A-8-71 FILED BY DONALD MILEK FROM PLANNING COMMISSION DENIAL OF VARIANCE NO. v-26-71 TO PERMIT A FAMILY ROOM ADDITION AT THE REAR OF A SINGLE FAMILY RESIDENCE WHICH WOULD CAUSE ZONE LOT COVERAGE TO EXCEED MAXIMUM ALLOWABLE . WHEREAS, in the matter of Variance Application No. v-26-7l, the Planning Commission of the City of Seal Beach. after conducting a public hearing therefore on October 20, 1971. did rep~rt 'and find as follow,s:.",. 1. Subject case was initiated by Hall &: Hill Construction Co.. 1401 E. 28th St.. Signal Hill. the authorized agents for Don t4ilek, 4809 Hazelnut Ave., Seal Beach. 2. Subject property is legally described as Lot' 147. Tract 5961, and is more commonly known as 4809 Hazelnut Avenue. 3. Subject requests a variance to permit construction of a family room at the rear of a single family residence which would cause the lot coverage provisions for the'R-l Zone, District II, to be exceeded by approximately 5%. ' 4. The proposed 14 I x 22 I family room add! tion would increase lot coverage from approximately 40% to about 45%. 5. Alternative methods of providing additional living quarters while still conforming to the Code provisions were discussed. but it was the applicant's opinion that a second story addition would not be economiCally feasible. 6. The applicant 's immediate neighbors were present at the meeting and had no objection to his proposal. 7. No protests, written or orBJ., were received. 8. The applicant failed to demonstrate hardship due to the size. shape. topography, location or surroundings of the property. WHEREAS, the Planning COllllllission of the City of Seal Beach on October 20. 1971. did deny 'Variance Application No. v-26-7l; and WHEREAS,'the City Council of the City of Seal Beach did open a public hearing on November 22. 1971, to consider Appeal Application No. A-8-7l and on the basis of introduction of new information regarding lot coverage in College Park East did continue said hearing to December 27, 1971; and WHEREAS, on December 27, 1971. the City Council of the City of Seal Beach continued and closed the public hearing on Appeal No. A-8-7l filed by Donald Milek from the Planning Commission denial of Variance No. v-26-71. NOW, TIIEREFORE. BE IT RESOLVED by the City Council of the City of Seal Beach as follows: 1. All notices required by law and by ordinance of the appeal and public hearing by the City Council upon this matter have been given. posted and mailed as required by law, and 2. Each finding heretofore made by the Planning Commission is found to be true and correct and each such finding was and is supported by substantial evidence. 1 I I .' "" , r ." ....
