HomeMy WebLinkAboutCC Res 2345 1974-07-22RESOLUTION NUMBER a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ESTABLISHING SALARY RATES, A SALARY AND WAGE SCHEDULE, AND OTHER PAYMENTS FOR EMPLOYEE BENEFITS, AND REPEALING, ON " THE EFFECTIVE DATES SPECIFIED, ALL RESOLUTIONS IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. The salary schedule as shown on Appendix A attached hereto and made a part hereof for each salary range and /or hourly rate of pay shall constitute the basic compensation and pay plan for all positions in the classified and /or unclassified service. The pay plan consists of five steps or rates of pay in each salary range for full -time or other positions, and hourly rates for certain unclassified positions, both specified in Appendix A. The respective ranges are identified by number and the salary steps within each range by the letters "A" to "E" inclusive. The columnar headings at the top of each column establish the minimum length of service required for advancement td the next higher salary step. The salary schedule hereinafter shown is based on a regular weekly work schedule of forty (40) hours except for employees of the Fire Department assigned on fire suppression, fire fighting, and /or dispatching duties where the regular weekly work schedule is based on fifty -six (56) hours per week. The equivalent hourly rate for a forty (40) hour per week position may be computed by dividing the monthly rate by 173.3. Section 2. The salary schedule for each position classification except department, heads, is indicated in Appendix B attached hereto and made a part hereof, which indicates the range number and "A" and "E" steps of each classified position, the hourly or monthly rate for unclassified positions, and the effective dates of each. Section 3. Department head and Assistant to City Manager salaries are listed at top step only. Authority to compensate at a lower monthly salary shall be vested with the City Manager. Section 4. The Memorandum of Understanding between the City of Seal Beach and the Seal Beach Firefighers Association is indicated in Appendix C, and the Memorandum of Understanding between the City and the Seal Beach Police Officers Association is indicated in Appendix D, and are attached hereto and made a part hereof. Upon adoption of this Resolution, the wage schedule, employee benefits and working conditions contained in Appendices C and D are effective upon the dates specified in Appendices A and B. Section 5. The provisions of this Resolution relating to salary rates shall become effective as listed in Appendix B. APPENDIX C MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING IS BY AND BETWEEN and THE MANAGEMENT REPRESENTATIVES OF THE CITY OF SEAL BEACH, hereinafter referred to as "Management" THE SEAL BEACH FIREFIGHTERS ASSOCIATION, an Association of Firemen, Fire Engineers, Fire Lieutenants and Fire Captains of the City of Seal Beach, hereinafter referred to as "Association." WHEREAS, Association petitioned City in accordance with provisions of Ordinance Number 769, and was granted certification as a recognized employee organization representing all full -time Firemen, Fire Engineers, Fire Lieutenants and Fire Captains of the City; and WHEREAS, the duly appointed, recognized employee representatives of Association and Management representatives representing the City of Seal Beach have met and conferred in good faith on numerous occasions concerning wages, hours and terms and conditions of employment in conformance with the teams, conditions and provisions of Ordinance Number 769 and State Law; and WHEREAS, Association and the Management representatives have mutually agreed to recommend to the City Council of the City of Seal Beach all the terms, conditions, hours and wages pertaining to employment with City for those employees represented by Association as set forth in this Memorandum of Understanding. Section 1. Management Prerogative Clause. It is understood that the City retains all of its rights and powers to direct and control the business of the City to the fullest extent required by law. Management and Association agree that replacement of personnel and their replacement rate is a management prerogative. Section 2. Effective Date. This Memorandum of Understanding shall be effective by and between Management and Association upon execution by Management and the required number of the duly authorized recognized representatives of Association. Section 3. Term of Memorandum of Understanding. This Memorandum of Understanding shall remain in full force and effect until Midnight, August 1, 1975. Section 4. Recognition of Prior Memorandum of Understanding. l t Is recognized and agreed that a Memorandum of Understanding was executed by Management and Association, becoming effective August 1, 1973, and termi- nating at Midnight, August 1, 1974, said Memorandum of Understanding remains in full force and effect until aforementioned termination date. It is further recognized and agreed that this Memorandum of Understanding shall not modify the aforementioned agreement until the effective date of said Memorandum of Understanding. Section 5. Dental Care - Effective January 1, 1975. Management agrees that the City shall contribute nine dollars ($9.00) per month per full -time employee to the Seal Beach Firefighters Association for the purpose of providing a dental health care program for full -time Fire Department employees and their dependents. The dental health care program shall be administered totally by the Seal Beach Firefighters Association. Resolution Number Memorandum of Understanding Seal Beach Firefighters Page Two Section 6. Move Up Compensation. Effective September 1, 1974, those full -time Firemen who are officially certified by the Fire Chief as qualified to perform the duties and responsi- bilities of Truck Operator and are temporarily assigned to the position of Truck Operator, shall be compensated for the time served as Truck Operator at the monthly salary step in the Engineer classification. salary range 100, which corresponds to their salary step in the Fireman classification. Quali- fication shall be determined by a test administered by the Fire Chief. Section 7. Salaries and Wages. Separability. If any provisions of the Memorandum of Understanding, or the application of such provision to any person or circumstance, shall be held invalid, the remainder of the Memorandum of Understanding, or the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby. Section 9. Previous Agreement. All benefits and working conditions not specifically referred to herein shall remain in effect. WHEREAS, Association petitioned City in accordance with provisions of Ordinance Number 769 and was granted certification as a recognized employee organization representing all sworn police department personnel except Chief of Police in accordance with Government Code Section 3508 which states that: " . . the governing body may not prohibit the right of its employees who are full-time "peace officers" as that term in defined in Section 817 of the Penal Code, to join or participate in employee organizations which are composed solely of such peace officers, which concern themselves solely and exclusively with the wages, hours, working conditions, welfare programs, and advancement of the academic and vocational training in furtherance of the police profession, and which are not subordinate to any other organization." WHEREAS, the duly appointed, recognized employee representatives of Association and Management representatives representing the City of Seal Beach have met and conferred in good faith on numerous occasions concerning wages, hours and terms and conditions of employment in conformance with the terms, conditions and provisions of Ordinance Number 769 and State law; and WHEREAS, Association and the Management representatives have mutually agreed to recommend to the City Council of the City of Seal Beach all the terms, conditions, hours and wages pertaining to employment with City for those employees represented by Association, as set forth in this Memorandum of Understanding, with the proviso that these negotiations will continue and cover auxiliary subjects, but shall not affect any section agreed herein. Section 1. ' Effective Date. This Memorandum of Understanding shall be effective by and between Management and Association upon execution by Management and the required number of the duly authorized recognized representatives of Association. Section 2. Term of Memorandum of Understanding. This Memorandum of Understanding shall remain in full force and effect until Midnight, July 31, 1975. Section 3. Recognition of'Prior Memorandum of Understanding. It is recognized and agreed that a Memorandum of Understanding was executed by Management and Association, became effective August 24, 1973, and will terminate at Midnight, August 1, 1974, and that said Memorandum of Understanding remains in full force and effect until the aforementioned termination date. It is further recognized and agreed that this Memorandum of Understanding shall not modify the aforementioned agreement until on or after Midnight, August 1, 1974. Resolution Number ' Section 4. Education Incentive - Effective November 1, 1974 All members completing initial probation will be eligible to participate in the educational incentive program, if all requirements are met. Steps will be: A - -45 college units with at least 16 in the police science field or attainment of a POST Intermediate Certificate. B - -60 college units with at least 19 in the police science field or attainment of a POST Advanced Certificate. C - -A Bachelors degree earned with at least 22 units in the police science field. A-- $40.00 B-- $60.00 Section 5. Uniform Fund - Effective August 1, 1974 Effective August 1, 1974, the Uniform Fund is to be used to replace.or repair required Uniform and /or safety equipment, as listed hereunder, which has been worn out due to normal wear or use. C-- $80.00 An Employee may utilize his entire fund to replace or repair worn out uniform items; however, he may not deplete his individual fund below a $50.00 minimum for the purpose of replacing required safety equipment. Uniform and /or safety equipment that has been damaged while in the performance of an employee's duties is to be replaced by the City. The City will continue to furnish duty helmets and mace. The Fund will cover Uniformed and Non- Uniformed (detectives) sworn personnel and will have no maximum balance limit. Section 6. Insurance Programs. (A) Dental Insurance - Effective January 1, 1975 (1) Part time, seasonal, provisional, and /or hourly employees and reserve police officers shall not be eligible for participation in this program. -2- Resolution Number (2)_ Full -time Police Department employees of the City who.have completed thirty (30) days of uninterrupted service shall -be enrolled in this insurance program on the first day of the next succeeding month. (3) Police Department employees who change classification from full -time to part time, provisional, hourly, or seasonal shall not be eligible for this benefit. (4) City shall not pay premiums for any Police Department employee on leave of absence without pay, or for any Police Department employee who has terminated from City employment for any reason. (5) City shall not make any monthly premium payments on behalf of any Police Department employee who has been absent without authorization during said month. (6) City agrees to pay, effective January 1, 1975, nine dollars ($9.00) per month per member of the Association and his or her eligible dependents to provide for a dental plan for each full - time employee. The payment shall be made to the Seal Beach Police Officers Association or its designee and the dental plan shall be chosen by the Association. The dental plan shall be administered by the Association unless otherwise agreed to by the City of Seal Beach and the Association. (8) Income Continuation Insurance - Effective January 1, 1975 (1) Part time, hourly, seasonal, and /or provisional Police Department employees, and any Police Department employee who is not employed on a continuous, full -time basis shall not be eligible for income continuation insurance. (2) Full -time Police Department employees who have completed sixty (60) days of continuous, uninterrupted service after the 15th day of the month in which employee is hired shall be eligible for this benefit on the first day of the next succeeding month. (3) City of Seal Beach shall not make any monthly premium payments on behalf of any Police Department employee who has been absent without authorization during said month. Premium payments shall be made on behalf of those Police Department employees who are receiving Workmen's Compensation Insurance payments for temporary disability. (4) Police Department employees who change classification from full -time to a classification of part time, seasonal, provisional, or hourly shall not be eligible for coverage. (5) Commencing January 1, 1975, the City agrees to provide the group insurance plan offered by P.O.R.A.C. for income continuation for employees represented by the Association. Said insurance to -3- Resolution Number proyide an income continuation of One Thousand Dollars ($1,000.00) per month or sixty -seven per cent (67 %) of employee'•s weekly salary, whichever is the lesser. Said insurance to be effective under the terms of said policy. Total payment for each eligible employee will be $7.80 per month. Any premium increase during the term of this Memorandum shall be assumed by the City. Section 7. Annual Physicals - Effective August 1, 1975 Members of the Seal Beach Police Officers Association shall be provided a physical exam periodically as indicated below for the purpose of detecting heart trouble and cancer. The exam shall be given by a City appointed doctor who is acceptable to the Association and shall not exceed One- Hundred Dollars ($100.00) per member in cost. The resulting diagnosis shall be submitted to the City as well as the employee together with specifics of corrective treatment. Physical Exam Schedule: A. New Employee B. Employee under 40 C. Employee 40 and over Second year following completion of probation. Alternate years. Every year. Section 8. Extra Range Ammunition - Effective January 1, 1975 The City shall provide 100 rounds of ammunition per member of the Association per month to be used for range practice. Section 9. Wages and Salaries. The following monthly salary ranges will be effective August 1, 1974. A E Patrolman $ 989 $1202 Policeman II 1038 1262 Sergeant 1159 1409 Lieutenant 1342 1632 Captain 1479 1800 (A) Effective August 1, 1974, Captain's Bureau Commander's pay shall be deleted from compensation. Section 10. Overtime. Effective January 1, 1975, all Association personnel on 5 -2 shift shall be given choice of pay or compensatory time off for all overtime worked. Section 11. Holide s. All Association personne on the 5 -2 shift shall have their paid holidays increased to eight (8), following the same holiday schedule as miscellaneous employees. Section 12. Bereavement Leave. In the event of the death of a member of the immediate family of a sworn police officer, effective November 1, 1974, he shall be granted three day's leave of absence with pay, not chargeable to accumulated sick time. -4- 1 • Resolution Number' • Section 13. Benefits. City shall not pay on behalf of any Police Department employee the cost of any fringe or supplemental wage benefits, including, but not limited to, group life insurance, marksmanship bonus, uniform allowance, and /or supplemental pay, or the wages or salaries of said employee during any unauthorized absence or during any period of time such employee is suspended without pay or on leave of absence without pay. In such instances, however, employee may make arrangements to pay such costs by authorized payroll deductions and /or cash payment to City. Section 14. Separability. If any provision of the Memorandum of Understanding, or the application of such provision to any person or circumstance, shall be held invalid, the remainder of the Memorandum of Understanding, or the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby. Section 15. Previous Agreement. All benefits and working conditions not specifically referred to herein shall • remain in effect.
