RESOLUTION NO. oJ.:J 5"5' A RESOWTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DENYING PLANNING COMMISSION RESOLUTION NO. 764 AND APPROVING APPEAL A-2-73 FILED BY SURFSIDE COLONY, LTD. WHEREAS, in the matter of Appeal Application No. A-2-73, the Planning Commission of the City of Seal Beach did report and find as follows: 1. Original case initiated by Maurice Millard, 4312 Beeman Ave., Studio City. 2. Subject property described as Lot 49, Block B, Surfside. 3. Subject proposal was to construct a garage in excess of IO feet in height on Southern Pacific property in Surfs ide. 4. On August 1, 1973, the Planning Commission considered the matter of Variance V-22-73, and, at the conclusion of the public hearing, found that the proposed garage would not exceed the height of other garages on the Southern Pacific property. WHEREAS, on August I, 1973, the Planning Commission approved Variance V-22-73 by Resolution No. 764; and WHEREAS, Surfside Colony, Ltd. subsequently appealed the Planning CoIllIiIission decision approving Variance V-22-73 to the City Council; and WHEREAS, the matter of the appeal from Planning Commission approval of Variance V-22-73 came before the City Council at its reguiar _eting of August 22, 1973; and WHEREAS, all noticea of public hearing were posted as required by":lawr and' WHEREAS, a public hesring was conducted on August 27, 1973, in which, af~er teat:l.mony was received, the City Council lawfully concluded and closed said public hearing; and WHEREAS, the test:l.mony and Planning Commission findings were found to be true and accurate; and WHEREAS, the matter of the appeal from Planning Commission approval of Variance V-22-73 was referred back to the Planning Commission with the finding that the proposed garage would be higher than other garages in the immediate area if a parapet wall were added to the roof of the proposed garage; and WHEREAS, on September 5, 1973, the Planning Commission considered the City Council findings and found: I. The applicant wished to add a safety railing to the roof of the proposed garage. 2. The proposed garage with railing would be materially higher than other garages in the area. 3. Recommended that the City Council approve the appeal, A-2-73, and deny V-22-73; and WHEREAS, on September 24, 1973, the City Council considered the report from the Planning Commission and concurred. ..
