HomeMy WebLinkAboutCC Res 1832 1970-02-16 I I I . , ,~ RESOLUTION NUI~BER J ! 3 d- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECOMMENDING MATTERS RELATING TO DEVELOPMENT OF THE COASTAL ZONE TO THE STATE OF CALIFORNIA. WHEREAS, the coastal zone within the City of Seal Beach was subdivided and developed over 55 years ago; and WHEREAS, since incorporation of the City of Seal Beach on October 27, 1915, the City has cooperated and taken the initiative in maintaining and developing the shoreline beach area as an irreplaceable natural resource for the benefit of the citizens of the State of California and the Nation; and WHEREAS, the City of Seal Beach policy and actions have and will continue to be in keeping with trust purposes for tide and submerged lands; and WHEREAS, the history of developments of the beach and coastal area involving cooperation and assistance of the City of Seal Beach and/or areas in Seal Beach and in some instances other government agencies include the following: 1, Jetties of 750 feet and 375 feet in length built on the east and west side of the San Gabriel River in 1932-33, with financial assistance of Seal Beach; 2. The west jetty extended to a length of 800 feet in 1940-41; 3, A third jetty of 600 feet in length at the mouth of the San Gabriel River constructed in 1940-41 west of the existing west jetty (in City of Long Beach); 4, City of Seal Beach constructed with local funds a 450 foot jetty at the west side of Anaheim Bay in 1936; 5, The City's Anaheim Bay jetty extended by the U. S. Navy in 1944 to form up coast entrance to Bay; 6. 800,000 cubic yards of fill placed on beach 1n 1954; 7. 200,000 cubic yards of fill placed on beach in 1956; 8. 225,000 cubic yards of fill placed on beach in 1959; 9, 700 foot groin constructed by City and Federal Government in 1959; 10, 85,000 cubic yards of fill placed on beach in 1968; 11. Construction of 1,800 foot pier in 1939 with City funds and federal assistance; 12, Settlement of tideland boundaries in the ocean beach area and execution of a lease for tide and submerged lands from the State of California in 1967; 13. Construction in 1944 of a stone revetment from east jetty 600 feet down coast from the east jetty of Anaheim Bay; 14, 202 cubic yards of material placed in erosion zone in Surfside area; 15. ~tone revetment in Surfside area extended by U. S. Navy 250 feet in 1946; 16, Private interests in Surfside reinforced bulkheads and further extended U, S. Navy revetment 300-400t feet; 17. 1,220,000 cubic yards of fill placed on Surfside area beach in federal- state-county-local financial program; 18. 875 cubic yards of fill deposited in Surfside area; and WHEREAS, the State of California leased areas offshore Seal Beach for oil production in 1954 and 1964; and WHEREAS, the City of Seal Beach has maintained and operated the beach area since 1915, involving a substantial local financial contribution which has exceeded a total of over $500,000 in the past decade; and I I I Resolution Number r WHEREAS, the City of Seal Beach has cooperated and will continue to cooperate with adjacent local agencies in the formulation of plans to improve the beach areas and the environmental and ecological conditions of the tide and submerged lands, including joint power financed studies with Orange County, County Harbor District, City of Huntington Beach, and private owners; and WHEREAS, the City of Seal Beach is currently engaged in updating its adopted General Plan (1966) by including a special shoreline"coastal zone element to the General Plan; and WHEREAS, the City of Seal Beach is currently engaged in solving a possible, future water pollution problem which will involve an expenditure of over $2,000,000 of local funds; and WHEREAS, the City of Seal Beach has maintained access to the beach areas and is working diligently to improve and increase such access using local funds; and WHEREAS, the entire history of the Seal Beach shoreline proves that better and proper development and utilization of the ocean and beaches as a natural resource can be better operated and managed by city government with proper guidelines from the.State and Federal Governments for the highest benefit to the people of the State and Nation, NOW, THEREFORE, be it resolved by the City Council of the City of Seal Beach, California, as follows concerning the matter of regulation, control and develop- ment along the California Coastal .Zone: 1. The use of existing Councils of Government would be preferable to a new layer of government or new governmental agency as a reviewing body of locally adopted and managed plans and developments of the coastal zone; the use of the existing and additional Councils of Government would involve elected local officials with professional advisory staff and would not further proliferate government or establish special interest districts. 2. In lieu of a moratorium on modifications within the coastal zone, the state legislature and governor are encouraged to establish policy guidelines for local emergency interim coastal regulations affecting the federal, state, county, city and special districts (with a permit system or approval or dis- approval by a Council of Governments after local governme~t determination if such a regulatory body becomes necessary) for mineral extraction, hydro- carbon and petroleum production, filling, dredging and/or distribution of bays, estuaries, lagoons. marshes, sloughs, tidal pools and/or the coastline; any adverse modification in the reduction of publicly owned access to the ocean from land; and/or the reduction of beach recreational areas. 3. A moratorium on modifications or emergency interim coastal regu~atjons concerning "impairment of the visual aspect of shore and sea" not be enacted which would be applicable to developed areas, such as the present coastal ci ties. 4. The Governor and legislature of the State of California to provide financial assistance to local agencies for acquisition by such local agencies of shoreline, access thereto, and the operation and management thereof. THE CITY COUNCIL DOES HEREBY FURTHER RESOLVE AS FOLLOWS: 1, . To cooperate with other local government agencies in the establishment of model ordinances relating to planning and zoning for the coastal zone. 2, To disallow any action which may be within the power and ability of the City of Seal Beach which would have an unnecessary adverse modification within the coastal zone as such modifications are stated above in connection with possible emergency interim coastal regulations prior to the City's adoption of a shoreline plan providing for the retention and enhancement of the environmental and ecological betterment of the area within this City. 3. To develop a shoreline and coastal zone element of the General Plan, which provides for local and state-wide benefits and which is integrated with the Coastal Plan currently under development for Orange County through the efforts of the County of Orange, the Cities of San Clemente, Laguna Beach, Newport Beach, Huntington Beach, Seal Beach, and private owners. . . '" . Resolution Number. .- I 4, To continue to utilize the tide and submerged lands in keeping with the present agreement with the State and the terms and conditions of the tideland trust. S, To take all actions necessary and within the power and authority of the City to prevent pollution of the tidal and ocean areas.
