SUBJECT: COUNCIL POLICY - TEMPORARY COMMUNITY
STORAGE CONTAINER AREA
SUMMARY OF REQUEST:
The proposed City Council action will approve the proposed City Council Policy ''Temporary
Community Storage Container Area."
BACKGROUND:
Volunteer non-profit entities in the Community (such as the Seal Beach Skl10k Run Committee
and the Seal Beach Historical Society) have requested storage space from the City to store
materials and equipment used during their annual functions and fundraisers, which benefit the
residents of the City. With the recent development of the John Laing Homes project and the
Boeing project, a temporary quarter-acre space has become available at the end of Adolfo Lopez
Drive for this use and may fit up to Eleven (11) 20-foot steel containers as shown on the attached
drawing.
Staff has prepared a City Council Policy that allows volunteer non-profit entities located in the
City and specifically benefiting the Seal Beach Community may apply for a yearly application to
use the temporary site. Containers, which must be approved by the Director of Public Works,
are to be supplied, owned and maintained by the non-profit entity per the policy. It is proposed
that every application must be renewed on an annual basis and the permits maybe revoked with
30-day notice to the entities. If more than 1 I applications are received, a lottery system will be
used. Minor construction including the placement of temporary asphalt grinding and fencing
will be required in order to prepare the site. It is anticipated that the site could be available by
the summer of 2006 and would be used on a temporary basis as determined by City Council.
FISCAL IMPACT:
Fiscal impacts to the Public Works Department are estimated at $2,000 per year in staff time. It
is estimated that $10,000 to $12,000 will be required for the installation of a temporary pavement
and a new fence and gate around the area. This request will be brought forward during the FY
2006/2007 budget process.

It is recommended that City Council approve the proposed City Council Policy "Temporary

1. SCOPE

2, PURPOSE AND INTENT
It is the intent of this policy to provide the volunteer non-profit entities,
located in the City and specifically benefiting the Seal Beach Community,
a temporary designated area for storage containers.
3. POLICY
The City has set aside a temporarily vacant quarter-acre parcel located at
the end of Adolfo Lopez Drive for storage containers. Volunteer non-profit
entities have requested storage space from the City to store materials and
equipment used during their annual functions and fund raisers, which
benefit the residents of the City. With the recent development of the John
Laing Homes project and the Boeing project, a quarter-acre space has
become available for this use and may fit up to eleven (11) 20-foot steel
containers.

4. PROCEDURE
Non-profit entities as described above may apply for a yearly application
to use the site. Every application must be renewed on an annual basis. If
more than 11 applications are received, a lottery system will be used.

4.1 Annual application required from the City Engineer.
4.1.1 Reauested bv aoolicant. No person/entity shall install or maintain
any container within the storage area without a approved
application permit from the City Engineer. A separate permit shall
be obtained for each container, which permit shall be valid only for
the particular location specified therein. Each permit shall bear a
separate number and not more than one permit shall be issued for
anyone entity.
4.2 Application for permit: fees, renewal.
4.2.1 Aoolication Packaae. No permit shall be issued except upon written
application, made upon a form prescribed by the City Engineer,
showing the proposed location on a dimensioned plan, the physical
dimensions of each container, a picture or other graphic
representation of the proposed container, and such other
information as the City Engineer may require including but not
limited to detailed plans and specifications.
4.2.2 Field Location. The City, upon initial acceptance of the application
by the City Engineer, shall mark the location of the storage area.
4.2.3 Consent of Leaal Reoresentative. Each application for an original
permit shall be signed by the owner or person in lawful control of
the Non Profit entity.
4.2.4 Owner of Container. Each application must be signed by the owner
of container for which permits are requested.
4.2.5 Maintenance of the Containers. Each entity (permittee) is
responsible for maintenance of their respective container including
aesthetics and functionality to the satisfaction of the City Engineer.
Graffiti removal is also the responsibility of the permittee.
4.2.5 Yearlv Rental License Charae. None at this time.
4.2.6 Exoiration. Each permit shall expire on the 30th day of June
following the date of issuance unless renewed. Application for
renewal must be made prior to the expiration date. Upon 30-day
notice from the City, at any time during the permit cycle, the entity
must remove the container from the property within the specified 30
days.
4,3 Permits: denial, revocation, removal.
4.3.1 The application shall be denied if the City Engineer finds that the
maintenance or use of the container would tend to obstruct
passage along any public way or create a hazard or would

otherwise be detrimental to the public safety, welfare or
convenience.
4.3.2 Any permit may be revoked, or renewal thereof denied for any
violation of any of the provisions of this section, for any fraud or
misrepresentation in the application, or for any reason which would
have been ground for denial of the application.
4.3.3 If the City designates the area for another use or is required to
cease operating the storage area the permit shall be denied or
revoked.
4.3.5 Any permit issued under this section shall be canceled and revoked
if the permittee fails to install the container within sixty (60) days
after the date of the issuance of the permit.
4.3.6 Any permit may be revoked at any time with thirty days advance
notice by the City should said revocation be necessary in order to
accommodate any planned, orderly installation any City public
improvement at the site.
4.4 Enforcement.
4.4.1 The City Engineer shall enforce the provisions of this policy, and
shall have complete authority over the use of the storage area,
subject to the provisions of this policy.
4.4.2 Applicants shall have 30 days to remove said container after
receiving notice from the City. If applicant does not remove said
container within the specified time, the container and its contents
become the property of the City and will be removed and disposed
of by the City. Any City costs associated with this action by the City
will be the responsibility of each entity.
4.4.3 Applicants will have 15 days to correct any maintenance issues
noted by the City. If applicant does not repair said container within
the specified time, the City Engineer will make a determination
whether the container should be repaired or the container and its
contents become the property of the City and will be removed and
disposed of by the City. Any City costs associated with this action
by the City will be the responsibility of each entity.
4.4.4 Applicants will have 3 days to correct any graffiti issues noted by
the City. Any City costs associated with this action by the City will
be the responsibility of each entity.

4.5 Bond or insurance polley. limit of liability.
4.5.1 Each entity shall be responsible for all liability associated with their
respective container. The City is not responsible for any lost or stolen
property.
