RESOLUTIDrI NmlBER 2003 A RESOLUTION OF THE CITY COUNCIL OF SEAL BEACH, CALIFORNIA, ESTABLISHING A CHARTER REVISION COMMITTEE AND PRESCRIBING THE DUTIES AND POWERS THEREOF. WHEREAS, The Charter of the City of Seal Beach was adopted in 1964, and has not he en amended substantially since its effective date; and the City of Seal Beach has experienced many significant and far reaching changes in its geographical size, population, economic atmosphere, cultural attitudes, and environmental quality in the past seven years; and WHEREAS, WHEREAS, The Charter of the City of Seal Beach as presently constituted, has proven to be awkward, enept; and f.requently ineffective in meetino the severe problems that have confronted the City in recent , years; and WHEREAS, The City Council desires to frame a proposed revised Charter of the City of Seal Beach to place before the electorate for adoption at a municipal election not later than July 1,1972; and the City Council seeks the advice of knowledgeable and intelligent citizens of the City of Seal Beach that are thorouqhly familiar with the problems confrontinq the City and those problems and circumstances that are likely to arise in the future, to aid and advise the City Council in framing said proposed revised Charter; WHEREAS. NOW. THEREFORE, BE IT RESOLVED that the City Council of the City of Seal Beach does hereby create and establish the Charter Revision Advisory Committee to be composed and appointed, and to undertake such powers and duties as are set forth herein: Section 1. Purpose The purpose of the Charter Revision Advisory Committee shall be to review, study, and investigate the City Charter as presently adopted and in effect with regard to its relevancy and effectiveness in meeting the problems, needs, and aspirations of the people of the City of Seal Beach; to thereafter present to the City Council a proposed revised City Charter, or proposed amendment to the existinq City Charter, which in the opinion of the majority of the members of the Charter 'i ., c I 1 1 Resolution' Numoer . ~ . ~ Revision Advisory Committee, and if adopted by the electorate. would best serve the City in all aspects of its existence as a municipality, and thereby allow the City to best serve its citizenry. Said proposed revised City Charter or proposed amendment to the existinp City Charter shall be presented to the City Council not later than December 1, 1971. Section 2. Termination The Charter Revision Advisory Committee shall terminate and cease to exist 30 days after the date of presentation of said proposed revised City Charter or proposed amendment to the existing City Charter to the City Council in compliance with Section 1 above. However, during said 30 day period, the City Council may order by resolution the extension of the term and existence of the Charter Revision Advisory Committee for any perio~ beyond said 30 days as the City Council deems necessa~y. Section 3. Composition and Appointment of Members The Charter Revision Advisory Committee shall consist of tern members, each appointed by motion of the City Council adopted by at least three affirmative votes. Each member shall be a qualified elector of the City and there shall be no more than two members from and residing in each Councilmanic District of the City. No member shall hold any office or employment in the City government. All members shall serve until the termination of the existence of the Charter Revision Advisory Committee pursuant to Section 2 above. Should a vacancy occur for any reason, said vacancy shall be filled b y appointment of a successor by the City Council in conformance with the requirements of appointment for oriqinal members set forth herein. Section 4. Presidino Office; Meetinos; uorum; Re uired Vote; Ru es of race ure; ecords The Charter Revision Advisory Committee shall, as soon as practicable, elect one of its members to serve as presiding officer at the pleasure of the Charter Revision Advisory Committee. The Committee shall likewise elect one of its members to serve as presiding officer pro tempore (vice Chairman) at the pleasure of the Committee. ." 'Resolution Number .' ., '.' .. I The Committee shall hold regular monthly meetings on the third Tuesday of each month in the City Council Chambers which shall be open to the public, and may adjourn or readjourn any regular meeting to a date and hour certain which shall be specified in the order of adjournment; when so adjourned such adjourned meeting shall be a regular meeting for all purposes. If at any time any regular meetings fall on a holiday such regular meeting shall be held on the next business day. A majority of the members of the Charter Revision Advisory Committee shall constitute a quorum to do business, but a less number may adjourn from time to time, in the absence of all the members of the Committee from any regular meeting; the secretary may declare the same adjourned to a stated day and hour. 1 Special meetings may he called at any time by presiding officer of the Committee, or by three members of the Charter Revision Advisory Committee; by written notice delivered personally, or by mail, or by the secretary to each member of the Committee at least twenty-four hours before the time specified for the proposed meeting, provided that a special meeting may be also validly held without the giving of such written notice if all members shall give their consent in writing, and such consent is on file in the office of the Committee's secretary, prior to the time set for said special meeting. The Committee shall adopt rules for the transaction of business consistent with the City Charter and subject to approval of the City Council. The secretary shall keep a record of the Committee's rules of business, findinQs, and determinations. which record shall be a public record. Section' 5. .Removal of Members; Vacation of Office Member; Compensation Any member of the Charter Revision Adviso~y Committee shall be subject to removal by motion of the City Council adopted by at least three affirmative votes. The office of any member of the Charter Revision Advisory Committee shall be vacated if such member absents himself from three regular meetings of the Comittee, unless by permission of the Committee, or if he is convicted of a crime involving moral turpitude, or ceases to be an elector of the City. .1 PASSED, APPROVED, ADOPTED by the City Council of the City of Seal~ach, C or ia, at a regular meeting thereof held on the 4/ day of 1971, by the following vote: /, YLL L~rletehf . tT er t/ .
