A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH AFFIRMING PLANNING COMMISSION
RESOLUTION NO. 586 AND DENYING THE APPEAL OF
ADELINE FECHTER/KAY HILLMAN FROM PLANNING
COMMISSION DENIAL OF CP-1-7l TO ALLOW ON-SALE
BEER AND WINE SALES IN CONJUNCTION WITH A
RESTAURANT IN THE C-2 ZONE.
WHEREAS. in the matter of Conditional Use Permit Application No. CP-1-71, the
Planning Commission of the City of Seal Beach. after conducting a public hearing
therefore on November 3. 1971, did report and find as follows:
1. Subject request initiated by Adeline Fechter, 5155 Cribari Knolls, San
Jose, with Kay Hillman, proprietor of the existing restaurant. acting as
authorized agent.
2. Subject property is legally described as Lots 1 and 2, Block 9. Bs;y City
Tract, otherwise known as 901 Ocean Avenue.
3. Subject proposal is for a Conditional Use Permit to allow on-sale beer and
wine sales in conjunction with a restaurant in the C-2 Zone.
4. Applicant has presented plans for remodeling and landscaping of the existing
restaurant. Remodeling for the existing facility was completed in April.
1970. but landscaping was never installed.
5.
Proposed dual use of a restaurant with beer and wine sales and walk-up
window~ervice oriented to youthful clientele constitutes a significant
increase in intensity of use and is not acceptable on a parcel of this size.
6. A communication was received from the Chief of Police indicating that
issuance of the permit would create a difficult law enforcement problem.
7. Subject property is directly across the street from two parks, less than 75
yards from a children's playground, and 150 feet from residentially zoned
property.
8. The proposal w;iJ.l"be detrimental to the peace. morals and general welfare
of persons residing in the neighborhood.
WHEREAS, the Planning Commission of the City of Seal Beach on November 3, 1971.
did deny Conditional Use Permit Application No. CP-1-71, and
WHEREAS, the City Council of the City of Seal Beach conducted and lawfully
concluded and closed a public hearing at their regular meeting held on November
22, 1971. concerning the appeal by Adeline Fechter/Kay HillJlls.n from the Planning
Commission denial of Conditional Use Permit Application CP-1-71.
NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Seal Beach
as follows:
1. All notices required by law and by ordinance of the appeal and public
hearing by the City Council upon this matter have been given. posted
and mailed as required by law, and
2. Each finding heretofore made by the Planning Commission is found to be true
8Ild correct and each such finding was and is supported by substantial evidence.
3. The appeal of Adeline FeChter/Kay Hillman from the Seal Beach Planning
Commission Resolution No. 586 is denied, and the action of the Seal Beach
Planning Commission adopting its Resolution No. 586 is affirmed.
