RESOLUTION NUM8ER ~;.< ~i7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, EXPRESSING ITS OPPOSITION TO PU8LIC EMPLOYER-EMPLOYEE RELATIONS LEGISLATION AND SUPPORTING SENATE BILL 522. WHEREAS, the City Council of the City of Seal Beach favors the existing practice of public agency employer-employee relations which allows for meeting and conferring in good faith with recognized employee organizations on matters of wages, hours and working conditions, and supports S.8. 522 which clarifies and makes the meet and confer process more equitable; and WHEREAS, various bills have been introduced in the Legislature, among which are A.B. 33, A.B. 819. A.B. 1112, A.B. 1243 and S.8. 32, which, if enacted, would completely undermine and disrupt public employer-employee relations at the local level; and WHEREAS, said bills would establish a separate labor relations procedure for police and fire employees and would invalidate actions taken by city councils on matters within the scope of representation unless notice is first served on employee representatives and provide that no city might require or request firemen or policemen to work regularly scheduled overtime (non-emergency), unless paid time and one-half or granted compensating time off at the rate of one and one-half hours for every hour of overtime and would require all employees in a particular organization to join that employee organization or union; and WHEREAS, such labor practices may be politically expedient, however, such legislation clearly injects the Legislature into a matter which is supposed to be negotiated between the representatives of local government and the representatives of their employees. For this reason, such practices are totally inconsistent with the fundamental principles of home rule and repre- sentative government and overlook the security afforded the employees by the various types of Civil Service and personnel merit systems and ignores the monopolistic nature of public services and could seriously jeopardize the health, safety and general welfare of the taxpaying public who have a right to rely on municipal services not being interrupted or curtailed; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HERE8Y RESOLVE AS FOLLOWS: Section 1. That the City Council of the City of Seal Beach hereby expresses adamant opposition to any employer-employee relations legislation such as A.B. 33, A.B. 819, A.8. 1112, A.B. 1243 and S.B. 32, that would conflict with the meet and confer process which has proven to be the most equitable method of insuring the highest quality of public employment while, at the same time, preserving and protecting the rights of local citizens and supports the League of California Cities-sponsored, Senate Bill 522. Section 2. The City Clerk is hereby authorized and instructed to transmit certified copies of this Resolution to Senators James Whetmore and Dennis Carpenter, Assemblyman Robert Burke. the League of California Cities, the Assembly Committee on Employment and Public Employees, the Senate Committee on Public Employment and Retirement and all of the Cities in Orange County.
