A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, A CHARTER CITY,
ESTABLISHING SALARY RATES, A SALARY AND WAGE
SCHEDULE, AND OTHER PAYMENTS FOR EMPLOYEE
BENEFITS, AND REPEALING, ON THE EFFECTIVE DATES
SPECIFIED, ALL RESOLUTIONS IN CONFLICT THEREWITH.
The City Council of the City of Seal Beach does hereby resolve:
Section 1. The salary schedule as shown on Appendix A attached hereto and
made a part hereof for each salary range and /or hourly rate of pay shall constitute
the basic compensation and pay plan for all positions in the classified and /or
unclassified service. The pay plan consists of five steps or rates of pay in
each salary range for full -time or other positions, and hourly rates for certain
unclassified positions, both specified in Appendix A. The respective ranges are
identified by number and the salary steps within each range by the letters "A"
to "E" inclusive. The columnar headings at the top of each column establish the
minimum length of service required for advancement to the next higher salary step.
The salary schedule hereinafter shown is based on a regular weekly work schedule
of forty (40) hours except for employees of the Fire Department assigned on fire
suppression, fire fighting, and /or dispatching duties where the regular weekly
work schedule is based on fifty -six (56) hours per week. The equivalent hourly
rate for a forty (40) hour per week position may be computed by dividing the
monthly rate by 173.3.
Section 2. The salary schedule for each position classification is indicated
in Appendix B attached hereto and made a part hereof, which indicates the range
number and "A" and "E" steps of each classified position, the hourly or monthly
rate for unclassified positions, and the effective dates of each.
Section 3. The Memorandum of Understanding between the City and the Seal
Beach Firefighters Association is indicated in Appendix C, and the Memorandum of
Understanding between the City and the Seal Beach Police Officers Association is
indicated in Appendix D are attached hereto and made a part hereof. Upon adoption
of this resolution the wage schedule, employee benefits and working conditions
contained in Appendixes C and D are effective August 1, 1973, unless otherwise
specified.
Section 4. The provisions of this resolution relating to salary rates
shall become effective as listed in Appendix B.

APPENDIX C
MEMORANDUM OF UNDERSTANDING
THIS MEMORANDUM OF UNDERSTANDING IS BY AND BETWEEN
and
THE MANAGEMENT REPRESENTATIVES OF THE
CITY OF SEAL BEACH, hereinafter referred
to as "Management"
THE SEAL BEACH FIREFIGHTERS ASSOCIATION,
an Association of Firemen, Fire Engineers,
Fire Lieutenants and Fire Captains of the
City of Seal Beach, hereinafter referred
to as "Association."
WHEREAS, Association petitioned City in accordance with provisions of
Ordinance Number 769, and was granted certification as a recognized employee
organization representing all full -time Firemen, Fire Engineers, Fire Lieu-
tenants and Fire Captains of the City; and
WHEREAS, the duly appointed, recognized employee representatives of Associa-
tion and Management representatives representing the City of Seal Beach have
met and conferred in good faith on numerous occasions concerning wages, hours
and terms and conditions of employment in conformance with the terms, conditions
and provisions of Ordinance Number 769 and State Law; and
WHEREAS, Association and the Management representatives have mutually agreed
to recommend to the City Council of the City of Seal Beach all the terms,
conditions, hours and wages pertaining to employment with City for those
employees represented by Association, as set forth in this Memorandum of
Understanding.
Section 1. Management Prerogative Clause.
It is understood that the City retains all of its rights and powers to direct
and control the business of the City to the fullest extent required by law.
It is also understood that the City retains all of its rights and powers to
direct and control the business of the City to the fullest extent permitted
by law except as may be limited by an express provision of this Memorandum of
Understanding. Management and Association agree that replacement of personnel
and their replacement rate is a management prerogative.
Section 2. Effective Date.
This Memorandum of Understanding shall be effective by and between Management
and Association upon execution by Management and the required number of the
duly authorized recognized representatives of Association.
Section 3. Term of Memorandum of Understanding.
This Memorandum of Understanding shall remain in full force and effect until
Midnight, August 1, 1974.
Section 4. Recognition of Prior Memorandum of Understanding.
Its recognized and agreed that a Memorandum of Understanding was executed
by Management and Association, becoming effective August 1, 1972, and terminating
'at Midnight, August 1, 1973, said Memorandum of Understanding remains in full
force and effect until aforementioned termination date. It is further recognized
and agreed that this Memorandum of Understanding shall not modify the afore-
mentioned agreement until the effective date of said Memorandum of Understanding.

Section 5. Group Life Insurance.
(1) Part time, seasonal, provisional and /or hourly employees
and volunteer firemen shall not be eligible for participation
in this program.
(2) Full time Fire Department employees of the City who have
completed sixty (60) days of uninterrupted service shall be
enrolled in this insurance program on the first day of the
next succeeding month.
(3) Fire Department employees who change classification from
full time to part time, provisional, hourly or seasonal shall
not be eligible for this benefit.
(4) City shall not pay premiums for any Fire Department
employee on leave of absence without pay or for any Fire
Department employee who has terminated from City employment for
any reason.
(5) City shall not make any monthly premium payment on behalf
of any Fire Department employee who has been absent without
authorization during said month.
(6) City agrees to provide commencing September 1, 1973, a
group life insurance plan providing life insurance coverage
of $10,000 for each full tine, classified Fire Department
employee, commencing on the 61st day of full time employment.
(7) Any Fire Department employee of City who has not completed
sixty (60) days of service but who is enrolled in any insurance
benefit program listed in this section shall remain in said
program except as provided in this section, or as provided for
in the rules and regulations of the current insurance policies

Section 6. Sick Leave - Effective September 1, 1973 z 0
Upon retirement or honorable termination after tni ) years of service,
an employee shall receive a cash payment for unused accumulated sick leave
at that time based on the following compensation schedule: 1 -30 Shifts - $0;
31 -90 Shifts - 25% not to exceed $500; 90+ Shifts - 50% not to exceed $1000.
Section 7. Stand -By - Effective September 1, 1973
A full time employee of the Fire Department when officially assigned by the
Fire Chief or his designee to stand -by shall be compensated at a rate of
$25 per day for up to three (3) days. No compensation shall be accrued
after the third day.
Section 8. Promotional Examination - Effective September 1, 1973
The City agrees to conduct one promotional examination per year for each
of the classifications of Engineer, Lieutenant and Captain. An eligibility
list shall be maintained for each classification of those employees who
pass the promotional examination. The eligibility list of each classification
to remain open until a new list for each classification is established.
Section 9. Educational Assistance - Effective September 1, 1973
City agrees to provide the following educational assistance to sworn
employees of the Fire Department:
(a) All full time employees of the Seal Beach Fire Department
(except Fire Chief) who attain an A.A. Degree in Fire Science
from an accredited college or 60 units, 21 of which must be in
Fire Science, shall receive a Fifty Dollar ($50.00) monthly
increase in salary, provided he shall have been once a permanent
employee of the Seal Beach Fire Department.

i LV Science, shall receive a Thirty Dollar ($35.00) monthly increase

of the Fire Department.
Section 10. Callback Pay - Effective September 1, 1973
Payment at straight time, guaranteed minimum of two hours pay.
Section 11. Move Up Compensation - Effective September 1, 1973
A full time employee of the Fire Department shall be compensated at the
rate of Two and One -Half Per Cent (21/2Z) above his regular base pay for
services performed in each classification above his regular classification.
Section 12. Salaries and Wages
Management agrees to adjust the monthly salary range of each Fireman Fire
Engineer, Fire Lieutenant and Fire Captain respectively as follows:

A member of the Fire Department in the classification of Fireman who is
certified as a truck operator by passing a qualification test administered
by the Fire Chief shall be compensated at Two and One -Half Per Cent (21/2Z)
above his base salary.
Section 13. Separability
If any provisions of the Memorandum of Understanding, or the application
of such provision to any person or circumstance, shall be held invalid,
the remainder of the Memorandum of Understanding, or the application of
such provision to persons or circumstances other than those as to which it
is held invalid, shall not be affected thereby.

APPENDIX D
MEMORANDUM OF UNDERSTANDING
THIS MEMORANDUM OF UNDERSTANDING IS BY AND BETWEEN
and
THE MANAGEMENT REPRESENTATIVES OF THE
CITY OF SEAL BEACH, hereinafter referred
to as "Management"
THE SEAL BEACH POLICE OFFICERS ASSOCIATION,
an Association of Sworn Police Personnel,
hereinafter referred to as "Association."
WHEREAS, Association petitioned City in accordance with provisions of
Ordinance Number 769 and was granted certification as a recognized employee
organization representing all sworn police department personnel below the
level of Lieutenant in accordance with Government Code Section 3508 which
states that: ". . . the governing body may not prohibit the right of its
employees who are full -time "peace officers" as that term is defined in
Section 817 of the Penal Code, to join or participate in employee organizations
which are composed solely of such peace officers, which conern themselves
solely and exclusively with the wages, hours, working conditions, welfare
programs, and advancement of the academic and vocational training in furtherance
of the police profession, and which are not subordinate to any other organization."
WHEREAS, the duly appointed, recognized employee representatives of Association
and Management representatives representing the City of Seal Beach have met
and conferred in good faith on numerous occasions concerning wages, hours and
terms and conditions of employment in conformance with the terms, conditions
and provisions of Ordinance Number 769 and State Law; and
WHEREAS, Association and the Management representatives have mutually agreed
to recommend to the City Council of the City of Seal Beach all the terms,
conditions, hours and wages pertaining to employment with City for those
employees represented by Association, as set forth in this Memorandum of
Understanding, with the proviso that these negotiations will continue and
cover auxiliary subjects, but shall not affect any section agreed herein.
Section 1. Effective Date.
This Memorandum of Understanding shall be effective by and between Management
and Association upon execution by Management and the required number of the
duly authorized recognized representatives of Association.
Section 2. Term of Memorandum of Understanding.
This Memorandum of Understanding shall remain in full force and effect until
midnight, August 1, 1974.
Section 3. Recognition of Prior Memorandum of Understanding.
It is recognized and agreed that a Memorandum of Understanding was executed
by Management and Association, becoming effective June 23, 1972, and termi-
nating at Midnight, August 1, 1973, and that said Memorandum of Understanding
remains in full force and effect until the aforementioned termination date.
It is further recognized and agreed that this Memorandum of Understanding
shall not modify the aforementioned agreement until on or after Midnight,
August 1, 1973.
Section 4. • Patrol Vehicle Replacement Program
Whenever two or more marked police vehicles attain 55,000 miles by actual
odometer reading, the City will commence replacement of such vehicles. Marked
police vehicles with mileage in excess of 65,000 miles will be placed in the
field only when extenuating circumstances necessitate (i.e.-- vehicles not
available from factory due to strike or shortage).

Section 5. Education Incentive - Effective November 1, 1973
All members completing initial probation will be eligible to participate in
the educational incentive program, if all requirements are met. Steps will
be:
A -45 college units with at least 16 in the police science field
or attainment of a POST Intermediate Certificate.
B -60 college units with at least 19 in the police science field
or attainment of a POST Advanced Certificate.
C - -A Bachelors degree earned with at least 22 units in the police
science field.
A-- $35.00
B-- $50.00 C-- $70.00
Section 6. Uniform Fund - Effective September 1, 1973
The City shall monthly pay the sum of $15.00 to the Seal Beach Police Uniform
Fund for each full -time sworn Seal Beach Police Personnel. Each full -time
sworn Seal Beach Police Personnel shall have the $15.00 monthly allotment
accounted to an individual account within the Fund in a debit - credit manner.
The Fund shall be used only to replace worn out uniforms. Items damaged in
the line of duty shall be replaced by the City when authorized by the Chief
of Police.
Each new sworn employee of the Seal Beach Police Department will be required
to purchase two new uniforms. The City shall reimburse the employee the
total cost of the uniforms upon the employee successfully completing
probation and presenting receipts for the uniforms to City.
Any full -time member of the Seal Beach Police Officers Association who
leaves his employment with the City shall not be entitled to any portion of
the Fund.
Section 7. Insurance Programs - Group Life Insurance
(1) Part time, seasonal, provisional, and /or hourly employees and
reserve police officers shall not be eligible for participation
in this program.
(2) Full -time Police Department employees of the City who have
completed thirty (30) days of uninterrupted service shall be
enrolled in this insurance program on the first day of the next
succeeding month.
(3) Police Department employees who change classification from
full -time to part time, provisional, hourly, or seasonal shall not
be eligible for this benefit.
(4) City shall not pay premiums for any Police Department employee
on leave of absence without pay, or for any Police Department
employee who has terminated from City employment for any reason.
(5) City shall not make any monthly premium payments on behalf
of any Police Department employee who has been absent without
authorization during said month.
(6) City agrees to provide effective September 1, 1973, a group
life insurance plan providing life insurance coverage of Fifteen
Thousand Dollars ($15,000.00) for each full -time employee of the
Seal Beach Police Department represented by the Seal Beach Police
Officers Association, commencing on the sixty -first day of
fullrtime employment. 4/1.

(7) Any Police Department employee of the City who has not
completed sixty (60) days of service, but who is enrolled in any
insurance benefit program listed in this section shall remain in
said program except as provided in this section, or as provided
for in the rules and regulations of the current insurance policies.
Section 8. Policeman II Program
Upon Civil Service Board and City Council approval, the City shall initiate
a Policeman II Program. The job classification of Policeman II shall replace
the job classification of Police Agent. Individuals who are currently
classified as Police Agents will be classified as Policeman II when this
Memorandum of Understanding becomes effective. The position shall be
meritorious in nature.
Individuals who qualify for Policeman II will not be supervisorial personnel,
ranking, nor personnel with additional seniority status. An individual who
qualified for Policeman II status will receive an additional $60.00 per
month above his base salary.
Members who have been certified by the Civil Service Board for the position
of Police Agent shall be classified as Policeman II effective September 1,
1973, however, these members will begin drawing the additional $60.00 as of
October 31, 1973. (Existing list advanced.)
Yearly qualifying tests for the position of Policeman II will be held April 1
of each year. Qualifications for the examination will be the same as those
for the past position of Police Agent. The qualifying test shall be a
recognized police evaluation test, and those members passing with a score of
70% or above will be classified as Policeman II on July 1 of the year in which
they qualified. The qualifying test will be administered by the Personnel
Officer or his designee.
Section 9. Vacation Accrual
Effective August 1, 1973, the levels of vacation accrual for all members of
the Seal Beach Police Officers Association will be increased from current
levels to 170 -210 hours, respectively. The rates of accrual will remain
the same as present rates.
Section 10. Payment of Unused Sick Time
Effective August 1, 1973, upon termination from City employment, any member
of the Seal Beach Police Officers Association with 15 years of service will
be paid 25% of his accumulated sick time at his hourly rate. Payment of
accumulated sick time will not exceed $1,000.00 per member.
Section 11. Payment of Overtime
Effective August 1, 1973, Management agrees to pay paid overtime earned by
members twice each year, in a total sum, at the member's option. Payments
to be made June 1 and December 1. Compensation in the form of Compensatory
Time Off is optional. To participate in this plan, member must notify
the accounting department by a memo from the Chief of Police no less than
thirty (30) days prior to either payment date.
Section 12. Wages and Salaries
The following salary schedule will be in effect August 1, 1973. The payment
for the period of retroactivity will be made on October 1, 1973.

An individual who qualifies for Policeman II status will receive an additional

Section 13. Benefits
City shall not pay on behalf of any Police Department employee the cost of
any fringe or supplemental wage benefits, including, but not limited to,
group life insurance, marksmanship bonus, uniform allowance, and /or
supplemental pay, or the wages or salaries of said employee during any
unauthorized absence or during any period of time such employee is suspended
without pay or on leave of absence without pay. In such instances, however,
employee may make arrangements to pay such costs by authorized payroll
deductions and /or cash payment to City.
Section 14. Separability.
If any provision of the Memorandum of Understanding, or the application of
such provision to any person or circumstance, shall be held invalid, the
remainder of the Memorandum of Understanding, or the application of such
provision to persons or circumstances other than those as to which it is
held invalid, shall not be affected thereby.
Section 15. Previous Agreement
All benefits and working conditions not specifically referred to herein
shall remain in effect.
