A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA, PROTESTING THE ACTION OF
THE DISTRICT ATTORNEY OF ORANGE COUNTY, AND
REQUESTING THE ATTORNEY GENERAL OF CALIFORNIA TO
INVESTIGATE THE MATTER OF ALLEGED ILLEGAL ACTS
IN CONNECTION WITH CONSTRUCTION IN COLLEGE PARK
EAST, A SUBDIVISION OF SEAL BEACH, CALIFORNIA.
WHEREAS, The S & S Construction company has built approximately
360 homes in College Park East, a subdivision of Seal Beach,
which are illegal under Seal Beach Ordinance Number 628, dated
June 28, 19631 and
WHEREAS, It is the opinion of the City Council that these acts
may have been knowingly and wilfully committed1 and
WHEREAS, This Council at their regular meeting on January lO, 1972,
did order the city Manager and the city Attorney to present the
facts to the District AttorneY1 and
WHEREAS, The City Manager, Dennis Courtemarche, and the Deputy City
Attorney, Frederic Keeler, did on January 13, 1972, present the
,facts to the District AttorneY1 and
WHEREAS, The District Attorney did, on February 3, 1972, by letter,
notify this Council that they were declining to take any action in
the matter due to the fact that the laws which were violated were
laws of Seal Beach and not of the State of California1 and
WHEREAS, It is the opinion of this council that the District
Attorney has the duty of protecting the rights of all of the
people in the CountY1 and
WHEREAS, The purchasers of these homes now find that they own
homes which are illegal and they stand to lose money because of
this1
NOW, THEREFORE, BE IT RESOLVED that this Council now goes on record
as asking the Attorney General of California to investigate this
matter, first, for the protection of the innocent purchasers of
homes in this subdivision 1 and second, investigate the refusal of
the District Attorney to do his duty.
BE IT FURTHER RESOLVED that the City Manager and the city Attorney
are hereby directed to furnish all of the facts to any person
appointed by the Attorney General to investigate this matter, and
to send copies of this Resolution to the Division of Real Estate
and to the Contractors License Board of the State of California.
PASSED, APPROVED, AND ADOPTED by the City Council of the city of
Seal Beach, California, at a meeting thereof held on the l4th day
of February, 1972, by the following vote: J #
