NOISE MONITORING SERVICES - PLANNING
DEPARTMENT
SUMMARY OF REQUEST:

The proposed City Council action will adopt Budget Amendment 06-10, increasing the
Professional Services account in the Planning Department by $6,000.00 to allow for use
of a noise consultant for on-call noise monitoring services as part of the approved
departmental budget for Fiscal Year 2005-06.
BACKGROUND:
Over the past 6-9 months the City has been receiving an increasing number of code
violation complaints regarding violations of the noise levels as set forth in Article 7,
Chapter 7.15, Noise. The complaints have primarily been regarding long-term
continuous or intermittent noise occurrences that are believed to violate the provision of
Chapter 7.15.
'City staff does not have the expertise or equipment to conduct appropriate noise
monitoring over extended periods of time to determine if the potential code violation
noise events do in fact violate Chapter 7.15.

The City has requested and received a proposal from Giroux & Associates to provide on-
eall monitoring services. The City has previously utilized their services in noise
monitoring related to condition compliance as pf!rl of a Conditional Use Permit approval
for the outdoor dining area at O'Malley's on Main and was very pleased with the quality
of the work. Their billing rates are as follows:

A copy of their proposal is provided as Attachment 2 for the information of the City
Council.
FISCAL IMPACT:
Budget Amendment 06-10 will increase the Professional Services Account budget within
the Planning Department, account number 001-030-44000, from $41,000 to $47,000.
Approval of the amendment would decrease the General Fund"s undesignated estimated
fund ending fund balance from $6,029,244 to $6,023,244.
RECOMMENDATION: '
Adopt City Council Resolution , which will adopt Budget Amendment 06-10
increasing the Professional Services account in the Planning Department by $6,000.00 to
allow for use of a noise consultant for on-call noise monitoring services as part of the
approved departmental budget for Fiscal Year 2005-06.
