A RESOLUTIOII OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, OPPOSING THE FEDERAL
HIGHWAY ADMINISTRATION AND URBAN MA5~ Tp'A~SP0~J.AJInN
ADMINISTRATION (FHIIA/U~rrA) DRAFT GUIDELINES FOR A
TRANSPORTATIOII DEVELOP~'EIlT PROGRAM (TOP) AND
URGING FHWA/UMTA TO WORK WITH THE INDIVIDUAL URBANIZED
AREAS TO DEVELOP A PROGRAM APPLICABLE TO THAT
PARTICULAR AREA.
WHEREAS, the City Council of the City of Seal Beach opposes the Federal Department
of Transportation proposed guidelines for the development, content, and processing
of a Short-Range Transportation Improvement Program for urbanized areas known as
Transportation Development Program; and
WHEREAS, the proposed FHWA/UMTA guidelines for a TDP requires all urbanized areas
regardless of size or individual circumstance to accept the same TOP methodology;
and
WHEREAS, these guidelines require that local agencies, I~hich budget more than
two hundred million ($200,000,000.00) annually, submit an inordinate amount of
detail regarding projects of purely local significance to qualify a few projects
for some thirty-four million ($34,000,000.00) in Federal funding; and
I~EREAS. FHIlA/UMTA, through the promulgation of new Federal guidelines, propose
a new decision-making process for the Federal-aid Transportation Program in
California; and
WHEREAS, FHIJA/UMTA propose that the regional transportation planning agencies
be responsible for project selection and establishment of priorities through a
new process called the Transportation Development Program (TDP) instead of the
cities and counties; and
WHEREAS, the urbanized cities and counties now have or are developing allocation
and implementation procedures for administering the Federal-aid Urban Program
that are to be approved by the State and HillA; and
WHEREAS, these procedures are being developed to minimize "red tape" and to
ensure the effective use of Federal-aid Urban funds on significant projects as
determined by the cities and counties to allow their energy to be spent in
getting the plans ready instead of getting the plans approved; and
WHEREAS, these procedures allow the cities and counties to determine the proper
modes of transportation, to establish priorities, to realize an equitable
distribution of funds, and to consider funding sources; and
loJIlEREAS, the 1973 Federal-aid High~/ay Act provides that the responsible local
official shall determine Urban route selection, choice of mode, establisl~ent of
priorities, and consideration of funding sources; and
WHEREAS, the FH~IA/UMTA proposal will remove the local decision-making process
from cities and counties and vest same in the Southern California Association of
Governments (SCAG). which has been designated the Regional Transportation Planning
Agency for this area; and
llHEREAS, this City Council has consistently supported the concept that decisions
be made by those most directly responsible to the people, such as the cities and
counties, and has opposed the creation of additional levels of government 11ith
their attendant "red tape"; and

WHEREAS, this City Council also supports the notion of clearinghouse review
(A-95 process) and the regional approach for transportation planning purposes;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach
opposes FHWA/UMTA's proposed Transportation Development Program as requiring an
inordinate amount of detail regarding local transportation projects and an
expansion of the "red tape" menace which is opposed by Congress and local agencies
alike; and
BE IT FURTHER RESOLVED that this City Council recommends that the FHI'JA/Ut.ITA I'rork
with each of the urbanized areas to develop a short-range transportation
improvement program procedure that ~~uld be applicable to each urbanized area;
and
BE IT FURTHER RESOLVED that this City Council opposes FHWA/U~lTA's proposed
Transportation Development Plan which vests the authority to select projects and
establish transportation priorities with a Regional Transportation Planning
Agency, l'lhich will increase the maze of "red tape" necessary to process a
Federally funded project, and will effectively destroy the local agency's ability
to respond to matters of purely local interest; and
BE IT FV~THER RESOLVED that this City Council supports a process whereby the
Regional Transportation Planning Agency, provides assurances that programs
developed and projects which are selected by responsible local officials are
in accord with the evolving Regional Transportation Plan; and
BE IT FINALLY RESOLVED that copies of this Resolution be forl~rded to the League
of California Cities, every city in Orange County, County Supervisors
Association of California, Southern California Association of Governements (SCAG),
requesting they take similar action opposing the implementation of the FHWA/UtITA
proposed guidelines for a Transportation Development Program, and that they urge
FHWA/UtITA to I'/Ork ~,ith each urbanized area to develop appropriate transportation
program procedures for their area and so advise their Congressional delegation,
Senators Cranston and Tunney, and the Secretary of Transportation.
