A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH SUPPORTING ASSEMBLY BILL NO. 95 OF THE
1973-74 REGULAR SESSION OF THE CALIFORNIA LEGIS-
LATURE, RELATING TO THE PUNISHMENT FOR FELONIES
COMMITTED WITH FIREARMS, AND GIVING REASONS THEREFOR.
Assembly Bill No. 95 of the 1973-74 California Legislature amends
certain sections of the California Penal Code relating to sentences
to be imposed in certain cases; and
WHEREAS, said Legislative Bill adds explosive and destructive devices to
the definition of deadly weapons; and
WHEREAS,
WHEREAS, punishment for certain crimes committed with deadly weapons has
heretofore been established by the California Legislature; and
WHEREAS, Assembly Bill No. 95 now revises said sentences in addition to
addin9 explosives and destructive devices to the definition of
deadly weapons; and
WHEREAS, said Bill provides that any punishment for any felony committed
while using or armed with deadly weapons as the definition has been
revised, will be ten (10) years for the first offense, twenty (20)
years for the second offense and life for third offense without
possibility of probation, parole or other release until the
completion of said terms; and
WHEREAS, said Assembly Bill No. 95 and the concepts expressed therein have
been reviewed by the Police Department and have received the approval
in principle of the measures expressed in said Assembly Bill;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach
offers its support to Assembly Bill No. 95 as the same was introduced on
January 17, 1973, and referred to the Committee on Criminal Justice.
BE IT FURTHER RESOLVED that a copy of this Resolution supporting Assembly Bill
No. 95 be forwarded to the Senate and Assembly representatives for the City
of Seal Beach in Sacramento.
BE IT FURTHER RESOLVED that copies of this Resolution be forwarded to members
of the Assembly Committee on Criminal Justice.
BE IT FURTHER RESOLVED that copies of this Resolution be forwarded to all of
the cities in Orange County with a request that similar Resolutions be adopted.
BE IT FINALLY RESOLVED that the staff of the City of Seal Beach, within the
scope of the duties of their various offices, assist the California Legislature
in moving this Bill forward for eventual passage by both the Assembly and the
Senate, and for approval by the Governor of the State of California.
