I 1 I " , - " RESOLUTION NUMBER ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ESTABLISH- ING HOURS AND LOCATIONS FOR SURFING PURSUANT TO CHAPTER 4, ARTICLE I, SECTION 4-8 OF THE SEAL BEACH CITY CODE, AND RECINDING RESOLUTION NUMBER 1650, AND ALL RESOLUTIONS IN CONFLICT HEREWITH. WHEREAS, Chapter 4, Article I, Section 4-8 of the Seal Beach City Code provides that hours and locations during which surfboards, padd1eboards, be11yboards, and skimboards may be used within the City of Seal Beach shall be established by resolution: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seal Beach: Section 1. winter Season. padd1eboard and surfboard surfing, and the use of be11yboards within the City of Seal Beach during the period of October 1 to June 15, inclusive, shall be allowed in and restricted to the following areas and following hours of the day and days of the week: (a) All day, seven days a week, from the westerly side of the Municipal Pier, northwesterly to the westerly jetty of the San Gabriel River, provided that this section shall not invalidate Section 4-2, Article I, Chapter 4, of the Seal Beach City Code. (b) An area easterly and westerly of the projection of Twelfth (12th) Street, said area to be determined at the discretion of the Senior Lifeguard on duty, with the concurrence of the City Manager: said area to be posted with a green flag secured to the roof of the Twelfth Street Lifeguard Tower when surfing is to be permitted. Section 2. Summer Surfinq. Padd1eboard and surfboard surfing and the use of be11yboards, within the city of Seal Beach, during the period commencing June 16 and ending September 30, inclusive, shall be allowed in and restricted to the following areas and following hours of the day and days of the, 'week: (a) In the area westerly of the westerly line of the Municipal pier to the westerly jetty of the San Gabriel River surfing and the use of be11y- boards shall be permitted daily from 7:00 a.m., to 11:00 a.m. (b) In the area westerly of the east jetty of the San Gabriel River to the westerly jetty of said river, surfing and the use of be11yboards shall be permitted daily from 6:00 a.m., to 8:00 p.m. . If any section, subsection, sentence, clause, phrase, or portion of this resolution, or the application thereof to any person, firm, corporation or circumstance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this resolution. The City Council of the city of Seal Beach hereby declares that it would have adopted this resolution and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentence, clause, phrase, or portion thereof be declared invalid or unconstitutional.
