HomeMy WebLinkAboutCC Res 2466 1975-07-28• • 1 r RESOLUTION NUMBER 4?)/66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ESTABLISHING SALARY RATES, A SALARY AND WAGE SCHEDULE, AND OTHER PAYMENTS FOR EMPLOYEE JENEFITS, AND REPEALING, ON THE EFFECTIVE DATES SPECIFIED, ALL RESOLUTIONS IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. The salary schedule as shown on Appendix A attached hereto and made a part hereof for each salary range and /or hourly rate of pay shall constitute the basic compensation and pay plan for all positions in the classified and /or unclassified service. The pay plan consists of five steps or rates of pay in each salary range for full -time or other positions, and hourly rates for certain unclassified positions, both specified in Appendix A. The respective ranges are identified by number and the salary steps within each range by the letters "A" to "E" inclusive. The columnar headings at the top of each column establish the minimum length of service required for advancement to the next higher salary step. The salary schedule hereinafter shown is based on a regular weekly work schedule of forty (40) hours except for employees of the fire department assigned on fire suppression, fire fighting, and /or dispatching duties where the regular weekly work schedule is based on fifty -six (56) hours per week. The equivalent hourly rate for a forty (40) hour per week position may be computed by dividing the monthly rate by 173.3. Section 2. The salary schedule for each position classification except department heads, is indicated in Appendix B attached hereto and made a part hereof, which indicates the range number and "A" and "E" steps of each classified position, the hourly or monthly rate for unclassified positions, and the effective dates of each. Section 3. Department head and Assistant to City Manager and Accountant salaries are listed at top step only. Authority to compensate at a lower monthly salary shall be vested with the City Manager. Section 4. The Memorandum of Understanding between the City of Seal Beach and the Seal Beach Firefighters Association is indicated in Ap- pendix C, and the Memorandum of Understanding between the City and the Seal Beach Police Officers Association is indicated in Appendix D, and are attached hereto and made a part hereof. Upon adoption of this resolution, the wage schedule, employee benefits and working conditions contained in Appendices C and D are effective upon the dates specified in Appendices A and B. Section 5. The provisions of this resolution relating to salary rates shall become effective as listed in Appendix B. Pool Lifeguard #5 H -85 $4.93/hr. 1 • Resolution Number APPENDIX C MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING IS BY AND BETWEEN and THE MANAGEMENT REPRESENTATIVES OF THE CITY OF SEAL BEACH, hereinafter referred to as "Management" THE SEAL BEACH FIREFIGHTERS ASSOCIATION, an Association of Firemen, Fire Engineers, Fire Lieutenants and Fire Captains of the City of Seal Beach, hereinafter referred to as "Association." WHEREAS, Association petitioned City in accordance with provisions of Ordinance Number 769, and was granted certification as a recognized employee organization representing all full -time Firemen, Fire Engineers, Fire Lieu- tenants and Fire Captains of the City; and WHEREAS, the duly appointed, recognized employee representatives of Association and Management representatives representing the City of Seal Beach have met and conferred in good faith on numerous occasions concerning wages, hours and terms and conditions of employment in conformance with the terms, conditions and provisions of Ordinance Number 769 and State Law; and WHEREAS, Association and the Management representatives have mutually agreed to recommend to the City Council of the City of Seal Beach all the terms, conditions, hours and wages pertaining to employment with City for those employees represented by Association, as set forth in this Memorandum of Understanding. Section 1. Effective Date. This Memorandum of Understanding shall be effective by and between Management and Association upon execution by Management and the required number of the duly authorized recognized representatives of Association. Section 2. Term of Memorandum of Understanding. This Memorandum of Understanding shall remain in full force and effect until Midnight, August 1, 1976. Section 3. Recognition of Prior Memoranda. It is recognized and agreed that prior Memoranda of Understanding have been executed by Management and the Association in past years. Those Memoranda remain in full force and effect except as specifically modified by this Memo- randum of Understanding. Section 4. Recognition of Military Service as Prior Public Service. Management agrees to provide enabling legislation within a reasonable period of time allowing an employee to include within the definition of his prior "public service" military service time as permitted by Section 20930.3 of the California Government Code. It is expressly understood that this in no way obligates the City to participate in the required reimbursement of the Public Employees' Retirement System. Section 5. Dental Plan - Effective August 1, 1975. Management agrees to administer and assume 100% of the cost of the current Association dental plan. Section 6. Uniform Fund - Effective August 1, 1975. Management agrees to pay $17.50 per Association member per month as the Uniform Allowance applicable to Association Members. Resolution Numbet. Management agrees to provide the following monetary educational assistance to sworn employees of the Fire Department: Units Completed Units in Fire Science 30 16 60 21 Bachelor's degree 31 Section 8. Income Continuation - Effective August 1, 1975. Management agrees to increase the maximum benefit under its existing income continuation plan to One Thousand Dollars ($1,000.00) per month. Section 9. Annual Physical Examination - Effective August 1, 1975. Management agrees to provide, as an incentive, Ten Dollars ($10.00) per Association Member per year toward a physical examination. Ten Dollars ($10.00) to be paid on a reimbursable basis within a reasonable period of time following presentation of a copy of the statement of charges by the physician performing the examination. Section 10. Life Insurance - Effective August 1, 1975. Management agrees to provide a group life insurance plan providing life insurance coverage of $15,000 for each full -time, classified Fire Department employee, $1,500 coverage for said employee's spouse, and $500 for each dependent child (6 months to 21 years of age) commencing on the 61st day of full -time employment. Section 11. Minimum Promotional Salary Increase - Effective August 1, 1975. Management agrees that the minimum salary increase for persons promoted in the fire service shall be 5% over the pay received in the prior position classification. Management agrees to study the feasibility of improved Health Insurance Plan(s) through a committee composed of one representative of each employees' association and one representative appointed by the city manager to represent "nori- represented" employees. It is hereby agreed to improve the current health insurance plan by an amount not to exceed $.6.,000 for all city employees for the current fiscal year effective with a new contract with the City Employees Association (CEA) on January 1, 1976. A majority of said committee to determine areas of improvement. Section 13. Sick Leave - Effective August 1, 1975. Upon retirement or honorable termination after twenty (20) years of service, an employee shall receive a cash payment for unused accumulated sick leave at that time based on the following compensation schedule: 1 -30 Shifts: $0; 31 -90 Shifts: 25% not to exceed $500; 90+ Shifts: 50% not to exceed $1 Section 14. Wages and Salaries. Separability. If any provision of the Memorandum of Understanding or the application of such provision to any person or circumstance, shall be held invalid, the remainder of the Memorandum of Understanding, or the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby. WHEREAS, Association petitioned City in accordance with provisions of Ordinance Number 769 and was granted certification as a recognized employee organization representing all sworn police department personnel in accordance with Government Code Section 3508 which states that: ". . the governing body may not prohibit the right of its employees who are full -time "peace officers" as that term is defined in Section 817 of the Penal Code, to join or participate in employee organizations which are composed solely of such peace officers, which concern themselves solely and exclusively with the wages, hours, working conditions, welfare programs, and advancement of the academic and vocational training in furtherance of the police profession, and which are not subordinate to any other organization." WHEREAS, the duly appointed, recognized employee representatives of Association and Management representatives representing the City of Seal Beach have met and conferred in good faith on numerous occasions concerning wages, hours and terms and conditions of employment in conformance with the terms, conditions and provisions of Ordinance Number 769 and State Law; and WHEREAS, Association and the Management representatives have mutually agreed to recommend to the City Council of the City of Seal Beach the terms, conditions, hours, and wages pertaining to employment with City for those employees repre- sented by Association, as set forth in this Memorandum of Understanding. Section 1. Effective Date. This Memorandum of Understanding shall be effective by and between Management and Association upon execution by Management and the required number of the duly authorized recognized representatives of Association. Section 2. Term of Memorandum of Understanding. This Memorandum of Understanding shall remain in full force and effect until Midnight, July 31, 1976. Section 3. Maintenance of Existing Benefits. Except as provided herein, all wages, hours and other terms and conditions of employment presently enjoyed by employees represented by the Association shall remain in full force and effect during the entire term of this Memorandum of Understanding unless mutually agreed to the contrary by both parties hereto. Section 4. Dental Plan - Effective August 1, 1975. Management agrees to administer and assume 100% of the cost of the current Association Dental Plan not to exceed $15 per employee per month. Section 5. Uniform Fund - Effective August 1, 1975. Management shall increase its monthly contribution to the existing Uniform Fund to $20 per each member of the Association. 1 Resolution Number Memorandum of Understanding 1975 -76 Seal Beach Police Officers Association Page Two Section 6. Education Incentive - Effective August 1, 1975. The educational incentive program currently in existence as set forth in Section 4 of the Memorandum of Understanding executed by and between the parties on June 7, 1974, shall be modified as follows: (1) Attainment of an Intermediate POST certificate shall entitle a member of the Association to the benefits available under paragraph B of the plan; (2) Attainment of an Advanced POST certificate shall entitle a member of the Association to the benefits available under paragraph C of the plan. Section 7; Life Insurance - Effective August 1, 1975. Management agrees to provide life insurance coverage for Association members, their spouses and dependents through the Meyers /Stevens Porac Plan II Plus, and to pay 100% of the premiums incidental thereto. (Schedule of benefits attached as "Exhibit A. ") Section 8. Maximum Accumulation of Compensatory Time Off - Effective Aug. 1, 1975. Management agrees to allow Association members to accumulate up to 400 hours of compensatory time off. Section 9. Physical Fitness Plan. Representatives of Management and the Association shall establish a study group for the purpose of developing a physical fitness program which shall include a point accumulation system predicated on definite physical fitness standards. Said program shall include: (1) Standards and sanctions for all employees hired after August 1, 1975; and (2) A monetary incentive for all employees who participate in the program of $2.50 per each ten (10) points earned. 1 Section 10. Health Insurance. Effective January 1, 1976, the existing health insurance program for all City employees, including all members of Association, shall be improved in the following manner: (1) The amount of funds contributed by the City for 100% of the premiums for all employees and dependents shall be increased by an amount not to exceed $6,000.00 for the six -month period through and including June 30, 1976. (2) The manner in which the program shall be improved as a result of said increased premiums or otherwise shall be ascertained by a study committee to be established as soon as practicable following the execution of this Memorandum of Understanding. The committee shall consist of one representative from each recognized employee organization, including Association, and one representative selected by the City Manager to repre- sent employees of the City who are not represented by any of those employee organizations. Payment of Unused Sick Time. Effective August 1, 1975, upon termination from City employment, any member of the Seal Beach Police Officers Association with fifteen years of service will be paid 25% of his accumulated sick time at his or her then current hourly rate. Payment of accumulated sick time will not exceed $1,500.00 per member. Section 12. Scheduling. Management shall provide the uniformed members of the Association with the four (4) days per week, ten (10) hours per day work schedule. Section 13. Wages and Salaries. Separability. If any provision of the Memorandum of Understanding, or the application of such provision to any person or circumstance, shall be held invalid, the remainder of the Memorandum of Understanding, or the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby. Section 15. Implementation.
