national Levee Certification Program. This program seeks
to Identify and assess the risk of flood damage In arBas protected by existing levees.
Under the program, local, State, and Federal agencies will be required to certify that
levees they own meet Federal flood protection standards. Alternatively, FEMA will map
areas protected by uncertified levees and designate them as hIgh flood hazard under
the National Flood Insurance Program. We expect all levees the Los Angeles County
Flood Control District maintains and operate to meet or exceed minimum Federalllood
protection standards.
In the next few weeks, FEMA will be sending the mayors of all 88 cities In the County of
Los Angeles a letter detailing the Levee Certification Program. The District Is currently
working with our local FEMA representative and the U.S. Anny Corps of Engineers
(Corps) to coordinate their compliance efforts under the Levee Certificatfon Program.
As part of this effort, we ara contacting each city In advance of FEMA's notification
making them awara of the Levee CertifICation Program.
The District and the Corps own and maintain most of the levees in Los Angeles County.

(PAL) AGREEMENT
Background
FEMA is in the process of updating the nation's Flood Insurance Rate Maps (FIRMs). As part
of this process, FEMA is requiring all levees to be certified as providing flood protection
before they can be shown on the new FIRMs. FEMA is giving cities and levee owners up to
27 months to obtain levee certification through an administrative process known as a
Provisionally Accredited Levee (PAL) Agreement. FEMA sent the County of Los Angeles and
cities the PAL letter and Agreement dated July 17, 2007 for signature and retum.
What Is the County of Los Angeles Doing?
The County is working with the Corps of Engineers, FEMA, cities, and other nearby southern
California Counties to coordinate the overall levee certification program. The County intends
to sign PALs and pursue certification for all of the 61 miles of levees we own, operate, and
maintain. The County is coordinating the PAL Agreement signatures with the affected Cities
and will turn them in to FEMA with the other required levee maintenance, operation and as-
built plans.
The Corps of Engineers will certify the 44 miles of levees for the Los Angeles County
Drainage Area (LACDA) project on the Los Angeles River, Rio Hondo, and Compton Creek.

What do Cities have to Do?
If a city has a levee owned or operated and maintained by the County, then the City should
sign and return the PAL Agreement to their Public Works City Services Representative by
October 1, 2007. Cities with levees they own and operate must sign and return the PAL
Agreement to FEMA and then undertake levee certification efforts in coordination with FEMA.
If a city has already signed their PAL Agreement and retumed it to FEMA, please send the
County a copy for our records.
What If a City/Levee Owner Doesn't Sign the PAL? =
FEMA requires all affected cities and levee owners to sign and return the PAL Agreement.
