BARRY K>RGAN FOR EXCELLENCE OF PERFORMANCE OF HIS DUTIES AS CITY TREASURER. EXONERATING HIM OF ALL CHARGES OF MISCONDUCT. AND REPEALING RESOLUTION NUMBER 1921. D. Barry Morgan as City Treasurer of the City of Seal Beach has demonstrated fidelity to the duties of the office of Treasurer. high degree of responsiblity to the taxpayer on guarding against illegal expenditures of public funds and the courage of his conviction to stand steadfast against pressure to make illegal expenditures; and on November 23. 1970. the City Council by a 3 to 2 vote adopted Resolution Number 1921 entitled "A Resolution of theCity Council of the City of Seal Beach Requesting the Orange County Grand Jury to Present an Accusation Against D. Barry Morgan. City Treasurer. Under Government Code Section 3060;" and said Resolution Number 1921 accused D. Barry Morgan of misconduct in the performance of his duties as City Treasurer. and declared that D. Barry Morgan had caused a disruption and breakdown of the regular orderly con- duct of the fiscal affairs of the city; and said Resolution Number 1921 recites the fact that the Interim City Attorney advised D. Barry Morgan that certain payments to one Russell W. Bledsoe would be lawful expenditures of public funds; and thereafter. the Superior Court of the County cf.:Orange. Judge Lester Van Tatenhove presiding. determined and found that said proposed payments to Russell W. Bledsoe would not be lawful expenditures of ppblic funds. and hence denied the petition for writ of mandate brought by the City against D. Barry Morgan; and said decision of the Superior Court of the County of Orange completely vindicated D. Barry Morgan's position and totally rejected the legal opinion of the Interim City Attorney with regard to the legality of the proposed payments; NOW. THEREFORE. BE IT RESOLVED. that the City Council of the City of Seal Beach does hereby commend D. Barry Morgan and full! exonerate and absolve him of all charges and accusations of m sconduct in the performance of his duties as City Treasurer alleged and contained in the aforementioned Resolution Number 1921 of the City Council. adopted on November 23. 1971. Resolution NUmber '. 1 BE IT FURTHER RESOLVED that Resolution Number 1921 entitled "A Resolution of the City Council of the City of Seal Beach Requesting the Orange County Grand Jury to Present an Accusation Against D. Barry Morgan, City Treasurer, Under Government Code Section 3060," and adopted on November 23, 1970, is hereby rescinded in its entirety, and declared to be of no further force or effect. BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Foreman, Orange County Grand Jury. BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to D. Barry Morgan.
