BACKGROUND: The City has received a copy of the subject Draft EIR and it is appropriate for the City to comment on the document as it has previously commented on ''Notices of Preparation" (''NOP'') for this project initially in October 2003 and again in April 2005 on a revised NOP. The City received a copy of the most recent "Notice of Preparation and Scoping - Long Beach Airport Terminal Area Improvements" in April 2005. This document indicated that the City of Long Beach will prepare a Draft Environmental Impact Report ("DEIR") on the proposed project, and requested comments from responsible agencies, other agencies, and the general public, as to what should be covered in the DEIR. The City Council approved comment letter of ~pril25, 2005 is provided as Attachment 2. An initial NOP was circulated for agency and public comments in September 2003, and the City Council approved a comment letter on October 14, 2003. The 2005 NOP informed the public of modifications that have been made to the proposed project as a result of public comments received in 2003, and provided another opportunity for mput on the issues to be addressed in the EIR for the current project e Agenda Item J Z:\My DoclllllOll1slCEQAILong Beach Airport Terminal DEIR CC StaffReport.docILWll2-{)l-DS Project Overview: Approval ofComme11l Leiter re: DEIR 37-03- Long Beach Airport Terminal Improveme1fl Project (SeHNa. 200309112) City Council StafJReport .- December 12. 2005 ., The DEIR evaluates the potential environmental impacts of a proposed project at the Long Beach Airport that will consist of the following major project,components: Holdrooms Concession Area Passenger Security Screening Area Baggage Security Screening Baggage Claim Devices Baggage Service Office Restrooms Office Space Ticketing Facilities Airline Gates Aircraft Parking Positions Vehicular Parking Traffic and Pedestrian Circulation A summary overview of the proposed improvements at these operating areas of the airport is provided in Section 2.0, Proiect Description, on pages 2-1 through 2-18 of the DEIR. Table 2.5-1, Long Beach Airport Passenger Terminal Area Improvements, EIR Alternatives, provides a detailed summary of the differences between the proposed project, Alternative A (the 2003 project), and alternatives identified as Alternatives B and C. This table is on pages 2-9 and 2-10 of the DEIR. e The terminal improvements are' being designed to accommodate up to an identified maximum of 52 commercial carrier flights and 25 commuter flights, the passengers associated with those flights, and security requirements imposed by the Federal Transportation Security Administration (TSA). This flight level is anticipated to result in approximately 3.8 million annual passengers (MAP) being served at Long Beach Airport (LOB). . A copy of the concept plan for the terminal improvements is provided as Attachment 3. The project is designed to serve the current minimum pennitted passenger levels at the airport. Phasing of the de~elopments proposed for the project would be determined based on availability of funding and service priorities, and to m;n;m;7.e impacts on airport operations. SummtlI'Y of ProposedAction and Environmental Impacts: Staff has previously provided a complete copy of the DEIR to the City Council, which provides an overview of the proposed project, location and site plan maps of the proposed project, and the required l?llvironmental analysis and mitigation measures determined appropriate to mitigate adverse environmental impacts to a less than significant level. Environmental Quality Control Board Action of November 30, 2005: e Staff prepared a draft response letter for the consideration of the EQCB, provided as Attachment I, which sets forth concerns of the City regarding flight path deviations for flights landing at Long Beach Airport, based on City Council discussions at several City Council meetings in the early part of 2005. The EQCB approved the response letter at its meeting of November 30 with minor grammatical corrections and the matter is now before the City Council for final approval of the comment letter and signature by the Mayor. The concerns of the City of Seal Beach are heightened upon our review of a recent study released by the State of California Air Resources Board titled "2005 Drqft Diesel Particulate Matter Exposure Assessment Study for the Ports of Los Angeles and Long Beach" (''the ARB Report''). Due to significant health risks identified within the ARB Report from existing diesel particulate emission from both the Ports of Los Angeles and Long Beach, and the regional impacts of thoSe identified air emissions, it is requested that a supplemental analysis of air quality impacts throughout the subject document be prepared and re-distributed to all interested parties for review and provision of comments prior to closing the public review and comment period on the DEIR and the preparation of the Final EIR for this project. This analysis needs, to also consider the cumulative impacts of this project and the "Draft ElSIElR - Long Beach LNG Import Project (SCH No. 2003091130)", and the cumulative projects identified in both of these environmental documents, The ARB Report contains on page 2 and 3 the following key findings that should cause all parties involved with this project to re-evaluate the impacts of additional diesel particulate matter emissions upon the region: e Long B.ac~ Anport Terminal DElR.CC StaffRcport 7 Approval ofComme1fl Letter re: DEIR 37-03- Long Beach Airport Terminal Improveme11l Project (SCHNo.200309112) City Council Staff Report .- December 12, 2005 ., 'The key findings from this study are: [J Diesel PM emissions from the ports are a major contributor to diesel PM in the SO!lth Coast Air Basin. The combined diesel PM emissions from the ports are estimated to be about 1,760 tons per year in 2002. This represents a significant component of the regional diesel PM emissions for the South Coast Air Basin (SCAB) at about 21 percent of the total SCAB diesel PM emissions in 2002. Focusing only on diesel PM emissions occurring on port property or within California Coastal Waters (CCW), the emissions from ship activities (transiting, maneuvering, and hotelling) account for the largest percentage of emissions at about 73 percent, followed by cargo handling equipment (10 %), commercial harbor craft vessels (14%), in-port heavy duty trucks (2%), and in-port locomotives (1 %), [J Diesel PM emissions from the ports impact a large area and the associated potential health risks are of significant concern. Diesel PM emissions from the ports result in elevated cancer risk levels over the entire 20-mile by 20-mile study area. In areas near the port boundaries, potential cancer risk levels exceed 500 in a million. As you move away from the ports, the potential cancer risk levels decrease but continue to exceed 50 in a million for more than 15 miles. e Primary diesel PM emissions from the ports also result in potential non-cancer health impacts within the modeling receptor domain. The non-cancer health effects evaluated include premature death, asthma attacks, work loss days, and minor restricted activity days, Based on this study, average numbers of cases per year that would be expected in the modeling area have been estimated as follows: [J 29 premature deaths (for ages 30 and older), 14 to 43 deaths as 95% confidence interval (CI); [J 750 asthma attacks, 180 to 1300 as 95% CI; [J 6,600 days of work loss (for ages 18-65), 5,600 to 7,600 as 95% CI; [J 35,000 minor restricted activity days (for ages 18-65), 28,000 to 41,000 as 95% CI. [J 'Hotelling" emissions from ocean-going vessel auxiliary engines and emissions from cargo handling equipment are the primary contributors to the higher pollution related health risks near the ports. e Long B"""b Airport Termill8l DElR.CC Staff Report 8 e e Approval ofComme11l Letter re: DEIR 37-03- Long Beach Airport Terminallmprovement Project (SCH No. 200309112) City Council Staff Report December 12, 2005 Hotelling emissions from ocean-going vessels account for about 20 percent of the total diesel PM emissions from the ports, These emissions are responsible for about 34 percent of the port emissions related risk in the modeling receptor domain based on the population-weighted average risk. These emissions resulted in the largest area (2,036 acres) where the potential cancer risk levels were greater than 200 in a million in the nearby communities. The second highest category contributing to cancer risk levels above 200 in a million was cargo handling equipment, which impacted a residential area of 410 acres and is responsible for about 20 percent of the total risk in the modeling receptor domain based on the population-weighted average risk, Reducing emissions from these two categories will have the most dramatic effect on reducing the port emissions related risks in nearby communities. o Emissions from commercial harbor craft, in-port trucks, in-port rail, and ocean-going vessels (transit and maneuvering activities) account for a much smaller percentage of the near source risk, but are an important contributor to elevated cancer risk levels over a very large area. Emissions from commercial harbor craft, on-port trucks, on-port rail, and ocean going vessels (maneuvering and transit activities) account for about 70 percent of the total diesel PM emissions for the ports. While emissions from these source categories do not have a major role in the near port risk levels, they are significant contributors to the overall elevated risk levels in the study area, Addressing the emissions from these sources is critical if we are to significantly reduc;e the exposure of a large population (over 2 million people) to cancer risk levels in the 50 in a million range."l Comments and Concerns re: Section 3.2, Air Quality and Human Health Risk Assessment: Revised Analvsis is ReQuired in Lif!ht of New and Sirmificant Air Duality Information Not Available at time ofPreoaration of Draft E1R: As stated above in our comments, it is the position of Seal Beach that a revised "Air Quality" analysis must be prepared and re-circulated for public review and comments due to the release by the Air Resources Board of the referenced "2005 Draft Diesel Particulate Matter Exposure Assessment Study for the Ports of Los Angeles and Long Beach". Long Beach Airport Tenninal DElR.cc StaffReporl 9 Approval of Comment Letter re: DEIR 37-03- Long Beach Airport Term.inal Improveme1fl Project (SCHNo.200309112) City Council Staff Report .- December 12, 2005 ., "Air Quality" and "Hazards" that are not discussed., evaluated, and proposed for mitigation under the current DEIR document. The "Human Health Risk Assessment" portion of this section of the DEIR should also be revised and updated as appropriate, based on a review and evaluation of the conclusions and documentation in the ARB Report. This is particularly important since the DEIR indicates that PMID emissions will remain significant after imposition of all proposed mitigation measures (Section 3.2.4, page 3.2-58) Comments and Concerns re: Section 3.6, Noise: The City recognjzes that the DEIR presents SENEL levels based on the anticipated number of flight operations, and the resulting CNEL and SENEL noise contours, based on the projected number of flights that could be added without airlines or commuters exceeding their allocated portion of the Community Noise Equivalent Level (CNEL) noise budget based on the baseline year of 1989 to 1990, not just the minimum number of flights permitted by the appropriate settlement agreements and the prpvisions of Chapter 16.43 of the Long Beach Municipal Code. Exhibit 3.6-10a, "A320, B727, B757-300' and B767-300 Arrival SEL Contour" clearly indicates portions of Leisure Wodd are impacted by the arrival of all identified types of aircraft except for the A-320 and are within the 85-90 dBA noise contours. The DEIR states on page 3.6-16 that: e "A SENEL of 90 dBA would produce a maximum noise level of approximately 80 dBA outdoors, directly under the flight path The indoor maximum noise level for such a flight would be approximately 68 dBA for a home directly under the flight path The purpose of showing the 85 and 90 SENEL contours is to provide a comparison of the noise levels generated by different aircraft types." A review of the October 11, 2005 ''Noise Budget Calculations for Budget Year October 1, 2004 to September 30, 2005 indicates that the established noise budget for RMT Location 10, the arrival noise monitoring station for enforcement of the Long Beach Airport noise regulations is within the stipulated ''noise budget". As indicated in our previous comment letters on the ''Notice of Preparation" for this project, during several of our City Council meetings concerns have been raised by City Council members and the general public regarding the perceived variances from the approved flight paths for flights descending into Long Beach Airport, and the low level of many of those flight operations. There is a concem that the enforcement of the existing flight approach patterns are not monitored and enforced rigorously enough by the Airport The City has received complaints from the residents regarding the noise impacts of these perceived deviations of the allowable arrival flight patterns. The City of Seal Beach is extremely disappointed that the DEIR does not present a clear and thorough presentation of information regarding the number of arriving flights that deviate from the approved approach patterns, both vertically and horizontally. The DEIR document needs to be revised to clearly indicate those flight pattern deviations and to then clearly establish the resulting noise levels that may be generated by such deviations from the flight patterns, and determine if there are exceedences of the CNEL and SENEL provisions of Chapter 16.43 of the Long Beach Municipal Code in those instances. The City of Seal Beach recognizes that the DEIR includes requested information as to the locations of the current noise monitoring stations, but again is disappointed that the DEIR does not include an evaluation as to the necessity of establishing additional noise monitoring locations within the City of Seal Beach to ensure full and complete compliance with the . provisions of the appropriate settlement agreements and the provisions of Chapter 16.43 of the Long Beach Municipal Code. e In our April 2005 comment letter regarding the NOP for this project the City further requested that the DEIR provide an "Air Carrier Arrivals Crossing Seal Beach" and a "Penetration Gate Plot" analysis similar to that provided within the "Long Beach Airport Brief - Huntington Beach Presentation", dated July 31, 2003 for the appropriate "gate plot" locations either within Seal Beach or the closest applicable gate plot locations to our city boundaries. Again, this requested information has not been provided within the DEIR, and we again request that this information be provided to allow for full disclosure and a better understanding of the existing impacts of such flight deviations on the noise environment in Seal Beach, and particularly within the Leisure World retirement community, which experiences the SENEL levels of between 85 and 90 dBA.. The Environmental QualitY Control Board considered and discussed this DEIR on November 30, 2005 and the City Council considered and discussed the DEIR on December 12, 2005 and authorized the Chairman and Mayor, respectively, to sign this letter, representing the official comments of the City of Seal Beach. The City of Seal Beach recognizes that the scope of the project and the analysis to be conducted as part of the environmental evaluation of this project has changed based on comments received during the 2003 scoping process. The City particularly appreciates your response to our concern of October 14, 2003 regarding the lack of specific information contained in the then Section 3.0, Description of the Proposed Proiect, on the probable number of flight operations that could be accommodated. The specification in the current document of a maximum of 52 flights will allow all reviewing parties to evaluate the forthcoming EIR document on a consistent basis. The City has received complaints from the residents regarding the noise impacts of these perceived deviations of the allowable arrival flight patterns. (District 5) DISCUSSION The City's existing Noise Compatibility Ordinance and the 2003' Airline Settlement Agreement mandate the compilation of monthly, quarterly and annual Air Carrier Noise Budget Analysis Reports, The Settlement Agreement defined the noise budget calendar year, from October 1 through September 30, and further stipulated that the annual noise budget report must be released to the public no later than October 15 of each year and City Council action, if needed, take place on or before November 1 of each year. The noise budget report will determine if the air carriers (airlines) are over or under their allotted noise budget and if supplemental slots (exceeding the 41 slot minimum) can be allocated, The allocation of supplemental slots would only be considered if and when there was a valid request and if the allocation would not exceed the noise budget for the year. In an effort to inform and educate the community on the Airport's noise management policies and noise budget l]lethodology, Airport staff has continued to provide noise budget updates at the Airport Advisory Commission meetings and during public presentations, The Noise Budget Analysis Report for the period ending September 30, 2005, was compiled by Vince Mestre, Mestre Greve Associates, an acoustical engineering consulting firm, Vince Mestre, Principal Engineer, has over 25 years of experience in the field of acoustical analysis. r The findings of the noise budget analysis, which runs from October 1, 2004 through September 30, 2005, indicates that the air carriers finished the year over their allowable budget allowance. Therefore, no supplemental commercial flight slots will be allocated for 2006, This matter was reviewed by Assistant City Attorney Mike Mais on October 10, 2005. HONORABLE MAYOR AND CITY COUNCIL October 18, 2005 Page 2 TIMING CONSIDERATIONS City Council action is requested on October 18, 2005, to satisfy the November 1 deadline required by the City's Noise Compatibility Ordinance and the 2003 Airline Settlement Agreement. The following table compares the allowed budget with the actual budget used: . . Because the air carriers operated above the allowed budget additional flights cannot be allocated as prescn"bed in the City's Noise Compatibility Ordinance. - - The NY '04-05 was significantly impacted by fluctuations in the air carrier fleet mix-relative to the previous Noise Year. In particular, American Airlines increased their number ofMD80 operations relative to the previous Noise Year and Alaska Airlines introduced MD80 operations during the Noise Xear. Individual data was provided .- for each of the commercial airline flights arriving and departing from Long Beach Airport during ., the budget year. The time used for noise budget calculations is the time that the noise event was recorded. at the monitoring site, not the scheduled flight time. Subsequent data includes the aircraft type, airline, departure/arrival/overflight, runway utilized, noise monitor measurement site, and the Sound Exposure Level (SEL), in decibels, as measured at the RMT (remote monitoring terminal). It is interesting to note that 4 of the 5 aircraft in the above example are AirbUs A-320's and there is a substantial range in the measured noise level. There are many factors that contribute to this range, but the most significant is aircraft weight Aircraft weight is a function of the number of paSsengers and the distance to the destination. A flight of 2000 miles carries substantially more fuel that a flight of 250 miles. e e e e Page 3 Noise Budl!et Calculations and Analvsis The conversion of the measured SEL at RMT 9 and RMT 10, is done according to the budget definitions and as prescn"bed in the City's Noise Compatibility OrdinanCe (LBMC 16.43). The fIrSt step in analyzing the data is to convert the noise measurements made at RMT 9 and RMT 10 to the noise level at the nearest residences to Runway 12130. For RMT 9 the noise level is increased by 1.1 dB and at RMT 10 the noise level is increased by 0.9 dB to account for the fact that the nearest homes arc closer to the runway than the actual monitoring stations. The next step is to convert the; noise level at the nearest home to an equivalent number of daytime flights oithe 'standard' aircraft that is built into the budget. Tbis equivalent number of daytime flights is termed "budget units." The 'standard' aircraft noise level is the SEL that 100 daytime flights would have to have to produce a CNEL of 65 dB at the nearest residence. The equation for CNEL as a function of SEL and number of daytime flights is as follows: CNEL - SEL+ 10Log..N.. - 49.4 The above equation can be solved for a value of 65 CNEL and 100 daytime flights and the result is that the 'standard' aircraft SEL is 94.4 dB. The task of converting the actual SEL to an equivalent number of budget units is done using the following equation: lOsano N = 10....'10 The N computed in the above equation is the number of equivalent noise budget units that are contributed to the budget for a daytime flight. If the flight OCCUlTed \:letween the bours of 7 pm and 10 pm, the result is multiplied by a factor of 3. If the flight occurred betWeen the hours of 10 pm Il11d 7 am the result is multiplied by a factor 10. Note that iorpurposes of this computation, the evening penalty begins at 7:00:00 pm and ends at 9:59:59 pm and the night penalty begins at 10:00:90 pm and ends at 6:59:59 pm. There are no exceptions to the evening and night penalties. For example an aircraft may begin its takeoffroll prior to 10 pm but produce a noise event at RMT 9 or 10 after 10 pm. In that case the after 10 pm penalty is applied. The resulting numbers of equivalent budget units arc then compared to the budget allocations of 70.7 budget units at RMT 9, and 84.6 at RMT 10. The budget allocations were based on the 1989190 baseline actual noise level and industrial aircraft forecast as prescribed in the federal court approved and fedliraI code-grandfathered Long Beach Airport Noise Compatibility Ordinance LBMC 16.43). Page 4 e The Long Beach Ordinance provides for allocating additional flights for the next budget year if it is clear that such additional flights will not cause the air carrier budget to be exceeded.
