A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH OPPOSING THE PASSAGE OF SENATE BILL
NUMBER 859 INTRODUCED BY SENATOR WILLIAM COOMBS
REGARDING FREEWAY LOCATIONS AND AGREEMENTS.
WHEREAS, Senate Bill Number 859, introduced by Senator William
coombs, would under certain circumstances, authorize the Department
of Public Works to construct a state freeway through a city and to
acquire right of way therein for the freeway even though the city
had not executed a street and freeway closing agreement with the
department: and
WHEREAS, Although Senate Bill Number 859 as written does not apply
to the City of Seal Beach, the city Council of the City of Seal Beach
finds that the passage of such a bill would set an undesirable pre-
cedent in that it could, at a later date, be made applicable to all
cities within the State: and
WHEREAS, Senate Bill Number 859 would further encroach on the
rights of cities by placing authority with a state agency possibly
not responsive to their needs: and
WHEREAS, The City Council of the City of Seal Beach is opposed to
any legislation which would hinder its efforts to solve the problem
of the coastal freeway in the Orange County area:
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Seal Beach does voice strong opposition to Senate Bill Number 859
introduced by Senator William Coombs:
BE IT FURTHER RESOLVED that the city Clerk is hereby authorized and
directed to transmit a certified copy of this resolution to
Senator William coombs, Assemblyman Robert E; Badham, Senator Dennis
Carpenter, members of the Assembly Transportation Committee, members
of the Senate Transportation Committee, the Assembly Ways and Means
Committee, the commission on California State Government Organization
and Economy ("Little Hoover" Commission), the State Highway Commis-
sion, the State Department of Public Works, the Orange County Road
Commissioner, the Orange county Board of Supervisors, and the city
councils of the cities of Laguna Beach, Newport Beach, Huntington
Beach, and San Juan Capistrano.
PASSED, APPROVED, AND ADOPTED by the City Council of the city of
Beach at a meeting thereof held on the 22nd day of May, 1972, by
following vote:
