RESOLUTION NO. o?/.12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, RESCINDING RESOLUTION NO. 2118 AND ESTABLISHING "SEAL BEACH UNDERGROUND UTILITY DISTRICT NO.2." ~he City Council of the City of Seal Beach, California, a charter city, hereby resolves as follows: WHEREAS, on April 24, 1972, a public hearing was called by the City Council of the City of Seal Beach for May 8, 1972, and May 22, 1972, at the hour of 8:00 p.m., in the Council Chambers in the City Administration Building, Seal Beach, California, to ascertain whether the public necessity, 11ealth, safety, or welfare requires the removal of poles, overhead wires, and associated overhead structures and the under- ground installation of wires and facilities for supplying ele~tric, communication, or similar or associated service in the Seal Beach Underground Utility District No.2, being th~t par~el of land described as follows: Beginning at the intersection of the southeast right-of-way line of First Street, and the northeast right-of-way line of Pacific Coast Highway; thence southeasterly along said northeast right-of-way line of Pacific Coast Highway to the north property line of Lot 384, Tract No. 1817; thence easterly along said north property line of said lot extending to the souwest right-of-way line of Bolsa Avenue; thence southwesterly along the northeast right-of-way line to Pacific Coast Highway; thence southeasterly along the northeast right-of-way line of Pacific Coast Highway to the intersection with the northeast right-of-way line of Balboa Drive; thence southwesterly along said right-of-way line extended of Balboa Drive to the southwesteright-of- way line of Pacific Coast Highway; thence westerly/northwesterly along said right-of-way line of Pacific Coast Highway to the intersection with the southeast right-of-way line of First Street; thence north- easterly along said right~6f-way line of First Street to the point of beginning. WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities coneerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, TlIEREFORE, be it resolved that the City Col,ineil of the City of Seal Beach herepy finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service to eliminate an unusually heavy concentration of overhead distribution facilities in the Seal Beach Underground Utility District No.2, being those parcels of land described as follows: Begtnn'ng at the intersection of the southeast right-of-way line of First Street and the northeast right-of-way line of Pacific Coast Highway; thence southeasterly along said northeast right-of-way line of Pacific Coast Highway to the north property line of Lot 384, Tract No. 1817; thence easterly along said north property line of said lot extending to the southwest right-of-way line of Balsa Avenue; thence southwesterly along said right-of-way line to Pacific Coast Highway; thence southeasterly along the northeast right-of-way line of Pacific Coast Highway to the intersection with the northeast right-of-way line of Balboa Drive; thence southwesterly along said right-of-way line extended of Balboa Drive to the southwest right-of-way line of Pacific Coast Highway; thence westerly/northerly along said right-of-way line of Pacific Coast Highway to the intersection with the southeast right- of-way line of First Street; thence northeasterly along said right-of- way line of First Street to the po~nt of beginning. Resolution Number " .. ~ ..,. .... -........~ ...... ,. . , BE IT FURTHER RESOLVED that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said under- ground utility district within the following times: I a. Underground installation by utility companies and property owners and reconnections not later than September I, 1973. b. Removal of poles, overhead wires and other associated overhead structures not later than September 1, 1973. BE IT FURTHER RESOLVED that poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts are excepted from this resolution. AND BE IT FURTHER RESOLVED that Resolution No. 2118 is hereby rescinded in its entirety.
