SUBJECT: ACCEPTING EASEMENT DEED FOR PUBLIC UTILITY
AND CITY ACCESS ON A PORTION OF HELLMAN
PROPERTIES, LLC PROPERTY ADJACENT TO
SOUTHERLY SIDE OF CITY CORPORATION YARD
SUMMARY OF REOUEST:
The proposed City Council action will adopt Resolution No._ accepting an Easement
Deed for public utilities and City access on a portion of the Hellman Properties, LLC
property adjacent to the southerly side of the City Corporation Yard.
BACKGROUND:
As part of the Hellman Subdivision Tract No. 15402 development requirements, certain
public utilities were required to cross a portion of the Hellman Properties, LLC property
in order to connect to existing public utilities in Adolfo Lopez Drive.
The proposed easement will allow the required public utilities to be installed within the
easement area and will allow the City access for maintenance of the public utilities
Hellman Properties, LLC has executed the attached Easement Deed and has forwarded it
to the City for acceptance,
Note that the Easement Deed additionally includes a grant of access easement to the
Orange County Flood Control District over a portion of the easement being granted to the
City which will allow the County access on a portion of Hellman Properties, LLC
property for access to a proposed County flood control pump station to be constructed by
the County along the southerly side of the Los Alamitos Retarding Basin located westerly
of the City Corporation Yard.
These easements will adjoin a separate access easement to be deeded by the City both to
the Hellman Properties, LLC and the Orange County Flood Control District which

crosses a westerly portion of the City Corporation Yard in order to allow access to
Adolfo Lopez Drive which was part of the Hellman Subdivision Tract No. 15402
development agreement conditions. The Orange County Flood Control District will
accept their Easement Deed grant by separate Board action.
FISCAL IMPACT:
By accepting this easement there is no additional fiscal impact to the City over and above
those already agreed to for maintenance of public utilities as part of the Hellman
Subdivision Tract No, 15402 agreement previously approved by the City Council.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. _ accepting an Easement
Deed for public utilities and City access on a portion of the Hellman Properties, LLC
property adjacent to the southerly side of the City Corporation Yard.

utility and access easements in the City of Seal Beach, County of Orange, State of California,
more particularly described as follows:
EASEMENTS FOR UTILITY AND ACCESS PURPOSES described on Exhibit "A",
consisting of 3 sheets, and shown on Exhibit "B", consisting of 5 sheets, attached hereto and
made a part hereof.
In addition, Grantor hereby grants to ORANGE COUNTY FLOOD CONTROL
DISTRICT, a body corporate and politic, a non-exclusive perpetual easement and right-of-way
for ingress and egress in, upon, over and across that certain real property (Parcel 110) in the City
of Seal Beach, County of Orange, State of California, described as:

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH ACCEPTING EASEMENT DEED FOR PUBLIC UTILITY AND
CITY ACCESS ON A PORTION OF HELLMAN PROPERTIES, LLC
PROPERTY ADJACENT TO SOUTHERLY SIDE OF CITY
CORPORATION YARD
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, as part of the Hellman Subdivision Tract No. 15402 development requirements
certain public utilities were required to cross a portion of the Hellman Properties, LLC property
in order to connect to existing public utilities in Adolro Lopez Drive; and
WHEREAS, the proposed easement will allow the required public utilities to be installed within
the easement area snd will allow the City ..cess for maintenance of the public utilities; and
WHEREAS, Hollman Properties, LLC has executed the attached Easement Deed and has
forwarded it to the City for acceptance; and
WHEREAS, the Easement Deed additionally includes s grant of access easement to the Orange
County Flood Control Distnct over a portion of the easement being granted to the City which
will allow the County access on a portion of HeUman Properties, LLC property for acc... to a
proposed County flood control pump station to be constructed by the County along the southerly
side of the Los Alamitos Retarding Basin located westerly of the City Corporation Yard; and
WHEREAS, these easements will edjoin a separate access easement to be deeded by the City
both to the Hellman Properties, LLC and the Orange County Flood Control District which
crosses a westerly portion of the City Corporation Yard in order to allow access to Ado]fo Lopez
Dnve which was part of the Hollman Subdivision Tract No, ]5402 development agreement
conditions, and
WHEREAS, the Orange County Flood Control District will accept their easement deed grant by
aoparato Board action; snd
WHEREAS, the City Engineer recommends that the City Council of the City of Seal Beach
..eept from Hollman Properti.., LLC. the Easement Deed for the aforementioned public utilities
snd City access.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOE
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECflON 1. The City Council of the City of Seal Beach hereby accepts the aforementioned
Easement Deed; and
SECTION 2. The City Council of the City of Seal Beach, upon ..ceptance by the Orange
County F]ood Contro] District of their portion of the aforesaid Easement Deed
will authorize City Clerk of the City of Seal Boach to have the aforementioned
Easement Deed duly and properly recorded in the official records of the office
of the Recorder of the County of Orange.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal Beach at a
meeting thereof held on the day of .2006.
