AN ORDINANCE OF THE CITY OF SEAl, BEACH ADOPTING REGULATIONS TO CONTROL THE OPERATIONS OF BOATS OPERATED ON WATER WITHIN ITS TERRITORIAL LIMITS. 6 WHEREAS, the State of California Harbors and Navigation 7 Code, Chapter 5, Section 660, authorizes the adoption of local law 8 relating to the operation of vessels, the City Council of the City 9 of Seal Beach does ordain as follows: Section l: All areas of the Pacific Ocean within 200 12 yards of the beach within the City of Seal Beach is designated as 13 a swimming area1 it is hereby declared to be unlawful for any 14 person to operate a power boat within such swimming area, except: 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (al For the purpose of entering or leaving a channel at which time the speed of such boat shall not exceed 5 miles per hour. (bl Any boat engaged in rescue or salvage operations. (c) Any boat operating under the control of or owned by a governmental agency while in the course of official duty. Section 2: It is unlawful for any person in command of a power boat to allow said boat to drift closer than 200 yards 29 of a beach within the City of Seal Beach, except: 30 31 32 (al When such drifting results from conditions beyond the operator's control. 1. . ~ . - 1 2 I 3 4 5 6 7 8 9 10 11 12 13 14 I 15 16 17 18 19 20 21 22 23 24 25 26 I 27 28 29 30 31 32 Ordinance Number '" , , ' section 3: There shall be established a seal Beach Po~ice Marine Patrol charged with the enforcement of Federal and state laws for the preservation of public safety and the provisions of this ordinance within the territorial waters of the city of Seal Beach. Section 4: Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $250.00 or be imprisoned in jail for not more than 30 days or by both such fine and imprisonment. section 5: The city Council of the city of Seal Beach does hereby find, determine and declare this to be an emergency measure, the immediate adoption of which is necessary for the preservation of the public peace, health, safety and welfare, and the facts constituting its urgency are as follows: due to the increased number of power boats frequenting the in-shore water area adjacent to Seal Beach and the high percentage of boats requiring assistance as a result of drifting into the breaker line and/or endangering bathers, this ordinance, being one for the preservation of the public peace, morals, health, safety and welfare, shall take effect immediately upon its adoption. Section 6: The city Clerk shall certify to the passage and adoption of this ordinance by a four-fifths majority of the Council and shall cause the same to be printed and published once in the SEAL BEACH POST & WAVE, a newspaper of general circulation in the City of Seal Beach.
