RESOLUTION NO. d DS{ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AFFIRMING PLANNING COMMISSION RESOLUTION NO. 567 AND DENYING APPEAL APPLICATION NO. A-5-7l FILED BY CHARLES LEDBETTER FROM PLANNIlfG COMMISSION DENIAL OF VARIANCE APPLICATION NO. V-1B-'{I TO PERMIT A STRUCTURAL ENCROACHMENT TO EXTEND INTO A PORTION OF TIlE REAR YARD SETBACK. WHEREAS, in the matter of Variance Application No. v-1B-71. the Plannin/; Commission of the City of Seal Beach. after conducting a public hearing therefore ell September 15, 1971, did report and find as follows: 1. Subject case was initiated by Charles Ledbetter, 644 Island View Drive. Seal Beach. 2. Subject property is legally described as Lot 216. Tract 2590; more (,,'I'llllOnly known as 644 Island View Drive. 3. Subject proposes a 3 foot encroachment for an enclosed patio into LIl" ten foot rear yard setback. The proposal would cause the 40% maximum h'L coverage provision to be exceeded for the R-l Zone in District II. 4. In 1967, the applicant was granted a variance to permit a family ro:;,,: ~o be constructed'wnich encroached into a portion of the rear yard sctll",Cli:. 5. In 1971. a patio addition was constructed at the rear of the existll,': dwelling. to one side of the family room addition. This patio encrc,,,,'hed 3 feet into a portion of the rear yard setback. 6. The average width of the rear yard has been reduced to approximateJ:.- ':"6". 7. After construction of the patio. the applicant requested variance consideration for the patio addition. 8. One written communication was received favoring the proposal and du:';rcg the hearing two residents spoke in opposition to the request. 9. It was concluded. that the , grounds for hardship were not sufficient La, , warrant the granting of the variance. WHEREAS. the Planning Commission of the City of Seal Beach on Septembe r ~), 1971, did deny Variance Application No. V-18-7l; and WHEREAS. the City Council of the City of Seal Beach conducted and lawfu: ly concluded and closed a public hearing at their regular meeting held on l)('tober 11. 1971. concerning the Appeal Application No. A-5-71 filed by Charles Ledbetter from the Planning Commission denial of Variance Application No. V-1B-7l; and WHEREAS, at said hearing Mrs. Shirley Pierson and Mr. Hadley Killough Si o<<e against the appeal, and Mr. Carl Irwin. Mr. Bjorn and Mr. Stan Hartford :;poke in favor of granting the appeal; and WHEREAS. at said hearing. the applicant. BE IT RESOLVED by the City Council of the City of Seal '!"uch as follows: 1. All notices required by law and by ordinance of the appeal and pubJ Ie hearing by the City Council upon this matter have been given, post.ell and mailed as required by law, and 2. Each finding heretofore made by the Planning Commission is found to :,,, true and correct and each such finding was and is supported by subs h:ltial evidence'. 3. The appeal of Charles Ledbetter from the Seal Beach Planning Commisni0n Resolution No. 567 is denied. and the action of the Seal Beach Planning Commission adopting its Resolution No. 567 is affirmed. PASSED. APPROVED and ADOPTED by the City Council of the City of Seal Beacll; California, at a meeting thereof held on the /."J /-lday of n/}i,.,~;."
