RESOLUTION NO. e>?~~~ A RESOLUTION OF THE CITY OF SEAL BEACH REQUESTING THE FHWA TO REVISE THEIR STANDARD AND PROCEDURES ON NOISE LEVEL REQUIREMENTS ON FEDERAL-AID SYSTEM PROJECTS. WHEREAS, the FHWA has promulgated untenable Noise Standards and Procedures for all Federal-aid highway improvements; even though they should only be applied to controlled access highways; and WHEREAS, the Metropolitan Transportation Engineering Board opposed these noise regulations and requirements on October 24, 1974, as being inappropriate when applied to conventional urban highway projects; and WHEREAS, the only even feasible way to comply with these regulations is to construct continuous 8 to 12 foot high walls that would conflict with local ordinances prohibiting property line walls in excess of six feet in the interest of public safety, convenience and aesthetics; and WHEREAS, such wall construction would sacrifice emergency access and public convenience, escalate project and development costs, deny direct access, create air circulation problems, produce a tunnel effect, detract aesthetically from the area and be far more objectionable than the street noise; and WHEREAS, we oppose the use of walls as noise barriers on conventional streets except in critically sensitive areas such as schools, hospitals and auditoriums where street noise would adversely affect the utility of the abutting development; and WHEREAS, we believe noise is an environmental consideration in the local agencies overall evaluation of the project and should not be handled as a separate item; NOW, THEREFORE, BE IT RESOLVED that the City of Seal Beach in the interest of the community and the environment-strongly recommend individual project evaluation and the use of noise attenuators where deemed appropriate by the local agency; and BE IT FURTHER RESOLVED that the FHWA allow the local agency to weigh and evaluate all factors and to make the final decision on the appropriateness of the proposed improvement in the best interest of the community along with its transportation needs; and BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the League of California Cities, County Supervisors Association of California, MTEB, SCAG and Subregional Transportation Planning Agencies in the MTEB area requesting the FHWA revise their noise regulations accordingly and so advise the Congressional delegation, Sen tors Cranston and Tunney, and the Secretary of Transportatior...'-- PASSED, ADOPTED AND APPROVED this /Ir...l day of , 1975, by the following ~e: p ) AYES: Council Members WIU-44AV, Cl ~tU.~ t7)~ ~! ~~ NOES: Council Members ~ ABSENT: Council Members B/lA..-~ ATToEST: ' ~~l; 'c ty Cl rk L ~~c2rlJ Mayor I' I I
