BRAITSCH/HOWARD SMITH FROM PLANNING COMMISSION DENIAL OF VARIANCE (V-9-11) TO PERMIT THE CONSTRUCTION OF APARTMEH'l' UNITS WITH LESS THAN THE REQUIRED NUMBER OF ON-SITE PARKING SPACES AND UTILIZING AN EXISTING FRONT CURB CUT. WHEREAS, in the matter of Variance Application No. V-9-11, the Planning Commission of the Cit;y of SeaJ. Beach, after conducting a public hearing thereon Mq 19, 1911, did report and find as follows: 1. Subject request was initiated by' Howard Smith, 6132 Nixon Ave., Lakewood, the authorized agent :for J. R. Braitsch, 344 Ocean Ave., SeaJ. Beach. 2. Subject propert;y is described as Lot 23, Block 5, B~ Cit;y Tract, and is more commonly known as 123 6th St. 3. Subject request is to permit construction of a three unit apartment with four (4) on-site parking spaces in lieu of the five required by' Code and utiliZing an existing frOnt curb cut to provide access for two of the parking spaces. 4. In 1969, the Planning COIDIIIission had approved plans for the construction of the three unit development. 5. Since that approval the polic;y of permitting :front curb cuts to provide access to on-site parking has been modified and the number of on-site parking spaces per unit increased. 6. The Building Permit which was issued for the construction of the apartments expired and was not renewable af'ter mid-summer of 1970. 1. The applicant is submittihg a new application which is subject to aJ.l existing zoning ordinance proviSions. 8. It was :felt that the applicant failed to prove s.oy hardship because of unusual circumstances and that the granting of such a variance would constitute the granting of a speciaJ. privilege. 9. Several members of the audience objected to the proposaJ. and a written communication opposing the development was received. WHEREAS, the Planning Commission of the Cit;y of SeaJ. Beach did on Mq 19, 1911, den:r Variance Application No. V-9-71; and WHEREAS, the applicants, J. R. Brai tsch/ Howard Smith, appealed the Planning Commission deniaJ. of Variance Application No. V-9-11 to the Cit;y Council; and WHEREAS, at a regularly scheduled meeting held on June 21, 1911, the Cit;y Council held.and lawfully concluded and closed a public hearing on Appeal No. A-3-71 by' J. R. Braitsch/Howard Smith :fr0lll the Planning Commission deniaJ.. NOW, THEREFORE, BE IT RESOLVED by' the Cit;y Council of the Cit;y of Seal Beach as follows: (1) All notices required by' law and by' ordinance of the appeal and public hearing by' the Cit;y Council upon this matter have been given. posted and mailed as required by' law; and AGENDA ITEM # VII C \
