CITY OF SEAL BEACH SPECIAL MUNICIPAL ELECTION
ORDINANCE NO. 559
AN ORDINANCE ENACTED BY THE PEOPLE OF
THE CITY OF SEAL BEACH CREATING THE CITY
MANAGER FORM OF GOVERNMENT IN THE CITY
AND DEFINING THE RESPONSffiIIJTY, AUTHORITY
AND DUTIES OF SAID OFFICE.

The people of the City of Seal Beach do hereby ordain as follows:
SECTION 1: The office of City Manager of the City of Seal
Beach is hereby created and established. The City Manager shall be
awointed by tlie City Council solely on the basis of his administrative
ana executive qualifications and abilities; and shall hold office at
and during the pleasure of the Council.
SECTION 2: EIJGIBILITY. Residence In the City of Seal
Beach at the time of appointment shall not be required as a condition
of appointment, but within one hundred eighty (180) days thereafter
the City Manager must become a resident Of the City or the City
Council shall declare the office to be vacant. No person elected to
membership in the City Council shall, subsequent to such election.
be elil!ible for appointment as City Manager until one year has
elapsro after completion of his term of office. -
SECTION 3: UNCLASSIFIED STATUS. The JIOSition of City
Manager shall be In the unclassified service of the City and he shall
not be covered by Civil Service provisions.
SECTION 4: BOND. The City Manager shall furnish a cor-
porate surety bond to be approved by the City Council in such sum
as may be determined by saia Council. The bond shall be conditioned
upon the faithful performance of the duties imposed upon the City
Manager as herein prescribed. The premium for such bOnd shall be
a proper charge against the City.
SECTION 5: ABSENCE. The City Manager shall designate,
subject to the approval of the City Council, an officer or department
head of the City to perform the duties of City Manager during his
temporary absence or disability, said person to be called City Manager
Protempore. In case of the abSence or disability of the City Manager
and his failure to so designate a City Manager Protempore, the City
Council may so designate an officer or department head. In either
event, said person shall furnish a corporate surety bond as set forth
In the preceding section.
SECTION 6: COMPENSATION. The City Manager shall re-
ceive such regular monthly compensation ahd expense allowance as
the City Council shall from time to time determine and fix by resolu-

tion. He shall also be reimbursed for all sums necessarily Incurred
or paid by him In the performance of his duties or incurred when
traveling on business pertaining to the City under direction of the
City Council.
SECTION 7: POWERS AND DUTIES. The City Manager shall
be the administrative head of the City Government under the direction
and control of the City Council, except as otherwise provided herein.
He shall be responsible for the efficient administration of all of the
affairs of the City within his jurisdiction. In addition to his general
administrative responsibility and authority, and not as a limitation
thereon, it shall be his duty and he shall have the power to perform
or cause to be performed the following functions:
A. To enforce all laws and ordinances of the City and to see
that all franchises, permits and privileges granted by the
City are faithfully oDserved.
B. To exercise administrative control over all departments, divi-
sions and employees of the City Government except the City
Attorney, City Clerk and City Treasurer, In those specific
functions provided by State law.
C. To appoint" promote, discipline and remove employees of
the City, except the City Attorney, City Clerk and City
Treasurer, subject to the rules and regulations of the Civfl
Service Commission.
D. To organize or reorganize such officets, positions, depart-
ments or units undet his direction as may be indicated In
the Interest of efficient, effective and economical conduct
of the City's business.
E. To attend all meetings of the City Council unless excused
therefrom by the City Council.
F. To Iecommend to the City Council for adoption such mea-
sures and ordinances as he deems necessary or expedient.
G. To serve as Finance Officer and to keep the City Council
fully advised as to the financial conditions and needs of the
City; the City Manager shall be the Ditector of Finance of
the City.
H. TO'lrepare and submit to the City Council the annual budget
an be Iesponsible for its administration after adoption DY
the Council.
I. To recommend a comprehensive salary plan for all City
employees and to recommend changes in line with current
conditions. .
J. To organize for and supervise the purchase of all supplies
for all departments or divisions of the City. No expenilIture
shall be submitted or recommended to the City Council
except on report and approval of the City Managet.
K. To make Investigations Into the affairs of the City and any
department or division thereof, and any contract, and the
proper performance of any obligation of or t? the City.
L. To investigate all complaints In relation to matters concern-
Ing the administration of the government of the City and
in regard to the services maintained by public utilities in
the City.
M. To exercise genetal supervision over all public buildings,
Ilublic parks and all othet public property which is undet
the control and jurisdiction of the City Council.
N. To devote his entire time to the duties and interests of the
City. except as may be specifically authorized by the City
Council.
O. To represent the City In discussions of administrative and
policy questions between the City and other levels of govern-
ment, i.e., County, State, Federal and other Cities, when
and if requested by the Council to do so.
P. To cooperate with leadership of civic movements designed
to benefit the residents of tl:ie City when so directed by the
City Council.
Q. To attend any and all meetings of any conunissions or
committees heretofore or hereafter created by the City
Council, upon his own volition or upon the direction of
the City Council.
R. To act as Petsonnel Officer for the City and to develop a
comprehensive personnel program.
S. To perform such other duties and exetcise such othet
powets as may be delegated to him from time to time by
resolution, ordinance or othet action of the City Council.
SECTION 8: COUNCIL POIJCY. The City Council and its
members shall deal with the administrative services of the City only
through the City Manager, except for the PUlJlO&e oJ; inquiry, and
neithet the City Council nor any member thereof shall give orders to
any subordinates of the City Manager.
SECTION 9: RESIGNATION. The City Manager shall notify
the City Council at least thirty (30) days In advance of his Intendeil
resignation. Failure to do so shall be grounds for withholding any
payment due him for his services. This provision may, howevet, be
waived by majority vote of the City Council.
SECTION 10: REMOVAL. The removal of the City Manager
shall be only upon majority vote of the whole City Council in regular
meeting. In case of Intended removal, the City Council shall furnish
the City Manager with written notice stating the intention to remove
and the reasons therefor at least thirty (30) days before the effective
date. In such removal, the City Council shall use its uncontrolled
discretion and its action shall be final.
SECTION 11. Within sixty (60) days after the effective date
of this ordinance, the City Council of the City of Seal Beach shall
appoint a City Manager.
