A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH. CALIFORNIA. URGING THE LEAGUE OF
CALIFORNIA CITIES TO PROMOTE A LEGISLATIVE PROGRAM
TO MINIMIZE THE EFFECTS OF EXCESSIVE LITIGATION ON
NECESSARY PUBLIC WORKS PROJECTS.
the California State Legislature has adopted legislation such as
the California E.nvironmental Quality Act. recognizing the importance
of preserving and maintaining the environment for the health.
safety and welfare of the public; and
public works projects are. by definition. dedicated to the health.
safety and welfare of the public; and
the benefits of the majority of public works projects consist of
improvement of water or sewer services. provision for flood control
to prevent loss of life and property. and construction of energy
sources to meet critical public needs; and
certain environmental groups have unnecessarily delayed beneficial
public works projects for environmental reasons by excessive
environmental litigation which has caus~d the costs of such projects
to increase; and
WHEREAS. the unnecessary dele.y is detrill1llntal to the health. safety and
welfare of the public; .
NOW. THEREFORE. BE IT RESOLVED that the City Council of the City of Seal Beach
urges the League of CalifOrnia Cities to promote a legiSlative program designed
to mininrlze the impact of excessive litigation on the resolution of environ-
mental suits on necessary public works projects.

BE IJ' FURTHER RESOLVED that the League of California Cities consider such
solutions as priority of such cases on court calendars. slllllllllry judgment
procedures. the awarding of judgment for attorney's fees against unsuccessful
environmenta} plaintiffs. and the requirement of bonds to be posted by environ-
mental plaintiffs to co.nsate successful defendants for damages incurred
as a result of rising costs due to de~~.
BE IT FURTHER RESOLVED that copies of this resolution be sent to the League
of California Cities. Senator Dennis Carpenter. Assenmlyman Robert Burke and
all cities in Orange County.
