HomeMy WebLinkAboutCC Res 2416 1975-03-24 I I I RESOLUTION NO. .;(~I ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH REVISING GUIDELINES TO BE FOLLOWED IN THE IMPLEMENTATION OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970 AND RESCINDING ALL PREVIOUS ACTIONS IN CONFLICT HEREWITH. The City Council of the City of Seal Beach does hereby resolve: WHEREAS, in September of 1972 the California Supreme Court in the Case of Friends of Mammoth et al vs Board of Supervisors of Mono County held that the California Environmental Quality Act applied to both public projects and private projects which required approval by the appropriate governmental agency; and WHEREAS, Environmental Impact Report requirements and procedures were adOpted by the City Council on October 24, 1972, in view of said court decision; and WHEREAS, the State Resources Agency has prepared standardized guidelines to be followed by all cities throughout the State in implementing the California Environmental Quality Act of 1970. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach does hereby adopt the report entitled "Environmental Impact Report Guidelines" prepared by the staff and attached as Exhibit "A" and "Guidelines for Implementation of the California Environmental Quality Act'of 1970" as amended and as may be amended by the Secretary of the Resources Agency, prepared by the State Resources Agency. AND BE IT FURTHER RESOLVED that the City Council of the City of Seal Beach does hereby rescind all previous policy determinations in conflict with the above provisions. Because of the complex inter~elationships which exist within our system, it is essential that a hi~h degree of environ:nental eo:npatibility be maintained for the general welfare of the r~sidents of the community. The, Director of Planning will deter.nine whether or not an Environmental Impact Report ~ust be prepared for a proposed . project. If an ImpDct Report.is required, it will be the responsibility of the Director to inform the applicant of the reasons why, in his opinioll, an Environmental Impact Report should be prepnred. The npplicant nay nppeal the Planning Di~ector's decision to the Envirolli~ental ~~nlity Control Eo~d. If after review of the " Environmental Evaluation Form, the Director'of Planning' determines that the project will not have a significant effect on the enviro~~ent he shall oversee the preparation of a Negative Declaration and a Notice of Determination for said I project. The City!.Clerk will then forward the Negative Declaration and lJotice of Determination to the County Clerk. I 'Upon reaching a determination that a proposed project will require the . preparation of an En\"ironmental Impact Report.. the Director of Planning will forward all relevant information to the Secretary of the Environmental Quality Control Board. The Secretary to the Board ....ill be responsible for directing the preparation of the Report. Upon completion of the draft Environmental Impact Report, the Secretary I to the ,iEnvironmental Quality Control Board shall schedule a public hearing no later than fifty (50) days foll~.ing the draft's submission. Public posting and advertising for the hearing shall be in accordance \l"ith City Council pOlicy. , FollO\/lnB public posting and adver"tisinG, the Envirollll!ental Qual! ty Control I Board shall hold a public ~earing for consideration of the draft J~nvirO~'llentl<l Impact Report. Environmental Impact Re~orts which have been fa~nd sufficient shall be forwarded to the City Council for affir~ation. If the project for which an Environlllental Iupaet Report has been prepared requires Planning Corr~ission consideration, the p~oposal and findings by the ~vironment~Quality Control Board shall. b~'fo;warded'to the Commission for consideration in their deliberations. In those cases where the Environmental Impact Report and findings have been referred to the Planning Commission, final effirmation of the Environmental Impa~t Rep~rt should be made by ~~e City Council. EXCEPTIOllS 4 Amendments to the Zoning Ordinance initiated' by the local agency and general . or specific plans.shall not require consideration by the Environmental Quality Control Board. When it has been determined that an Environ~ental ~mpact Report is required in conjunction with an amendment or plan as described above, a public hearing shall be. conducted by the Planning Commission to consider the environmental effects of the proposed project. A hearing shall be no later than fifty (50)'days following the preparation of an Environl'llental Impact Report. Public posting and advertising for the public hearing shall be in accordance with City Council policy. , An.
