A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH AFFIRMING PLANNING COMMISSION RESO-
LUTION NO. 694 AND DENYING APPEAL, A-6-72 FILED
BY STEVE H.A. MANLEY FROM PLANNING COMMISSION
DENIED OF VARIANCE, V-49-72 TO PERMIT TANDEM
PARKING AND A REAR YARD OF LESS THAN THE MIN-
IMUM ALLOWED FOR A PROPOSED DUPLEX.
WHEREAS, in the matter of appeal application No. A-6-72,
the Planning Commission of Seal Beach did report and find as follows:
1. Subject case initiated by Steve Manley,
4302 Pickwick Circle, Huntington Beach.
2. Subject property described as Lot 25, Block 11,
Bay City Tract, and more commonly known as
125 - 12th Street.
3. Subject proposal is to construct a duplex in the
R-3 zone with tandem parking and less than the
required rear yard setback.
4. Public hearing was held before the Planning
Commission on October 18, 1972.
5. Applicant or representative was not present.
6. No hardship was shown which would require a
rear yard of less than required minimum.
WHEREAS, on October 18, 1972 the Planning Commission by
Resolution No. 694 did deny Variance V-49-72 on the basis that the
applicant failed to demonstrate hardship for a rear yard of less
than the minimum required; and
WHEREAS, the applicant subsequently appealed the Planning
Commission's decision to the City Council; and
WHEREAS, the matter of the appeal from the Planning
Commission's denial of V-49-72 came before the City Council for
Public Hearing at its regular meeting of November 13, 1972, and
after receiving testimony, and with neither the applicant nor
his authorized agent in attendance at the meeting, the City Council
lawfully concluded and closed, said public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Seal Beach as follows:
1. All notices required by law and by ordinance
of the appeal and public hearing by the City
Council upon this matter have been given,
posted or mailed as required by law; and
, .
2. Each finding heretofore made by the Planning
Commission is true and each such finding was
and is supported by substantial evidence; and
3. The appeal of Steve H.A. Manley from the Seal
Beach Planning Commission Resolution No. 694
is denied, and the action of the Seal Beach
Planning Commission adopting its Resolution
No. 694 is affirmed. '
