HomeMy WebLinkAboutCC Ord 594 1961-09-05 I' I I - c . . ~ , , J . \0 CITY OF SEAL BEACH ORANGE COUNTY, CALIFORNIA ORDINANCE NO. 594 AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING ORDINANCE NO. 578, ENTITLED "AN ORDINANCE OF THE CITY OF SEAL BEACH ADOPTING REGULA- TIONS TO CONTRGL THE OPERATIONS OF BOATS OPERATED ON WATER WITHIN ITS TERRITORIAL LIMITS". THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: SECTION 1: Section 1 of Ordinance No. 578 is hereby amended to read as follows: of the area. a boat SECTION l. (b) A boat engaged in rescue or salvage operations. (c) A boat operating under the control of or owned by a governmental agency while in the course of official duty. SECTION 2. Section 2 of Ordinance No. 578 is hereby amended to read as follows: SECTION 2. It is unlawful for any person in command of a boat to allow said boat to drift closer than 200 yards of a beach within the City of Seal Beach, except: (a) When such drifting results from conditions beyond the operators control. SECTION 3. Section 4 of Ordinance No. 578 is hereby amended to read as follows: SECTION 4. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of & misdemeanor and upon conviction thereof shall be punished by a fine of not more than $500.00 or be imprisoned in jail for not more than 180 days or by both such fine and imprisonment. SECTION 4. SEVERABILITY If any section, subsection, sentence, clause, phrase, or portion of this ordinance, or the application thereof to any person, firm, corporation, or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Seal Beach hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or uncon- stitutional. ' SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect thirty days after its adoption, shall be certified as to its adoption by the City Clerk~ and shall be published in the SEAL BEACH POST & WAVE " ~~ ..
