OF SEAL BEACH AFFIRMING PLANNING COMMISSION
RESOLUTION NO. 630 AND DENYING APPEAL A'-3-72

WHEREAS, in the matter of Appeal Application No. A-3-72, the Plannill8 Commission
of the City of Seal Beach did report and find as follows:
1. SUbJect case initiated by Dr. J. R. Braitsch, 344 Ocean Ave., Seal Beach, with
Howard I. Smith, Lakewood, as the authorized representative.
2. SubJect property described as Lot 23, Block 5, Bq City Tract, commonly
kDown as 123 6th St.
3. SUbJect proposal is to construct two, three-bedroam units with tandem parking.
4. Public hearill8 was opened on April 19, 1972. Plans were incamplete because
no front or side elevations were provided. Hearing continued until May 3,
1972, to permit the applicant to prepare and present the requested elevations.
5. Hearill8 reconvened on May 3, 1972. Neither applicant nor his representative
were present. Artist's rendering of elevation was provided which was
inadequate for Planning Commission determination.
6. The City of SeBl Beach is in the process of condemnation procedures for
the existing partial construction at the site.
WHEREAS, on May 3, 1972, the PJ.anning Commission or the City of SeBl Beach did
de~ Variance v-14-72 on the basis that the applicant failed to provide adequate
plans; and
WHEREAS, the applicant subsequently appealed the Plannill8 Commission's decision
to the City Council; alid
WHEREAS, the matter of the appeBl f'ram the Planning Commission's denial of Variance
v-14-72 came before the City Council for public hearing at its regular meeting of
June 12, 1972, and a1'ter receiving testimo~, and with neither the applicant nor
his authorized Bgent in attendance at the meeting, the City Counclllawf'ully
concluded and closed said public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seal Beach as
follows:
1. All notices required by law and by ordinance of the appeal and public hearill8
by the City Council upon this matter have been given, posted or mailed as
required by law, and
2. Each finding heretofore made by the Planning Commission is true and each such
findill8 was and is supported by substantial evidence, and
3. The appeBl of J. R. Braitsch/Howard Smith f'ram the Seal Beach Planning
Commission Resolution No. 630 is denied, and the action of the Seal Beach
Planning COIIIDIission adopting its Resolution No. 630 is affirmed.
