A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH CONDITIONALLY APPROVING APPEAL
NO. A-3-74. (STUKALOFF)
WHEREAS, an application was duly filed by Les Stukaloff, 2061 Rancho La
Merced, Covina, California. appealing Planning Commission denial of Variance
V-29-74 to permit less than the required rear yard setback or with modifications
to the building permitting three parking stalls of less than the required
length for a four-unit apartment building located in the Multiple Residential
Zone. The property is described as Lot 12 and one-half of Lot 14, Block 2,
Bay City Tract, and is more commonly known as 112 2nd St.; and
WHEREAS. a public hearing was advertised as required by law and held before
the City Council on August 26. 1974. Written information was reviewed and oral
comments were received by the City Council; and
WHEREAS. the matter of Appeal A-3-74 was referred back to the Planning
Commission and on September 4, 1974. the Planning Commission eonsidered the
applicant's appeal and the City Council's findings; and
WHEREAS. the Planning Commission. by Resolution No. 866. recommended that
the City Council conditionally approve Appeal A-3-74 based on the following
findings:
1. The granting of the appeal will not adversely affect the general plan.
2. Requiring major modifications of the existing building to obtain
compliance with all code provisions \~uld result in extreme and
unnecessary hardship to the applicant.
3. The circumstances that pertain to this application are unique in that
the building has already been constructed.
4. With a nine-foot rear yard setback, access to the three parking stalls
at the rear of the property would be greatly improved.
5. This property is situated in an unusual location with alleys at both
the side and rear of the property providing vehicular access to the
site.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal
Beach does conditionally approve Appeal A-3-74 subject to the following
conditions:
1. That the rear of the building be modified to hold a nine-foot setback
from the rear property line.
2. That all steel posts be removed from the rear yard setback.
AND, BE IT FURTHER RESOLVED that the City Council does permit two of the
four units of the building to be occupied imnlediately. The remaining two units
may be occupied after modifications are made to the rear of the building.
PASSED, APPROVED AND ADOPTED by the City Council of/1the Ci~y qf Seal Beach
