A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH ASCERTAINING THE GENERAL PREVAIL-
ING RATE OF PER DIEM WAGES AND TIlE GENERAL PRE-
VAILING RATE FOR HOLIDAY AND OVERTIME WORK TO BE
PAID ON PUBLIC WORKS PROJECTS WITH THE CITY (1973-74)
WHEREAS, the City Council of the City of Seal Beach intends to commence several
public works projects during the fiscal year beginning July 1, 1973 and ending
June 30; 1974; and
WHEREAS, pursuant to the provisions of Section 1773 of the Labor Code of the
State of California, as amended by Chapter 785 of the 1971 Session of the State
Legislature, it is necessary that the City Council of the City of Seal Beach
ascertain and determine the general prevailing rate of per diem wages and the general
prevailing rate for holiday and overtime work in the locality in which public work is
to be performed for each craft, classification or type of workman needed to execute
the public works contract; and
WHEREAS, said City Council has received reports ascertaining said general rate
of per diem wages and for holiday and overtime work established by collective bar-
gaining agreements and such rates as may have been predetermined for federal public
works within the locality and in the nearest labOr]ma ket area; and

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Seal Beach does hereby ascertain
and fix the general prevailing rate of per diem wages and the general prevailing rate
for holiday and overtime work in the locality for each craft, classification or type
of workman needed to execute any public works contract as follows, and in accordance
with the schedule attached hereto and made a part hereof as though set forth in full.
In addition, the City Council does further ascertain and fix the following:
(a) Any classification omitted herein shall be paid not less than $5.045 per
hour.
(b) Per diem wages shall be deemed to include employer payments for health
and welfare, pension, vacations, and similar purposes.
(c) All public works contracts shall include in the specifications a requlre-
ment for the payment of travel and subsistance payments to each workman
needed to execute the work, as such travel and subSistence payments are
defined in any applicable collective bargaining agreement on file with
the Department of Industrial Relations in accordance with the provisions
of Section 1773.8 of the Labor Code.
(d) In accordance with the provIsions of Section 1777.5 of the Labor Code,
properly indentured apprentices may be employed on a public works project,
,I and the provisions of Section 1777.5 shall be complied with by the con-
tractor or any subcontractor.
(e) No qualified employee shall be refused acceptance as an indentured appren-
tice or any employment on any public works project solely on the ground
of race, creed, national origin or ancestry, or religion of any such
employee.
(f) Eight hours labor constitutes a legal day's work in all cases, and the
time of service of any workman employed upon a public works project is
limited and restricted to eight (8) hours during anyone calendar day,
and forty (40) hours during anyone calendar week; except that work in
excess of the foregoing shall be permitted upon compensation for all
hours worked in excess of eight (8) hours per day at not less than one
and one-half (l~) times the basic rate of pay.

(g) The basic rates of pay hereby established are based upon a working day
of eight (8) hours, being proportionately applicable to eight (8) hours
of less employment in anyone calendar day. Holiday, Sunday, and overtime
employment is usually not permitted but if allowed, wages shall be one and
one-half (l~) times the basic per diem rate. Holidays as used herein
include the following seven legal holidays, to wit~ New Year's Day,
Memorial Day, Fourth of 'July, Labor Day, Veteran's Day, Thanksgiving Day,
and Christmas. Where any work is required in case of an extraordinary
emergency caused by fire, flood or danger to life and property, and for
time worked on Sundays and the aforementioned holidays, not less than one
and one-half (l~) times the basic per diem rate shall be paid.
(h) Any contractor to whom a public works" contract is awarded, and any sub-
contractor under him, shall also otherwise comply with the provision of
Part 7 of Division 2 of the Labor Code of the State of California, as the
same are applicable to the foregOing.
SECTION 2. This Resolution, and any amendment thereto, is hereby made a part of
any public works contract to be executed by the City of Seal Beach and shall be included
in the call for bids and in the bid specifications.. In lieu of specifying the pre-
vailing rate of per diem wages in the call for bids, the City Council hereby authorizes
and directs that copies of this Resolution and per diem wages schedule shall be main-
tained on file in the Office "of the City Clerk located in the City Administration
BUilding of the City of Seal Beach, 211 Eighth Street, Seal Beach, California, 90740,
and shall be made available to any interested party on request.' A copy of 'this Reso-
lution and the per diem wage schedule attached shall be incorporated in the public
works contract by reference or otherwise, and a copy of this Resolution and the per
diem wage schedule shall be delivered to the successful contractor or contractors for
posting on the job site. The call for bids shall incorporate this Resolution by reference.
SECTION 3. The City Clerk is authorized and directed to cause a copy of this
Resolution and the per diem wage schedule attached hereto to be posted in the four (4)
spe~fied public,p}aces as provided by Ordinsnce, at least once, on or before

SECTION 4. The per diem rate herein set forth shall be periodically reviewed by
the City Council, and this Reaolution shall be amended from time to time indicating
any change in such general prevailing rate of per diem wage, ~~th the date of adoption
of said Resolution set forth in the title of any amended Resolution. In the event of
any amendment to the per diem prevailing wage rate during the course of the year, the
City Council shall specify the change in the first call for bids made by it hereafter.
SECTION 5. The City Clerk is directed to forward a certified copy of this Reso-
lution with the per diem rate schedule attached hereto, as well aa any suhsequent
amendment of this Resolution, to the State Director of Industrial Relations in accor-
dance with the provisions of Section 1773.3 of the Labor Code of the State of California.

WAGE SCALES FOR TIlE SIX BASIC TRADES
The wage rates listed below are in accordance with the terms of the Southern
California Master Labor Agreement for the Construction Industry and cover the
following counties: Los Angeles, Orange, Riverside, San Bernardino, Imperial,
Ventura, Santa Barbara, San Luis Obispo, Kern, Inyo and Mono.
ADDITIONAL COST ITEMS: For SubSistence Allowance, Transportation and Travel
Time Allowance, Overtime, Appren~ice Program Contributions, Industry and Promotional
Funds, Administra~ive Funds, Cash Bond Deposits, etc., contact the Local Union or
ita District Council having jurisdiction.

maximum of the 200' rate.
Tandem type Equipment-Scrapers, Belly Dumps, etc. (any combination) - $1.00
per hour additional
TEAMSTERS
ALLOCATIONS: ll/1/73 - 35~+ The Union may, at its discretion, upon at least sixty
days written notice prior to November 1, 1973 allocate the increase to any or
all: (1) hourly wage rates, (2) Health & Welfare, (3) Pension, (4) Vacation-
Holiday.

Foreman: When a Contractor employa on his payroll 9 or more Teamsters operating
equipment under the jurisdiction of the Teamsters, excluding any equipment

one Teamster as Craft Foreman and he shall receive 50~, per hour more than the
highest Teamster classification over which he is Foreman.
