HomeMy WebLinkAboutCC Res 2294 1974-02-25 I I .- .- . .........( ""\ .- ~'! , ~ RESOLUTION NUMBER ~ ;;. 91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH OPPOSING AB 16 WHICH WOULD REQUIRE, BY STATE MANDATE, THAT CITIES PROVIDE THE 2% AT AGE 50 OR "CALIFORNIA HIGHWAY PATROL" FORMULA RETIREMENT PLAN FOR POLICE OFFICERS. the City of Seal Beach has opposed similar attempts by the State Legislature since 1969 to usurp the basic right of cities to provide salaries and benefits for safety personnel within fiscal boundaries deemed satisfactory by the city; and the mandatory implementation of the "California Highway Patrol" formula, or 2% of final compensation at age 50, without regard for length of service, as prescribed by AB 16, would double the City's cost for retirement contribution; and WHEREAS, the State assistance in the sum of $20 Million initially and $10 Million annually provided for continuing expenses is inadequate; and WHEREAS, WHEREAS, WHEREAS, the imposition of such a program on the Cities of California is contradictory and erosive to the "meet and confer" process as provided by the Myers-Milias-8rown Act wherein the State reaffirmed the right of negotiation for salaries and working conditions at the local level; and WHEREAS, AB 16 would mandate a program without providing adequate funds to implement the program which would necessitate a property tax increase of approximately $.11 per $100 assessed valuation by the City; and WHEREAS, such a tax increase would be in direct conflict and supersede the right of local legislative bodies to decide the degree and propriety of the local tax burden to its citizenry; NOW, THEREFORE, 8E IT RESOLVED that the City Council of the City of Seal Beach opposes adoption of A8 16, and 8E IT FURTHER RESOLVED that the City is firmly opposed to legislatively mandated programs which are insufficiently funded and which conflict with principles and management prerogatives previously reaffirmed by State legislation, and BE IT FURTHER RESOLVED that copies of this resolution be sent to the League of California Cities, Assemblyman Robert H. Burke, State Senators Dennis Carpenter and James Whetmore and the Senate Committee on Public Employment and Retirement, and all cities in Orange County.
